Just because there is a right to free speech, that doesnt mean it exists for children in a public school. There is still a dress code and SCHOOL policies to remember. One of the rules of the dress code is that writing on a t-shirt can't be offensive to anyone in the school...no matter what the subject matter is. If I wanted to walk down the street wearing a shirt that says "F*CK YOUR MOTHER", I would have every right...but I couldnt wear it to school. See the difference?.
If the shirt caused disturbances within the school, then it should be proscribed. If it doesn't cause any such disruptions in the school, then they have no right to restrict it. Students' rights can be restricted, but if it's simply nonviolent protest like that, the school doesn't have a legitimate claim to intervene.

The UK we has "faith based" publicly funded schools which I disagree with. Muslim, Catholic, CE etc but most are mixed. So religious symbols are allowed but "dress codes" mean crucifixes have to be small. I think anti anything shirts should not be allowed like "America is the Devil" or "Islam" or whatever. I don't agree with all of the ACLU's goals, but the ACLU approached this church to help with this case, and they appear to be a varied group of lawyers with different focuses. In Europe this statement would have sent the students and Pastors to jail or they would have been killed by Islamists.

Just because there is a right to free speech, that doesnt mean it exists for children in a public school. There is still a dress code and SCHOOL policies to remember. One of the rules of the dress code is that writing on a t-shirt can't be offensive to anyone in the school...no matter what the subject matter is. If I wanted to walk down the street wearing a shirt that says "F*CK YOUR MOTHER", I would have every right...but I couldnt wear it to school. See the difference?.

Valuable tax dollars aren't supposed to be spent on things which promote a single (or a couple) over the others, according to the U.S. constitution.
The entire point of freedom of speech is that speech you do not like is allowed, if you liked it you wouldn't try to suppress it anyway.

As for whether it is legal, or should be legal, to discriminate against negative messages, I think this would mean that any shirt that mentions hell could be banned, because it implies that anyone who does not follow your religion deserves to be tortured mercilessly. The UK we has "faith based" publicly funded schools which I disagree with. Muslim, Catholic, CE etc but most are mixed. So religious symbols are allowed but "dress codes" mean crucifixes have to be small. I think anti anything shirts should not be allowed like "America is the Devil" or "Islam" or whatever. These serve one purpose and that is to stir up trouble. It may be different in the US but in the UK that kid would be klilled by other classmates. I do not agree with that but it is a fact.

I am one of the kids who wore a shirt, and what they also left out that first the school was fine with the back of the shirt being covered. then suddenly after 5 days of wearing it the principal got complaints and sent us home for the day. we received no proof of complaints.
And furthermore, we also wore shirts that simply said "IIOTD" the initials, 3 days for that. and since everyone says that education was disturbed, what about ours huh?

I don't agree with all of the ACLU's goals, but the ACLU approached this church to help with this case, and they appear to be a varied group of lawyers with different focuses. Whether we in America can say anything negative about Islam without cringing in fear of some fitna or fatwa is a very important question. In Europe this statement would have sent the students and Pastors to jail or they would have been killed by Islamists.
Fox is also a mixed bag...

If the ACLU really did promote secularism that would be a good thing. I'm not saying everyone needs to stop practicing their religions but promoting religion just causes trouble because people should keep their religions to themselves. But the same goes with atheism and agnosticism too.
