What happened to INNOCENT until PROVEN guilty? Huh? In other states they require a WARRANT to get your blood, etc for a drug/alcohol test. People in Florida have no 4th or 5th amendment.

In all states, you either have a choice to take the test, or you get arrested. that's how it's always been. If you chose not to take the tests, you are considered guilty... that's the way it is.. just so we are clear. it's understandable.

You don't get arrested for refusing the test, you get arrested for reasonable cause that you are presumed intoxicated and have been driving a car. Of course, later when you stand before a judge unless the arresting officer has some evidence to prove you were intoxicated then the case should get thrown out. Thats where the cop's dash cam comes in, it can be proof of intoxication and sufficient evidence to get a huge fine and/or jail time for being drunk.

I understand. They are arrested for suspicion of being intoxicated but not for refusing to take the test. Take the test or not, if the cop thinks you're intoxicated and you are, you're getting arrested. Taking the test if a person is drunk only confirms it. Most lawyers, if stopped after they've been drinking, will refuse the test. Taking the test is good if you are innocent, not if your guilty.
