Google the human rights case of Gillan & Quinton v UK. In that very recent case s.44 was declared illegal by the European Court of Human Rights and since then, Theresa May has abolished it. In short, s.44 no longer exists because the courts and the Conservative government recognised that it was oppressive and unjustified.

If he said nothing then they would have grounds to believe that it is an extreme circumstance and therefore would be able to detain him under s44 of the Act.

Like I got stopped once taking a photograph at Night of a building that I was trying to get, and the security guard kicked me off, but I was on his property he has the right to do that correct? Photography in a public place is not against UK law. Only the police or the security forces can stop you and they must have a good reason to do so. That means they must have reasonable grounds to suspect you are breaking or have broken the law. They should know what law it is and how you are breaking it. They must tell you when asked. Unless they arrest you, you do not need to give them your details. It's that simple. But be sensible, the police are there to help and have a difficult job.

Google the human rights case of Gillan & Quinton v UK. In that very recent case s.44 was declared illegal by the European Court of Human Rights and since then, Theresa May has abolished it. In short, s.44 no longer exists because the courts and the Conservative government recognised that it was oppressive and unjustified.

If he said nothing then they would have grounds to believe that it is an extreme circumstance and therefore would be able to detain him under s44 of the Act.

Photography in a public place is not against UK law. Only the police or the security forces can stop you and they must have a good reason to do so. That means they must have reasonable grounds to suspect you are breaking or have broken the law. They should know what law it is and how you are breaking it. They must tell you when asked. Unless they arrest you, you do not need to give them your details. It's that simple. But be sensible, the police are there to help and have a difficult job.

@YoungNLive in this case he did know the law better than an officer. In fact i think you can see, he understood the law and more importantly his rights, better than 3 police officers .

@YoungNLive You , and im assuming you are a police officer from your "id nick you" line, police officers are given the powers by us the public , to protect us not to harrass us . do not assume that the public will always bow down in submission to the police some of us know what we can do and what you cant . its the people like you (stubborn, cocky and with a badge) that ruin the public perception of the police force .

As a photographer, if that is what you choose to call yourself, perhaps first you should take care to find out what can and cannot film, then this situation would be avoided.
Anywhere such as that building, a train station, a shopping centre etc, somewhere which is PRIVATELY MANAGED, is not a public place to do as you choose. If you are asked to stop, it is their legal place to do so. Kicking up like a 10 year old doesn't change it.
They are well entitled to claim on the anti-terrorist law.

Think about it for a second. How many cameras do you think there are attached to that building watching every single person walking by and on every building in london. its now illegal to film any member of the queens service as it may be used for terrorist activity. Ian Tomlinson died at police hands, something they tried to cover up. The government know how powerful a weapon cameras can be and there taking that away from us.

How many people die or indeed are injured per year by terrorist action? If it really was about protecting the lifes of innocents, then the police should be rounding up the managers of macdonalds as heart attacks are a much bigger killer. I want to be free and I'll run the risk of being killed by a terrorist.
