The reason of banning mines and cluster bombs is that they persist (CB got huge dud rate) and threaten long after peace have been signed. As a consequence they make peaceful existence harder and promote war for 'fresh' territories.

Well, even considering the unacceptable damage and loss of innocent civilian lives by cluster munitions, it is still a vital weapon in military tactics. This is how achieving air superiority can help countries overcome enemies far larger in number. What we need is a new generation of cluster munitions whose bomblets are timed so they explode there and then or blow up after reaching a certain altitude so they are not like mines planted for years which can harm innocent civilians.
