The state has to follow the law. All states required that before post conviction dna testing be granted, the defense must show that if the results are exculpatory, there would have been a different result at trial. Skinner can't show this because of all the evidence which proves that he is the murderer, which doesn't magically disappear no matter what the results of any further dna testing.

I support the death penalty, but only if the guilt is beyond reasonable doubt, that is if there's DNA evidence that links the defendant to the crime in some way. He was denied a DNA test, and this is a glaring ommission.

You're not cognizant with the terms "due process" and "fair trial". First off, there's a slew of pieces of evidence that hasn't been analyzed to date, including the murder weapon. I know Hank's lawyer refused to have that evidence analyzed for fear that it might be damning, but Hank was not informed of that decision.

There are other possibilities that haven't been analyzed: Hank was passed out because he had taken too much codein. Hell an expert even testified he could not physically committed that crime. But that's not the issue - the issue is that there COULD be other suspects, there IS reasonable doubt about Hank's guilt.
And even if there's a small trace of reasonable doubt, the State must STOP the execution and commute his sentence to life or some other sentence.

In capital cases it's always good to err on the side of CAUTION.

Enough! Hank should have had the evidence tested before the trial, not wait and see what happens, then ask for testing. If he was innocent why wouldn't he want the evidence tested when it was prudent. There is no evidence that someone has been put to death by execution erroneously since at least 1950. Even though the interview is pieced together it indicates deception from his body movements.

I confess I dont know the case. Im just going off the news report. Ive never done any investigation. Im simply saying what I said based off this. If there is DNA in any case it should be explored. I myself have had problems with police refusing to give me a breathe test but charging me with open container. Ive seen the corruption first hand. His attorneys decided not to test this stuff because it may incriminate him. In law only new evidence that did not exist at the time can be pursued.This is a last ditch effort to save his life to buy time. If you allow these guys to constantly recover the issues that their attorneys should have addressed at that time. All this DNA was there? They did not pursue it.

Double Jeopardy just means you can't be tried for the same crime twice, he may be innocent but with out strong enough evidence to warrant a new trial, the fact that he wants to take a DNA test isn't new evidence.

This is just awful... personally, I think he is guilty (after 17 years of convincing himself that he is innocent, he probably believes it now) but no one will know for sure until the DNA test is done. Is Texas really that cruel that they won't even pay for a DNA test to end the man's suffering and bring the case to a close? He's been on death row now for 17 years, and still waiting for a simple answer...

The state has to follow the law. All states required that before post conviction dna testing be granted, the defense must show that if the results are exculpatory, there would have been a different result at trial. Skinner can't show this because of all the evidence which proves that he is the murderer, which doesn't magically disappear no matter what the results of any further dna testing.

I support the death penalty, but only if the guilt is beyond reasonable doubt, that is if there's DNA evidence that links the defendant to the crime in some way. He was denied a DNA test, and this is a glaring ommission.

I know Hank's lawyer refused to have that evidence analyzed for fear that it might be damning, but Hank was not informed of that decision.

There are other possibilities that haven't been analyzed: Hank was passed out because he had taken too much codein. Hell an expert even testified he could not physically committed that crime. But that's not the issue - the issue is that there COULD be other suspects, there IS reasonable doubt about Hank's guilt.
And even if there's a small trace of reasonable doubt, the State must STOP the execution and commute his sentence to life or some other sentence.

One of those cases ultimately resulted in the exoneration of Anthony Graves. I know Texas has executed innocent men, and I do not feel that any error is acceptable when the error is the loss of human life.

Enough! Hank should have had the evidence tested before the trial, not wait and see what happens, then ask for testing. If he was innocent why wouldn't he want the evidence tested when it was prudent. There is no evidence that someone has been put to death by execution erroneously since at least 1950. Even though the interview is pieced together it indicates deception from his body movements.

They need to DNA test so without a shadow of a doubt whether he did this or not. Look at the men who have been wrongly locked up for 30+ years and now with todays extensive DNA testing are able to finally realize they were wrongfully procecuted and set free. How can they put a man to death without this DNA proving he did it or he didnt? If it's right there in front of them? That's not the fair part...is it? Twila had skin under her nails..? Who's is it then? Since Skinner only had a cut.

If there is one thing we know about Texas and that is they kill more people than any other state, they just love killing a person.
However, what they need to do first is make sure he is guilty 100%. Even if there is a 5% doubt a person did not commit a crime, they cannot and should not be put to death. The DNA testing needs to be done, DNA does not lie....

I confess I dont know the case. Im just going off the news report. Ive never done any investigation. Im simply saying what I said based off this. If there is DNA in any case it should be explored. I myself have had problems with police refusing to give me a breathe test but charging me with open container. Ive seen the corruption first hand. So if theres DNA there is a reason its never been tested. Cops dont do stuff that doesnt help them railroad you.

@Pimpintology They never test all the evidence because not all evidence is forensically relevant and Skinner didn't want it all tested. After his conviction, he had nothing to lose by asking it to be tested. Skinner's own blood spatter expert's opinion was that it was Skinner who beat Twila to death. Skinner also confessed but because an atty was not present, the confession was suppressed. He's guilty of triple murder.

@Pimpintology I know the case well and have followed it. Hanks Skinners attorneys had a chance to test this DNA from the beginning. His attorneys decided not to test this stuff because it may incriminate him. In law only new evidence that did not exist at the time can be pursued.This is a last ditch effort to save his life to buy time. If you allow these guys to constantly recover the issues that their attorneys should have addressed at that time. All this DNA was there? They did not pursue it.

Is it possible for his lawyer , doctor or any means outside the court to have a DNA test done? If so wouldnt the results of the test be "new evidence" ? Of course if the test did in fact show it was not him wouldnt this be more than enough to warrant a new trial?

@kirbylee57 No, no, and never going to happen. Once again, no dna test will make all the evidence against him magically disappear. One of the reasons that Skinner & his atty did not seek more dna testing before trial, was because their own blood stain expert reported that the blood stain patterns showed that Skinner lied. He was not laying on the couch but up and about and that he was the one who bludgeoned Twila to death. There was also a confession that was suppressed.

Double Jeopardy just means you can't be tried for the same crime twice, he may be innocent but with out strong enough evidence to warrant a new trial, the fact that he wants to take a DNA test isn't new evidence.

This is just awful... personally, I think he is guilty (after 17 years of convincing himself that he is innocent, he probably believes it now) but no one will know for sure until the DNA test is done. Is Texas really that cruel that they won't even pay for a DNA test to end the man's suffering and bring the case to a close? He's been on death row now for 17 years, and still waiting for a simple answer...
