  • Those of us who are fighting a much larger battle for our rights and freedoms would appreciate it if you wouldn't nitpick local bylaws and regulations that involve the safety of the population based on the amount of precipitation that was received. You obviously know these EMS and I don't know your history with them, so I can't make an informed decision. I do know that you know you have a volunteer FD and 2 were enjoying their day like you, but you felt the need to use GOV funds 2 use them.

  • the police and volunteer firemen were pretty darn nice considering the "fight" you were putting up with your fire.  You could have simply put it out and done your burning according to the city codes (50 ft away from a structure) - they were just doing their job and not trying to ruin your weenie roast. You may be careful and control you fire but others may not, and that's why they have those type of rules.

  • Did John know when he took that job that he'd have to enforce stupid rules like that? Yes. Whether or not he agrees with them doesn't change the fact that he has to enforce them. But taking that job also came with the responsibility of RISKING HIS LIFE TO SAVE PEOPLE FROM FIRE. And he's doing that for free. Does that not matter in all this? Doesn't that more than make up for whatever stupid rules he has to enforce?

    And are fire-related laws really that terrible and oppressive? Fires spread

    That isn't there decision to make. They're there to ENFORCE the laws. That's it. Whether or not it's a stupid law, or whether they think it's a stupid law, is no matter to the fact that it's their job to enforce the law. I think it's a stupid law, but I would still enforce it or put out the fire if it were my job. You know who you should be angry at? Whoever the hell called it in.

  • @BroccoliTowel the law is a piece of paper and nothing more. police should let people peacefully go about their business (and not extinguish campfires). if their is a conflict between persons, police should help mediate the dispute.

  • It certainly looked more than safe to me. Low flame , Rock and dirt all around. We don't know what the wind speed was , or the humidity level or the temp. it's seems as your typical case of authority trying to say Hey I'M the Law.

Check the RSA's it is illegal to tape your audio in the state of NH unless they have your permission, which I know they didnt. This is a fact!!! I am sure you know this and because you feared for your safety and you did not have back up with you at that time, you are working on this charges. Then throw in the burning fine as frosting.

  • Whatever happened to personal accountability? We don't need officer to help us take our own safety into concern. You are ultimately responsible for your own safety. The guests on your property are responsible for their own safety and so on. If I was somewhere and I felt my safety was a concern I would promptly take action. If you do damage to your property or someone elses. you are responsible if it was your fault. and should be held accountable according to the law....

  • This is ridiculous. We have fires about 3 feet away from stockpiles of firewood that has been drying for several years, and we were never once endangered. Thanks for not complying with such a silly order.

  • Note that in a free society, both parties here would go to mutually agreeable arbitration, where it could be decided whether the force was justified or not.

    I doubt they'd rule that a tiny fire in a pit like that was an imminent threat.

    Instead, since we've got a one size fits all government, they get to make up whatever baloney they want, and there's little or no recourse.

  • When I owned that property (up until a week ago), I tried to use the mulch to fuel a fire - and failed. Couldn't get it to burn well.

    What qualifies an act as an initiation of force against me?

    If a cop draws a pistol because I don't obey his orders, can I justifiably shoot him to protect my life?

    How close to my property, out of control, & large does a fire have to be for me to justifiably enter my neighbors property to put it out?

    If a neighbor points a missile at my house, can I justifiably destroy his missiles?

    I'd say if you are being eminently threatened, you have a right to defend yourself or your property. This had nothing to do with defense -- the idea that that tiny fire in a well defined pit was an eminent threat is absurd. It was code enforcement.

    I think it'd be reasonable to put out a fire that's a truly clear and eminent threat to yourself or your property. One should err strongly on the side of caution with the use of force, however, -- and this was nowhere close to meeting those criteria.

    It's also the case that a person should be responsible for any damages they cause. This, rather than threats of fines, should be the main deterrent for irresponsible behavior.

    Agreed. The tort law for damages has always been crystal clear. But the line at which a threat becomes imminent remains fuzzy. By international law, an imminent threat is instant, overwhelming, leaving no choice of means & no moment for deliberation. The fire in the video was not an imminent threat to anyone but the ants in the fire pit. But a cop drawing his pistol in my opinion meets all these criteria. We just don't defend ourselves because we would die or be jailed for life.
