  • Obviously he's parodying his own detractors. He's done tons of interviews discussing his disdain for copyright law. Do people really think a former biomedical engineer is too stupid to recognize the parallels between what he does and internet fan videos? And yea, you can buy his albums. He also tells his fans to just download them for free. I'm sure he's under no illusion that the reason he sells out all of his shows without ever posting on the top 40 is because of file sharing.

  • It doesnt come directly out of his pocket. its a complicated process the whole thing. Venues (i.e a bar) have to pay a sort of permit to the royalty company to play public broadcasts in their premises. the bar then keeps a playlist of the music played in the place which is given to the royalty company to sort out payment. Its ilegal to make money from the recording (cd) not to play it live. He would be treated much the same way as a radio dj who also has to write a playlist for royalties

    He's doesn't pay anyone royalties because his music falls under the Fair Use Act of media so he can use as much material he wants without owing anyone a cent.

It doesn't matter if some of them don't have a problem with it - all of them are being affected, including those who haven't acquiesced in his usage.

Fanmade music videos using clips of other shows are taken down since they don't have the permission of the the companies to use their material. Viacom has been getting tons of shit for copyrighted material being uploaded by the users. Why do you think that you'll never see an entire episode of The Simpsons on here?

    Current law provides that any unauthorized use, even a single note, is enough to constitute copyright infringement. Fair Use only applies to a narrow range of exceptions.

    Crediting an artist is polite, but if he's not paying that artist royalties on the profits he makes, that's simply wrong. It's stealing from other musicians, man - I don't understand why more people aren't upset about this.

  • The only thing that I can think of is that artists see his music as a sort of free advertising. Speaking for myself at least, I have download (actually bought) at least 15 different songs that I've found through Gillis' music. He is doing those artists credit by using their songs.

  • To a degree, this might be another factor that's holding the lawsuits back. It definitely doesn't do anything in terms of justifying what he's doing.

    Another consideration is the fact that, while he isn't making some money, perhaps he's just not making enough yet to provide a sufficient basis for a profitable lawsuit. (Read: he hasn't gotten rich enough for the industry dinosaurs to catch on or care). The debate over all this is super interesting.

I'll also point out that he presses and sells physical recordings of said unlicensed mashups. If you really care about any of this, you'll no doubt remember DJ Drama's situation?

  • Venue owners are required to pay licensing fees to the major performing rights organizations (ASCAP, SESAC, BMI) in order to obtain a blanket license which allows for their performers to play other artists' music in their establishments. We're all just "trying to make a living," and I'm a DJ myself, so I'm unsure as to how that bolsters your argument in his favor at all. I'm sure when he plays a club, the owners are covered - my point is that Gillis himself is not.

Yes I am law student myself and I want to see this case brought as it will make for an interesting read.

    While I not a fan of IP law I personally think what Girl Talk does is under the fair use. And the sampling that he does is much different I have heard from other artisits. But thats my opinion.
