So there should be no legal issues with paying in pennies. Refusal is refusing legal tender which by law is for ALL DEBTS public and private. If they don't like pennies then remove them from circulation.

Thought it's a federal crime to possess it, the state recognizes it as legal. Therefore, while the feds would crack down on you in California, the state itself will look the other way.

    I'd say it's a similar case with a much smaller body of government.

  • Srry its Canadian regulation to protect merchants from having to spend hours counting pennies, all banks have to accept though. As far as I can tell in the USA, all coin is legal tender for private public debts, but go read snopes.com/business/money/penn­ies.asp. which explains that buisness still has the right to refuse any legal tender currency, although they should state somewhere that this is part of the contract (eg. wont accept any denomination over $20).   • AHA I found a currency regulation that says coins are a type of subsidiary currency , and a merchant can refuse anything over 25 cents, but it seems if they are rolled, no bank can refuse to exchange. If he wanted to peev the gov off he shoulda bought a turkey for whatever the cost of the tickets, pluck some feathers, ink onto it the amount, sign and then bring it in as a negotiable instrument, farmers still do this today to pay the tax man (IMF).

    Look at the remainder of the Uniform Commercial Code. Sections cover time of payment, place of payment, type of payment, and so on. Pay attention to sections covering check, casher's check, teller's check, certificate of deposit, and so on. There is no requirement anywhere within that code to accept cash or any particular form of cash. Again, entities have a right to set conditions (when, where, how, etc) on payment of a legal debt.

If this "cowboy" refuses to comply with those conditions (not pay), he can reasonably expect even greater fines and (depending on state laws) potential loss of his drivers license.

Mastercard, Visa accepted only is a clear violation of Public Law and is a criminal offense. Public Law means that HJR 192 has been codified and is law. I've had one of those private ones and they aren't worth the paper they are printed on but then, neither are the so-called official ones if you know how to deal with them.

    Second, there is case law that limites the amount of penny they have to except.

    Third, have the number of FBI and or department of the treasury so you can complain about a law being broken.

    Forth, last but not the least record the refusal.
