One should be able to record a public servant anywhere, seeing that tax dollars are paying that public servant's salary (of which they mostly forget at times). Not only that, the Bill of Rights takes care of that, It's called Freedom of Expression. Enough said !!!! so, record away.

@yourroaddog I already gave that answer above, not only that, one can issue a subpoena for the camera, but I find it unlikely that the camera will testify in a court. After all, one has the right to confront and cross-examine their accuser.
@PennaPlanum No, I think he said from a private space because I know there is a stipulation for recording private space so long as it is recorded FROM public space. This only doesn't hold for certain more secretive federal or national security locations. eg. a military base.

California for propositions to get laws on the ballet. So it will take work to get a law crafted to allow the citizens to record the cop both audio and video. The second goal is to keep the cops from leaving an audio mike on your car while they go back to the squad car and recording you. Third keep any sex tape of husband, wife private. Fourth some will have word the proposition so that reasonable distance from cops as not to interfere but close enough to see and hear what is going on.
Really? How did U come to this conclusion Sherlock? There are so many abuses of citizens civil liberties that Amerika lost so much freedom after 9-11. Cops demanding ID cards for citizens standing on public sidewalks and people being detained and questioned for taking photos.

Put in the words of the time: They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety." Ben Franklin.
Wouldn't that mean the same in court too? Courts are public property paid for by tax payers, therefore in my opinion we should always be able to record there as well..
@madjimms do you know how many times the government has used your tax dollars to bail these airlines out?the american people own a part of just about every car manufacturer(amercian cars of course)and financial institution in this country.
@allnamesaretakenful Once America actually promotes the benefit of the people & not rich CEO's I will support US products, but I doubt that will happen very soon. :-(

Why would you get "roughed up" if you videotape a public servant in a public place while they are doing the job you are paying them to do. We are now on notice to fear our government.
Ok on the TSA side of the question, unless some thing has changed since I left the TSA there are a few reasons that cretin things can not be photographed at the check points. First of all you can exorcize any of your rights any where so long as it does not violate the rights of others. That is why you can not photograph the X-ray monitors. There are things at the check that should not be photographed for security reasons. (mostly equipment) The TSA personal are fair game so far as I know.
I say it is legal for evidence. Even if someone got a video of a undercover cop dead it can be used as evidence and back up. Only evil people don't allow. Therefore for cops who don't allow filming in public should be investigate right away.

Illinois, Maryland and Massachusetts have specifically made it "illegal to record an on-duty police officer even if the encounter involves you and may be necessary to your defense, and even if the recording is on a public street where no expectation of privacy exists."
Look up the 'legal' definition of the word 'Public' ... and you will know that it means: 'Government' (ie: Public Works, Public Property, Public Park) ALL Law is a word game ... and by understanding, or Standing Under their authority ... you consent to your own slavery.
@daliOtter So would you be cool if a camera crew followed you around for a week 24/7 and put EVERYTHING on youtube for your friends, family (mother grandma father kids), co workers (boss, supervisor)? Think of all those F bombs, racy jokes, stupid habits, etc etc that everyone will get to see. I'm not talking about getting caught dealing drugs, shooting and raping but 9 times out of 10 its the 9 catagory small stuff people catch all those 'bad' and 'dirty' cops doing.
@FreelancerCalifornia Your comment is so absure it's insulting. First off, no one is following them 24/7, but rather filming them while they are on duty and working for??? you guessed it, the American people. Personally I would think cops would like to be filmed for their own protection so when some a-hole slams his own head against the concrete and claims the cops assulted him there would be video proof of what really happened.
@daliOtter Its called iCop, records everything a cop does on duty and saves everything 3 seconds prior to turning on emergency lights and any encounter they choose to record and saves it on a harddrive to be used later in court or as evidence. They love it, only problem I see is that here your proven innocent till proven guilty so you never have to deal with if your not doing anything wrong you have nothing to hide guilty untill innocent way of things so that doesn't seem like a good reason
@FreelancerCalifornia Actually you are guilty if you comitted the crime period, we just don't punsh people unless we can prove it. Example if I killed someone I would be guilty even if I got off like OJ did. He is guilty we just didn't punish him because supposedly we couldn't prove it.
However, staged recording in public, depending on state you live, may not be legal. Example, if you put up a hidden camera and then try to get/push a person or a cop to commit in abusoive behavior. In some states this will be entrapment and may be unlawful. But, lets say you setup a hidfden camera shooting a spot, then catch a person or cop in act, (remember Rodney King), the video is then legal and admissible as evidence. As I wrote below, I record myself in public and its helped me many times.
Recording anything in public unless posted sign, ordinance or Gov restriction prohibits such recording is legal. Whether it can be used in court is another story. I record myself all time while driving & coming in contact with unknown person in public. This is done in conjuction with recording my life while in public and if it leads to any findings it can then be used to defend myself. Police officers nowadays record themselfs for protection from public and it is no difference if you do it.
I was told by cops here in New York State that there's a statute prohibiting photographing someone without their permission. I was photographing them trailing and shadowing me through a mall. And I was ordered to delete the pictures. How can I find out if they were lying or if there is such a law?
@xander7ful Go to your local congressman. They actually did something illegal by "making" you delete the pictures. They would need a warrant for that. However, you did say that you deleted them, not the police themselves, so that could be their loophole.
I come down pretty consistently on the side of civil liberties. My only concern with the recording of courtroom proceedings would be in the case of a witness testifying against persons involved in organized criminal enterprises. These witnesses often need the courts protection from these vicious criminals who think nothing of committing murder for hire.
Thank you for the info. Does it apply to Illinois? I would love to expose individuals for infractions commited by public servants and victims' statements not believed (or ignored) in the courtroom by judges. The police lie as does TSA.
@RP4409 maybe in your state but in Illinois you can only bring them into a specific part of the building. There are a lot of laws that complicate things like that.
"TSA does not prohibit the public, passengers or press from photographing, videotaping, or filming at screening locations, TSA may ask a photographer to stop if they are interfering with the screening process or taking photos of X-ray monitor screens in a checkpoint."
Just to note off the bat is to watch your own language. You ask can you, while the question should be may I? It's not possible to do something without permission or contrary to the opinion of so-called legislators.
"The First Amendment protects the right to gather information about what public officials do on public property, and specifically, a right to record matters of public interest." Smith v. City of Cummings
question how about A usual public area such as city park BUT the city rented it out for wedding. Now that could considered private would the laws now pertain to and video switch to private? How about uninvited guests?
Does the law change when the police officer requests you to come and sit in his cruiser? I had a police officer do that once, and I did not know if I was required to go with him or if I could record or video the conversation once in his vehicle. Maybe it would then not be considered public anymore, so I would not be able to record it?

Anyway, I learned a lot of tricks of the trade from a Christian/retired officer from old school. they can detain you in their car, and while looking back {recorder off} they can say you nodded your head to a car search.
@snowfallzz yes let them find whatever they want. So long as you know you did not consent then the search is illegal as is any evidence found during the search, no matter how guilty you may be from the evidence found.

@faithhopelovep91 your right except scum cops don't like being filmed when there out there beating, raping, tazing, and murdering people for the fun of it.but there have been cases where police didn't mind getting filmed while they where having sex with sheep and other farm animals

Tarrin, this was so cool. I literally was just taking a walk the other day wondering about some of these questions. All the stuff lately with Sam D., and the Motor Home Diaries folks, well, it's just got me thinking. I'm really liking what you're doing and have subscribed!
Keep up the great work!

Whatever is done in public IS public.
Any government officers who prevent recording of any public happenings are evil and hiding something. They answer to we the people, not the other way around.

@faithhopelovep91 your right except scum cops don't like being filmed when there out there beating, raping, tazing, and murdering people for the fun of it.but there have been cases where police didn't mind getting filmed while they where having sex with sheep and other farm animals
