  • 160 people including myself received a notification from Google Legal that a lawyer representing YouTube user yahsladynred wants our private docs. The people on that subpoena have done nothing to warrant legal action against them. It is just a malicious abuse of the legal system to harrass people she doesn't like. She nor her lawyer has any legal right to our docs, and she has placed a comment on YouTube saying our full legal names would be published. The system is flawed!

  • Well I recently got a DMCA cause I was doing videos wondering what really happened to Jesse Woodrow, cause some people think the illuminati got him or something else happened to him.

    All I did was use a picture which was an advertisement he was part of, and talked about how peculiar it was in a video, and I was slapped with a DMCA for showing it for a few seconds.

    Would that be classified as a false DMCA?

  • I have seen the idea that if someone files a DMCA that is false, there is recourse you can take to get the file lifted. If it is that obvious that its some guy in a cafe that ran away after he did it giggling like a school girl, youtube will go "Oh so that was bogus." and the flag will be lifted. Pain in the ass but nothing can really come of it of you are falsely accused. Still its annoying and there should be a better way of controlling such actions.

  • I'd like to agree with T3hFatass about his idea of how anyone can avoid the DMCA banning their channel, but however this does bring up that if this same person who does this; may not be able to make a video on their channel, not a single one. If a person is going to be able to file a DMCA then they should be subject to one also to keep everything fair. Youtube can get around the false DMCA's at cyber cafes by only allowing people with at least one video able to file them.

  • @SeeingUFOzPA If enough people are interested in it, it can be a serious case, it sets a precedent. That's how law works. If enough groups are interested in such a case, it can easily be taken to the supreme court, not because the plaintiff's complaint itself. Once they decide whether filing false DMCA is wrong under specific circumstances, future law cases will use that decision in their arguments.

  • As far as I know, only the owner or a representative of the owner can do such a thing.

    Basically, if you compose and play a song and sell it online; it's your right to do that, since you're the owner. It's copyrighted to you.

    However, if I then buy the song and put it on my server and make it freely available to everyone without your permission, you may file a DMCA against me, as I'm robbing you of your income from sales of your song.

  • Well anyone with half a brain can easily avoid any detection by creating a fake account and filing the DMCA from a internet cafe or any public wireless access point, so even if someone bothers to track your connection they will not find anything, then again since most of the people who file these false DMCAs are religious fundies they probably dont have a sufficiently high IQ to do even that.

  • @T3hFatass umm...you do realize that even if someone were to use an internet cafe or public wireless access point, that every computer, when it connects to the modem, leaves a specific imprint that can be tracked. it is kinda like a fingerprint, just with a lot of numbers. but then again it takes a long time to figure out what one filed it, along with who bought it. and you are right, i think the average fundie IQ is 78...but it might be lower, they kill brain cells for fun. lol

  • @TrutherD1 you are right that it is possible to remove modem and router logs, and at that point it would be very difficult to track them down. however if someone was really going to all the trouble such as checking router logs, then there is most likely a full investigation that would involve interrogating the employees and employer of the cafe. as unlikely as it is, i am sure it has happened at least once. also, from my experience, admin pages aren't difficult to access.

  • The individuals who would need to file any perjury charges would be YouTube. Not the the person the DMCA was filed against. When you file a DMCA you sign a good faith oath to YT that you are telling the truth. So it would be YT who would need to file those charges. The rest is a civil case. The person who was filed against needs to defend. A court would first have to determine it was indeed fair use.

  • To file a DMCA safely against these atheist go to a lawyer. It costs like 50 bucks. Call up for a consultation. Explain the issue. Get your lawyer to file the DMCA for you. When they counter claim they get the lawyers info. To claim fair use it must fall under all the outlines (4-6 depending on your country). If they claim fair use you can claim derivative. Better yet take all your videos and copyright under a collection and sent a cease and desist. Cheap

  • I did search for it but if someone is posting a vid informing people of something then I think they should, well, inform people what's got their knickers in a twist.

    Having done a lot of legal translating in my time, I tend to be pedantic. Hence my asking the vid maker whether all these various phrases mean the same thing or not.

    My curiosity is fairly legendary, thank you, but remember: Google is not the only search engine.

    I mentioned on roseboosje's vid earlier that since if you file a counter claim you give your contact info to the person filing the DMCA, its only fair that if someone is to file a DMCA they should be obligated to give their contact info to the other party. I think this would stop most DMCA nazis from filing them. I see it as a open hole in the system that needs plugged. :)

  • This is true. But the party that runs that Gambian proxy server may still have ethics. They get a letter informing them that a client from America used their server to download child porn or some other unethical behavior. They are under no legal pressure whatsoever to do so but they balk at this misuse of their service and burn the cache to CD right away for the police to mull over. I'd do this.

  • You can use a proxy indeed. But proxies are run by third parties who can be forced to hand over session information by a third party. Sure, they can clear their cache regularly or even on every logout, but the party that runs a proxy server has an incentive to keep user information so that, if push comes to shove, they can hand it over and transfer the attention away from themselves.

    They know your IP address but then you should get another court order to get the ISP to tell you witch person is behind that IP address

  • Youtube don't specifically know that. They will have your IP address, however. Yes, it might take a court order for the information to be disclosed by them or an ISP, but ISPs are hardly under a great deal of pressure from their customers to secret information about computer crime, are they?

Youtube's servers contain the IP addresses of all machines that connect to the site, including those used to log into accounts. even if you give false details, this cannot be hidden unless you use a proxy. A simple google search for an IP address will find the ISP and probably the locality of the server. It is then a simple matter to ask the ISP for your identity.

  • And using a proxy does not hide your IP either. The proxy will contain your IP address and the party that runs it may be asked for this. All it does is slow the process of obtaining it by adding another link in the chain. A dynamic IP address does not hide you either, because ISPs use specific ranges for specific servers and localities, inwhich you will be found, and very likely the ISP keeps records of what IP was assigned to which physical device (home broadband router) in certain time frames.

  • There is a nifty piece of free software out there, which I will not name, that alows users to create, or 'mask' their IP and MAC addresses. If someone wants to stay hidden on the internet, they can do so with very little effort. PS - For those of you who know, yes, it is a lynux based product.

  • There are at least 8 unsecured wireless networks right here in my little podunk town, that I know for sure I can access the internet from. One of them is our itty bitty little library's network. I can sit outside, in my car, any time day or night, and get on the net with my laptop. I do this whenever my cable goes out or my home network fucks up.

  • It seems to me, that it would depend on the case, and the cost-benefit of investigating any supposed crime. I have never even been approached while accessing remotely. My library has signs inside advertising the fact that they have wireless access, and I have noticed people outside on their laptops many times. I just never paid any attention as to who they were, or what they were even driving. I think that this would probably be the same everywhere. Very very small risk.

    If I wanted to file a false DMCA I'd go to a publicly available computer in a shopping mall, put in my $1 make a youtube account & false DMCA with false info 3 times on an account. Account suspended. Person appeals DMCA, then I tell youtube I plan to sue the youtube account holder. It all ends there. Account dead & no electronic finger prints left.
