and to correct my earlier statement the city is justifyign the charge under code 9.72.370 - Public property and misuse of a motor vehicle so the city is within their right. The media has false reported the story as a parking ticket which is incorrect. The lady was found in violation of the municpal, code however the city screwed up if it can be documented that $15 tickets were issued in the past. Should be interesting.
what the city has done has reclassified a pariking violation as a civil offense thus the justification for the higher charge. Only one problem now is a conflict within their own municpal code especially if the city has knowing charged $15 in the past for parking on the grass. So the question, is the city calling this a parking fine or a municipal infraction. The possible out is the city misapplied the code and bypassed the schedule of fees illegally when charging her this amount.
