And my friends do weed but I never smoked pot or even drank a drop of alocohol ever once in my life and she suspected I had marijuana on me because she smelled. My 12th grade U.S./Virginia Government teacher ingrained all of this into our minds. We watched this video and she went out of her way to have lessons on this stuff. Turns out it's really effective. I used all of these tips and the cop let me go. I didn't even have anything illegal in the car but it felt good to exercise my damn rights. Cop told me to "Get the fuck out of here and have a nice day" after all of that bullshit. Guess he was pissed haha!

Every time my friends or I are stopped by the police they say, "I smell marijuana can I search your car." At least with the plain view rule they can't say that they see marijuana when there isn't any, but what am I supposed to say when he says that he smells marijuana when there isn't any. I've never had any or smoked any when the cops pull me over they're bluffing and its not fair because I can't call their bluff without waving my rights.

And if it does, then probable cause is a total joke because they can always say that. It's useful to go own record as refusing, which I will, but it doesn't do anything to protect your rights. @Setzer Your best bet is to get out of the car when he asks you to. But before-hand roll up all of your windows and lock your car on the way out. If he asks why then just tell him it's a force of habit. The sad reality is that he can still legally search your car but if he's lying he might not waste his time getting the keys from you. Just make sure to get his badge number (legally required to give it to you) and file a complaint after the search is over. That's the best you can do.

First of all that cop is dick, and get his info....second, well did he ask you to step out of the car, is so THEN DO IT, BUT b4 you do just take your time and close all windows and lock all doors, theres no time limit really (i mean dont milk it and check everywhere to make sur everything is hidden thats REALLY STUPID, but just take your time to do those things, AND THEN when he asks say you dont concent to searches...then still if your not STUPID, he cant do shit, and your free to go

When the police smells or guess anything in the car and wanted to search it, the driver can refuse to consent to searches. That means police cannot search and must abide by fourth amendment with respect to the right of privacy.
