The 8th Amendment is vague and open to debate. "Cruel and unusual punishment" can have a wide variety of meanings. Shooting out someone's knee caps is both cruel and unusual. This statement applies to everyone. Now, here comes the gray area. Simulated drowning. It causes no lasting effects. You don't get a scar and it won't kill you. You could almost equate this to spanking an unruly child. It sucks, but it's not deadly. For me, watching Sex & the city is cruel and unusual, but not for others.
