why? well the irish govt is trying to give itself retroactive immunity from prosecution for illegal "acts done" by continuing to implement the lisbon treaty without waiting for the referendum to pass. the piece about EURATOM will allow eu power plants or silos for defence that the irish people dont want.

since 2008 the eu continued to pass laws as if the treaty has passed. the irish govt is looking for immunity for its treason.

now if u look at the differences between june 2008 amendment and the 2009 amendment to constitution ( u can find in your voting slip or on wikipedia ) you will notice they revised the statement to:

"No provision of this Constitution invalidates laws enacted, acts done or measures adopted by the State, BEFORE, on or after the entry into force of the Treaty of Lisbon..."

The Irish Times reported last week that the Lisbon "no" vote has shrunk to 30% !

IF Lisbon is ratified :

1.ALL legislation will come from the un-elected Council in Brussels.

2.They can lawfully change anything in previous Treaties ( Article 48 ).

3.The Executive retains the RIGHT to dissolve national parliaments anytime it wishes.

4.The Lisbon Treaty ( Art.1.2:1-6 )abolishes the Nation State & replaces it with the EU Nation.

5.The European Charter re-introduces the death penalty.

EU laws that exist are superior to Irish Laws. There are Irish Laws concerning certain areas were there are no EU laws, however the Lisbon Treaty give the EU the authority to create laws in over 60 new areas. The new laws in new areas would be superior to national Laws. It's a massive power grab by the EU. Do you understand?

As it stands all EU law that is deemed necessary to give effect to "our obligations as members of the EU" passes unhindered into Irish law by virtue of Art 29.4.10 as amended and under the Single European Act 1972. Therefore AS IT STANDS EU law is superior to Irish law. (the Doctrine of Supremecy). At the moment we still have sovereignty in relation to the creation of indictable offences and in all matters of foreign policy. Will Lisbon change this??

Why would there be no other referendum? Your constitution will not be changed. France changed their constitution. If your government had wanted to stop a referendum they would have changed your constitution just like France did this year.

Another thing: in case you fear they will change your constitution if you do not vote NO this time, you should think about it twice. It is more likely that your constitution will be changed if you vote NO, because next time they will not want Irish people to screw it up again. So vote YES and afterwards just leave the EU, if you do not want to be part of it. At least your constitution will stay the same then.

You should really learn about the Irish constitution before posting any more. The government cannot change the constitution, only a referendum of the people can.

I actually find it bizarre that France and other countries can change it without a referendum. It's supposed to be foundation of the country's law, the rules by which the law-makers must operate and as such, the law-makers are the last people who should be able to change it.

Thanks for the information though. But based on your information I find it even more ridiculous to claim you could not vote again on another EU Treaty in the future. If it's the people's decision then why would they abandon referendums, so they can't vote on another Treaty again? savagecabage doesn't make sense and maybe needs to learn more about his/her constitution then, too.

Simplified version is that Article 48 makes it easy to change the rules now without a new treaty.

Any change to policies does not actually require a ref in Ireland however they have always comes in huge treaties that also include extension of EU's powers and so we needed a referendum.

Technically we were spoiled in that we got to vote on non-referendum changes because they were tied to other changes in a big treaty.

Whether you like it or not, we had that power. We are now losing it.

But Art. 48 (4) II and (6) 3 says the Member States have to still ratify it all as their constitutions need them to ratify. What exactly does your constitution say?

Art. 48 (6) II additionally says they can't extend powers that are mentioned in the treaties.

I don't even know what country you're from but I know that some of your countrymen want us to vote NO. The only reasonable way for me to take your opinion *and* their opinion into account is all countries have a referendum.

It's the people who pushing this treaty who won't allow this and I consider that one of several reasons for me to vote NO.

Sorry, I'm not quite sure what you mean. I just know I want this damn Treaty finally, because I'm tired of the current state. If this Treaty fails it just means we'll drag this whole issue to another level and try to work on another Treaty again and will have to deal with the less Democratic situation we have right now. Maybe it's time to drop out for some states then, so the rest of the Union can go ahead. Some should definitely consider leaving the Union for the sake of the rest of the states.

What I mean is that you are telling "us" how we should vote but not providing any argument other than "I want it". There are plenty of people who would say "I don't want it".

The only way your request can have any legitimacy is if everyone in your country has an opportunity to votes on this.

Alternatively you could provide some arguments for why the treaty is good.

As for leaving, we all signed a big contract and now some want to change the terms, isn't that their problem?

It is your problem, too, because you signed the big contract, too. You are free to leave though, it doesn't take the Lisbon Treaty to be allowed to leave.

I can name many reasons why I think the Lisbon Treaty is better than the current Treaty. But it would mean many YouTube pages of explaining.

Yes, I signed the contract but I'm not trying to change it (that's not to say it couldn't be improved). The idea that some countries should drop out of the EU because they are holding back "progress" has no legitimacy. The Maastricht treaty didn't say "part 1 and by the way, there's lots more to come".

If some people intended that, that's their problem. Nobody said Yes to their dream and if it doesn't come true, tough.

Obviously you are not talking about the phrase by which a new European Union will be established by the Lisbon Treaty, but the phrase: "no provisions of the Irish Constitution can prevent..." (29.4.10). It is not the exact phrase, there is one major change, the word communities is being dropped. (29.4.4) Maastricht (1992) refers to a European Union Treaty which is defined as a community even if they call it by another name....

Aren't these just names. We could call it anything but what matters is the rules laid down in the treaties. The new EU is a state because of the treaty, not because of the amendment. I think you can more successfully campaign on other things.

If I'm still wrong then this is a very tricky area and you're going to have a hard time convincing anyone who asks my question.

The EU will not be a state. It will be an International Organization. Ask the United Nations, they will tell you whether the EU will be a state or not. Only states can become members of the UN. The UN will most likely tell you - bad luck, but you can't become a member, because you are NOT a state. Just ask them, they will tell you what we're gonna be.

If UN membership is the definition of state then you're right. Personally I would have though that membership of the UN would be based on nationhood, it being the United *Nations*.

The problem is that there are lots of definitions of "state". Can the State of California join the UN?

There is no correct word to describe what the new EU will be but it will have more characteristics of more definitions of "state" than the old EU.

California can't join the UN, because in International Law the Federal State is the state that matters. Whatever the US Constitution says on states and how they are organized doesn't matter.

Ask the UN, they will tell you what the EU will be. UN membership is not a definition of state. But you can only become a member if you are a state in the sense of Internat. Law.

I am voting "No" but I have a problem with this video. The Irish constitution already contains that exact phrase with regard in relation to the Maastricht treaty (Article 29.4.1, search for "Bunreacht" on Google).

Do you not know this or are you just deliberately ignoring it?
