I work at a Subway, and I have seen the cookies get that hard before, yes. Normally we through them away, if not then we eat them ourselves, we don't serve them to customers. I have eaten a cookie that hard and I could tell before I even bit into it that it would be hard enough to cause pain if nothing else to my teeth... so I didn't bite into it. duh. would you bite into a jawbreaker that you just pulled out of a wrapper? probably so... and then try to sue them.

Well i worked for subway for 1.5 weeks and my manager is running a small scam that scams the employees. I've contacted the subway hotline and apparantly it is not subway policy to follow th law so the franchise owners can do watever the fuck they want. Uve already tried to contact subway I would take legal action know.

I work there too... we get paid under the table, are missing hours on our checks, and often work over 8 hour shifts without proper breaks or lunches... Subway headquarters is no help whatsoever.

Seriously? If anything else, freaking break the cookie in half before eating it. Then you will at least be able to tell if it's soft enough. If it's not, go back, and ask for a different one. call the store manager where it happened.ask for the number for there claims dept.tell the claims dept you need a dentist.if they won't pay for it then get a lawyer, as i think the going rate for a tooth now is about $2,000 plus pain and suffering and i believe about 7 times your medical bill total is the going rate for a settlement.if you don't follow up they will not call you as there hoping you go away!!.john esquire J.D.
