The Nishin Maru should have altered her course to avoid a close quarters situation with the Artic Sunrise (Stand On vessel).

The Nishin Maru broke the IRPC.

However the Artic Sunrise was 'compelled' to alter her own course by Rule 2 (b) and Rule17(b). In short poor regard for safety and poor seamanship.

So Artic Sunrise was fully in contravention.

Putting the engine(s) astern would have also been acceptable of course in Rule 17 (b). However this should have been carried out much earlier if to be effective. Taking action once collision is unavoidable is no action (or defence).

As per 'usual' the most effective course of action would probably have been a bold alteration of course to Starboard.

May I recommend Cockcroft & Lameijers book on the IRPCS. It is very good and gives legal precedents in court cases. Happy Sailings

Greenpeace can burn in hell. The rule 2 of the Rules of the Road laid down by the coast guard statest that BOTH vessels must do everything in their power to avoid a collision. This requires you to act beyond the rules of the road when the other vessel is not following them.
