Just like cops can't just go to a bar and have a dog sniff every vehicle in trhe lot. Cops have to have reasonable suspicion before introducing a dog into the investigation.

  • I worked for law enforcement for a bit….they really don't emphasis the alert on the dog…meaning they don't care if it's accurate or not….the less accurate the more cars they can search…get it…got it….ok good.

  • In this specific case the owner of the vehicle is incorrect, once a dog sniffs the exterior of the car, and alerts an officer to a possible contraband, that does establish probable cause, and the supreme court has given an exemption to the 4th amendment in these instances when a vehicle is involved.

They had no warrant to do so in the end and asserted the use of excessive force against two men they had no right harassing the way they did. Those bp officers are a prime example of why police in the united states can not be trusted anymore.   • It seems you can't go directly to the complaint site because it is a "secure" site. You have to start at CPB.GOV and then click on "Questions/Complaints" on the upper left hand side of the page. You will then have to click on "SUBMIT A COMPLAINT" button on the lower right side of the page. Perhaps if they get enough complaints about a particular CPB Agent they will start to get disciplined accordingly. Make sure to do a complaint that requires them to contact you. Don't be anonymous.

And yes a law was broken by not responding to "is there a weapon in the vehicle". When a border patrol agent asks you this question it is a crime to A: not answer or to B: lie. The agents made the decision not to file a charge. And they turn it over to a sheriff because they can't just leave the border to take his sorry ass to jail. Educate yourself before speaking kiddo.

  • A dog does not constitute probable cause. You could have exited the car for them but you should have locked it immediately to prevent them from searching the car.

I've probably passed thru that point countless times and not once have I ever had a problem, I roll up and they ask "Are you an American citizen"? I say "Yes sir" and they go on, have a nice day.     Arrive: I roll down the window about 4 inches. Answer "Yes sir I am. How else may i help you?" to the U.S. citizen question.

    I am threatened with arrest when i say "no thanks" to a request to roll my window down. I did not disobey any laws.

    The gentlemen that just threatened me with arrest now tries to open my door. Sorry, locked. I start reading my book.

That's why a lot of peoplebring up the Sheriff. SOme bring the sheriff up because they dont recognize other law but that's another issue.

They intimadated me i was dehydrated and confused. I was really scared was crying so i exited the car. a small amount of marijuana was found that i missplaced 1 1/2yrs ago. I had no idea was on me in a duffel bag full of shoes. I dont even smoke. I was strip searched and put in cell till sherif arived.  i felt i was in a third world country.

And how can the dog decide which thing to sniff for at any given time?  Remember that refusing a search is not probable cause! people not commiting a crime have rights too!

  • America has to protect it's people so that they can continue to pursue happiness. These checkpoints might be an inconvenience to those who have nothing to hide but they are necessary as long as there are people in the world who will die to see America fall.

These checkpoints are far more than an inconvenience. They allow gov't agents to stomp on the rights of the individuals they're supposed to be protecting with impunity.

    If you're so concerned about border security then I suggest you petition DHS to patrol the border instead of harassing domestic traffic inside the country absent suspicion

  • Drug checkpoints are illegal by Supreme Court Decision. Border Patrol committed a Civil Rights Violation under color of law, and felony assault.

  • If a drug dog "hits" on a vehicle the courts have stated that it is probable cause to conduct a search for the substance that the dog is trained to detect. Those two guys should have cooperated with the agents. If there was nothing to hide, this would have been over quickly and without much incident.
