You cannot get anywhere with them by playing their game. It's rigged. You need a good attorney. Some judges in some courts understand the game the banks a playing and are not amused. They will rule in your favor if the law allows them to and you make a valid argument in court. If you can, find a case similar to your own situation that won in your jurisdiction and use the same argument. Don't depend on B of A to do the right thing. They won't. They will steal your house and evict you. Believe it.
when you talk to "short sale dept" it is an outsourced company, like i worked for and they give misguided info that changes all the time. i for one documented all the customers concerns and got a bad rating as far as taking too long on calls. BTW i was with country wide and they did suck along with boa.
That's horrible. I tried to refi thru BofA since I was banking with them and they drug their feet and drug their feet until the very end so I pulled out because it made me nervous BUT I lost my application fee. I'm so glad I did.

@Patrick1678 Nice talking with you on the phone. I did sell the house on a short sale just recently, but have some regrets. Bank of America sent me a letter after the closing that they were forgiving the remaining debt on the loan and sent me a 1099c for the difference. This would be a problem if I didn't have so many losses in other areas.

i have done 5000 modifications with an 85% sucess ratio you need to get an id # from anyone you speak to and you can record them--you must tell them they are being recorded---then you have the person with id# and your proof--- i will get it done send them to me---! i dont miss-------------------

Not sure what happens if you ask for the ORIGINAL promissory not to verify the debt and BOA does not produce it. Might be a good thing to find out. Talking to people on the phone means nothing. None of the people you talk to seem to have any decision making power. Maybe an attorney could provide the answer about the Note. I think that without the note they shouldn't be able to foreclose. Not sure about non-judicial states. All of this needs clear cut clarifications so people know what 2 expect
I'm writing to the state attorney general in Florida about the nightmare we've been through on our short sale home. It was our home for four years, bought at height of market and now that space program is ending our whole area is glutted with homes on the market and the bank will lose a LOT more on a foreclosure than on a good cash short sale deal we've presented to them. BoA has changed their mind three times now at time of closing on how much extortion $ they want from us, the seller.

Extortion is a very good description of what they are doing. FIrst they commit fraud with their mortgage assignments, then they act like they are cooperating with short sales by demanding more money from distressed sellers. My attorney asked them for it. They do not have it. Also, the assignment was signed in Texas and notarized in New York. But some judges in Florida are not respecting the facts. The lender's attorney has pushed for summary judgement anyway without producing proper documents. My attorney is fighting back.
Or maybe you don't get yourself into a loan you can't afford in the first place and live up to your originally written contract stating you will pay x amount for x time and make your payments on time and act like an adult take responsibility not rely on shortsales and forbarances you know all those things have such a nasty effect on your credit?
@6175wmlerik I could afford it at the time. Just like so many people who lost their jobs due to the fall in the economy, many independent contractors like myself also lost their income. There were so many here in Florida. I do agree with you, as there were many people that purchased property without the income to back up the ability to pay their loans hoping to flip properties and make easy money. I never saw myself as someone that would not be able to meet an obligation.
sorry that you are having problems with b of a. i worked for them up until recently. the truth is that they bring people in and even if you have no mortgage experience you are given barely any training. you are then given hundreds of files and are supposed to automatically know what you are doing...that's why customers and re agents get the run around. no one there knows what they are doing. i was eventually let go for productivity even with such little training.....go figure. so glad i am gone!

Thank you. I am now signing a contract for a short sale. I didn't want to sell the home but at this point the choices aren't good. They won't even talk to me on the phone about a loan mod. I have an attorney now, but nothing is happening.
I am getting the biggest run around from Bank of America as well. I went through the Making Homes Affordable plan, which took over 4 months...and then I get a denial, saying that I make more than 31% of my mortgage...they said that I made more than $2,000 more a month on my gross income, and they can't tell me how they came up with that number...Bank of America is horrible.
I still hearthis same story all the time. There is no improvement. They tell us that they are going to comply with the HAFA and the HAMP programs, but when someone trys to apply they turn them down. It's no wonder they have so many class action suits.
You have to call 2 to 3 times a week to get a status on your loans and ask for the latest updated notes and dates of those notes and have the rep read them back to you. Trust me it works
I wish it did work. If it worked for you, I'm glad. It doesn't work for most people. I have now closed over 100 short sales for other sellers, and I still can't get Bank of America to do what they are supposed to do. Now i just found out they have settled with a class action lawsuit for 8.6 billion dollars and they have to modify 400,000 predatory loans. I called them to modify under the settlement agreement, and they still turned me down. Go figure.

Bank of America is giving me the run around. I clearly qualify with my unemployment, they are dragging this process out so I run out of unemployment and no longer qualify. There right hand does not know what the left hand is doing. If I am able to find employment my income would be less than my current compensation from the state and my Union benefits. I am a homeowner who started with Full Spectrum Lending, then sold to Countrywide, now bought by Bank of America. According to the couty recorder's office, these "new assingments of mortgage" were never properly recorded. Who knows who really owns my mortgage? Check out the MERS foreclosure lawsuits online. And by the way, I think B of A hired the countrywide employees, who could not do anything right no matter what you do as a homeowner. Take your business elsewhere.

And if you take a good look, their lack of getting things done is causing more damage than ever to the economic recovery which could be stimulated by the housing recovery. The sellers and buyer give up and walk away many times. IF they could get answers we would have peoople who could afford to pay the payments living in these homes.
They are costing their shareholders billions. I lost a buyer today on one of their short sales that has taken over 6 months and still no answer. The buyer bought another home to get the tax credit before the Nov 30th deadline.
The septic tank has now failed and will have to be replaced. The house is now worth $70,000. The contract price 6 months ago was $89,900.
The only person B of A saved any money for was the buyer.
Right On! My cousin died leaving a mobile home in a park - he didn't own the land. Trying to get a payoff amount from them was impossible. BOA said the loan was for a lot in TN not a mobile in FL. After 2 years trying to deal with them the Probate Judge finally declared the mobile abandoned - just to close the estate.
It was disgraceful. Bank of America needs a good audit.
Keep them coming. The more chatter and buzz there is, the more likely they are to actually listen. Once they listen, the chance of actually doing something is increased by the VOICE of the PEOPLE of this Great Country. Do Not let them take our Voice!!!! We Must Be Heard!!

More borrowers need to complain to their Congressmen and women, tell the news media, post on the internet, form groups and do whatever they can do proactively, loud and clear that this activity should be stopped. It is criminal. If other professionals acted with this negligence they would lose their licenses to conduct business and pay heavy fines. Bank of America should not be treated any differently than any other business.
This is the frustration I have encountered with multiple Buyers I am working with at this time. My Buyers are trying to purchase these short sale homes that are currently listed. We go to contract hoping to get to the closing table. Which would make my buyer a homeowner but would also relieve the stress on the current Sellers. Due to red tape and issues by banks such as Bank of America, they make it impossible for my Buyers or the desperate Seller's to get to the closing table.
As a RE agent, BOA has been one of the most difficult, almost combative, lenders that I have dealt with. Out of all the short sales we have closed, only 2 are with BOA/Countrywide! So many people are in need of assistance & BOA's "process" is so frustrating! It's very sad to see the banks take advantage of people who need their assistance & paid the taxes to bail them out! Something needs to be done now! There is no excuse for the bank's unwillingness to cooperate. NO EXCUSE!
Her comments portray many americans that have to deal with the banking industry to save their homes. My experience with Bank of America is the same. Its very difficult to trust anything they say, they never follow-up in writing the conversation, they record what your saying, but we cannot record any of their comments. My suggestion is write down what you can, the date, and time so that you can have a record, and dont forget to ask for their name, although they will lie about that as well.
Exactly why can you not record your conversation? That's the first I'd do. I'd want to know the name of the person, what their decision-making power is, what -their- deadlines are and I would go to them and ask for agreements in writing. How can a bank refuse to have agreements in writing? That's their job!
Im confussed also. I have stated to the bank collection group that I will record, They will tell me that they can not speak with me because of bank policy. I always ask for their name and how it is spelled. I am logging in the time we start and finnish. Bottom line, they do what they want since they are not regulated in this area. Absolutely spot on!! They were great at booking the loan and now they are nearly totally incompetent at mitigating them even with OUR money paying the losses!!
They say, "the truth shall set your free" - I guess not with short sales and modifications. We work work for dozens of realtors. They are all having the same problems, lies and delays. Hopefully someone will see this and help you out

Fantastic informative information. Banks should be required to respond in a timely manner. Not 3-6 months or at their leisure. They are very quick to take the governments financial help and then do not want to give the people the same courtesy they recieved.

My suggestion is write down what you can, the date, and time so that you can have a record, and dont forget to ask for their name, although they will lie about that as well.

Exactly why can you not record your conversation? That's the first I'd do. I'd want to know the name of the person, what their decision-making power is, what -their- deadlines are and I would go to them and ask for agreements in writing. How can a bank refuse to have agreements in writing? That's their job!

Im confussed also. I have stated to the bank collection group that I will record, They will tell me that they can not speak with me because of bank policy. I always ask for their name and how it is spelled. I am logging in the time we start and finnish. Bottom line, they do what they want since they are not regulated in this area. Their process is destroying the american dream, just like the locust do to a field of wheat in a starving country. Maxwell5931.

Absolutely spot on!! They were great at booking the loan and now they are nearly totally incompetent at mitigating them even with OUR money paying the losses!!

They say, "the truth shall set your free" - I guess not with short sales and modifications. We work work for dozens of realtors. They are all having the same problems, lies and delays. Hopefully someone will see this and help you out

Fantastic informative information. Banks should be required to respond in a timely manner. Not 3-6 months or at their leisure. They are very quick to take the governments financial help and then do not want to give the people the same courtesy they recieved.
