Well here I am again ... this time it's US bank trying to screw me out of over a $1K, by building it up over the years even though I haven't use the account. I did the same thing that I did with Huntington bank and got the same results. No more phone calls ... no more collection agency. Plus I got my court fee back too. The bank will keep up their tough talk until you file with the court, then they sing a different tune.
I love these pompous pieces of shit who say: "It's your own fault for not reading the fine print dumbass!" To all of you condescending geniuses out there: You're right, I didn't read the fine print. I just assumed, like a logical fucking human being, that if I didn't have sufficient funds in my account to pay for something with my debit card the register would reject the transaction. Why didn't paper checks just overdraft your account back in the day? Why did they bounce instead?
@fooschnikens Because you probably ran it as a credit card transaction instead of a debit card. It's simple, don't spend more than you have and you won't have an issue.
I took Wells Fargo to court for $275.00 in OD Fees and within two days of my court appearance I was told by a letter from the court that I was denied my claim because I agreed to the terms and conditions when I opened my account. So you theory does not work.
Did you ever get the money back? I'm going through this right now. I can not WAIT to call back the belittling bank manager I spoke with and rub it in his stupid face. After I get back not only the recent overdraft fees but my fees from the past that I allowed them to walk all over me with. THANKS!!!
i have called them n they say they not in error. i so hate huntington. n i never signed nothing to have this crap. i get ssi. i called ss office they say they cant help me get my money back.
i am also with huntington... they just got me for$182.50 in overdraft fees. in which i had had an unauthorized charge go through my account with paypal. n huntington rearranged the items to get maximum overdraft charges. had 2 other earlier the day that went through for only a couple bucks each. then they charge extended overdraft fees on top of the days they collected the $37.50 per each item. then my account had to sit 6 days in the negative.
Nick- so even if the banks charge you in an unfair manner by processing the bigger transactions first. Do you still feel that you should pay SOME of the fees, because if people dont spend more than whats in their account then it wont happen no matter what.
you can opt out as of december 1st 2009. There are still some kinks being worked out though in regards to the timing of purchases/ when merchants turn in their work. (pending transactions)
I am glad to see that B of A has seen that they can't get away without offering an opt-out. On the flip side, if you are someone who can afford to take a short-term loan from the bank with an outrageous interest rate, great! Go ahead and opt-in! What would really be nice is for the banks to make fees commensurate with the amount charged instead of a flat $35. They're coming around though, and I am glad to have played a role in making it happen.
@nickyaya111 I just wanted to post this ... folks Nick's suggestion worked for me. I'm with Huntington bank I don't know if it's national or not, but a big bank. They were charging me outrageous overdrafts fees and refuse to close the account for 45 days charging $7 per day until I paid. File court papers cost me $55 got a call from the bank a week after I filed that they will 0 out the account and pay the $55 court fee. Thanks for giving me a way to fight back. :)
Thanks Nick! Filed my small claims case today after seeing this video. I've been hit for $1225 since April of this year. (2 instances of multiple overdrafts due to their "perfect" system) Bring on part III.
