  • @miabee111 What exactly does the law protect Cris Williamson from in this case? When Jaylib's "Champion Sound" was released in 2003, the album this song appeared on had been out of print for a considerable time. In 2005 the album was re-issued in part thanks to the attention that this sample drew to Williamson's music. Also, while he was surely aware of the law, it's often unclear who owns the rights to a song, or difficult to track someone down to ask.

But clearly you don't have any problem with this particular brand of infringement. IP laws in the US are a disjointed mess, and Dilla knew that as well as anybody.

  • I like the use of the sample , and the way the beat blends with it, it's masterful work. It's just sad that it had to come along with trash lyrics. I know that I would not want my music being sampled by people using it to present a message that I disagreed with. If the KKK or some white power trash musical group sampled my work I'd sue them out of existence. I'd keep the record for the beat, and remix with it, but there's no way I'd play the whole song.

  • I understand sampling, and I agree that sampling is in itself an art form , but at the same time I can understand why Cris would object to the sampling of her song to be included in " The Red ". Her music was , and continues to be, about the polar opposite of the themes and lyrics in The Red. I mean anyone who has listened to more than 10 minutes of Cris Williamson would cringe at the use of her music in the middle of the " yo yo fuck dat nigga fucking women shit " lyrics.

  • That's some serious sampling right there son. Yeah, it is so lame when people sue over samples. For me sampling is a way to reintroduce music to another generation. How much jazz, soul, funk, and folk has been sold because of sampling? So many unheard of artists, like this Williamson chick, owe a resurgence of interest in their music to artists like Dilla who ostensibly say, "check this music out" when they sample it. If I were an artist, I'd be flattered if my shit was sampled. r.

Sorry your track was less-than, because you didn't get permission up front, but those are the rules.   • The 1st rule is clear your shit. Your record company s'pose to finalize it b4 release. Pay the artists you sample. Then there's no problem.. Yes, original is best. Had they cleared it w/ her, 'stead of gettin an artist pissed off 4 being ripped off, there it's all swell.

    oh, sorry its such a late reply, but yes, jay lib is J Dilla and Madlib, both underground hip hop producers with wide range in musical tastes, J Dilla did pass away in 2006 though

  • An artist has copyright for a good reason... I love that Jaylib record to death, and it's too bad that The Red can't be put out because of clearance issues... But lets face it, it's their piece of music which you, rightfully, can't use without artist permission.

    So even though I love the Jaylib record, I think they should just have cleared it or don't use the sample.... If you' get caught for sample issues in the 21th century, you're just plain stupid. Give our forefathers some love too!

  • I agree that they shouldn't have used the sample on the retail album if it hadn't been cleared but it honestly that shouldn't stop hip-hop producers from using these samples. If they can't clear the sample for an album, then they should be putting their beats on free mixtapes so the masses can hear it. I've heard a bunch of underground beats using MJ samples that sound awesome but can't be released on retail albums. That's the way to do it.

    I love the art of sampling. I find it unfortunate that clearance often does dictate distribution. The use of any sample, be it 1 min. or .01 sec. is illegal. It's use in any form, whether the intention is for profit or for free distribution is a violation of copyright law. To say that the free distribution of songs containing uncleared samples by way of mixtapes would avert potential copyright litigation is great in theory if the law did not state otherwise.

  • man i was fuckin dissapointed when i bought my special edition of champion sound to find that the red had to be re-done, that song is what generated new interest in this person and probably made her a few bucks and this is how she shows her thanks. i wanted an official copy of the red, guess ill have to make do with my illegal download instread....or maybe cop it on vinyl
