@miabee111 What exactly does the law protect Cris Williamson from in this case? When Jaylib's "Champion Sound" was released in 2003, the album this song appeared on had been out of print for a considerable time. In 2005 the album was re-issued in part thanks to the attention that this sample drew to Williamson's music. Also, while he was surely aware of the law, it's often unclear who owns the rights to a song, or difficult to track someone down to ask.
@FOTSOproductions Also, this very YouTube video is, by the letter of the law, an illegal copy of Cris Williamson's intellectual property. But clearly you don't have any problem with this particular brand of infringement. IP laws in the US are a disjointed mess, and Dilla knew that as well as anybody.
I agree. She, as a folk artist, may not appreciate the musical genius that is J Dilla, but I'm sure as hell she appreciates the recognition and money she got from The Red. I hope she's fucking happy now.
I like the use of the sample , and the way the beat blends with it, it's masterful work. It's just sad that it had to come along with trash lyrics. I know that I would not want my music being sampled by people using it to present a message that I disagreed with. If the KKK or some white power trash musical group sampled my work I'd sue them out of existence. I'd keep the record for the beat, and remix with it, but there's no way I'd play the whole song.
I understand sampling, and I agree that sampling is in itself an art form , but at the same time I can understand why Cris would object to the sampling of her song to be included in " The Red ". Her music was , and continues to be, about the polar opposite of the themes and lyrics in The Red. I mean anyone who has listened to more than 10 minutes of Cris Williamson would cringe at the use of her music in the middle of the " yo yo fuck dat nigga fucking women shit " lyrics.
@DjDelchi no lyrics of madlib or dilla is "yo yo fuck dat nigga fucking women shit", even though the message is the same, that's the sound of lil wayne, soulja boy and all the other mainstream "artists". when dilla, madlib, frank n dank, all of those, talk about it, they do it with flair and creativity
btw, i know you're not but it sounds like you're comparing jaylib with the KKK
That's some serious sampling right there son. Yeah, it is so lame when people sue over samples. For me sampling is a way to reintroduce music to another generation. How much jazz, soul, funk, and folk has been sold because of sampling? So many unheard of artists, like this Williamson chick, owe a resurgence of interest in their music to artists like Dilla who ostensibly say, "check this music out" when they sample it. If I were an artist, I'd be flattered if my shit was sampled. r.
Cris has been around and recording for decades. Making big bucks isn't the be-all, end-all for everyone, and integrity counts for a lot. Sorry your track was less-than, because you didn't get permission up front, but those are the rules. I gotta give Cris props because she does stand for what she believes in and I'll stand w/her for that.
she should be grate do dilla...but what the fuck, who cares? the beat is out there for us to get hype anytime the shit plays, so fuck her and her sue...
Hi there! If anyone has a Cris' fantastic song 'Don't Lose Heart', which I heard from Henry Jaglom's best film New Year's Day, could you post it up, please? Thanks! That song is so apt for now and this song isnt' so bad either.
ya or maybe she should pay him for givin her a bit of fame...who knows? anyway, the red is the shit...this is just an old 70 song with a good vocal...i made uo my mind...
The 1st rule is clear your shit. Your record company s'pose to finalize it b4 release. Pay the artists you sample. Then there's no problem.. Yes, original is best. Had they cleared it w/ her, 'stead of gettin an artist pissed off 4 being ripped off, there it's all swell.
damn you cris for stopping the original version of the red from appearing on the re-issue. i was so disappointed when i first spun it, i bought it on goddamn vinyl!
but then again thank you cris for making this song. without this one dilla couldve never made the red in the first place :D.
I hope she's happy because without dilla sampling her music so wouldn't have gotten the popularity of new fans looking for her music in record stores. And she sues him just because he sampled her music.Hope that Bitch dies peniless
do people like her relize that when someone like dilla samples her music,he introduces her to a new generation of music lovers, who may possibly go find more music by her? i wouldnt of even heard about her if it wasnt for dilla sampling her!!!! she shouldnt have sued
I, on the other hand, knew Cris Williamson, and had never heard of Dilla. I think, if you're going to use a sample, you should at least clear it with the artist or publisher.
Or, for that matter, the Butchies' cover of "Shooting Star". Again, never even HEARD of this Dilla person, and I rather suspect most people who might like Cris Williamson probably hadn't heard of him/her either.
oh, sorry its such a late reply, but yes, jay lib is J Dilla and Madlib, both underground hip hop producers with wide range in musical tastes, J Dilla did pass away in 2006 though
@Timmybear hip hop is sampling at the very foundation ,my point is that people who listen to hip hop like to discover where the sample came from originally, hence the reason dilla fans have discovered her and why hip hop fans have a wide taste of music, but people who are her fans or have heard of her proberly havent heard of dilla as sampling wasnt a vehicle of discovery for them,i agree samples should be cleared but disagree in her suing

WHAT? I'm angry about this... she sues stones throw for 5 seconds of sampling? c'mon... listen to kanye's or jay-z's beats... they just copy the whole songand then rap over it.. nothing creative about it... but check dilla's beat, they are creative as hell...
im confused, cuz i bought champion sound the deluxe edition and it came with the original the red track, it also had an alternative instrumental version tho..i dont see why people are complaining about it..
you probably got lucky and got one of the last copies which had the original before they had to change it, im sure theres a few around here and there.
An artist has copyright for a good reason... I love that Jaylib record to death, and it's too bad that The Red can't be put out because of clearance issues... But lets face it, it's their piece of music which you, rightfully, can't use without artist permission.
So even though I love the Jaylib record, I think they should just have cleared it or don't use the sample.... If you' get caught for sample issues in the 21th century, you're just plain stupid. Give our forefathers some love too!
I agree that they shouldn't have used the sample on the retail album if it hadn't been cleared but it honestly that shouldn't stop hip-hop producers from using these samples. If they can't clear the sample for an album, then they should be putting their beats on free mixtapes so the masses can hear it. I've heard a bunch of underground beats using MJ samples that sound awesome but can't be released on retail albums. That's the way to do it.
I love the art of sampling. I find it unfortunate that clearance often does dictate distribution. The use of any sample, be it 1 min. or .01 sec. is illegal. It's use in any form, whether the intention is for profit or for free distribution is a violation of copyright law. To say that the free distribution of songs containing uncleared samples by way of mixtapes would avert potential copyright litigation is great in theory if the law did not state otherwise.
man i was fuckin dissapointed when i bought my special edition of champion sound to find that the red had to be re-done, that song is what generated new interest in this person and probably made her a few bucks and this is how she shows her thanks. i wanted an official copy of the red, guess ill have to make do with my illegal download instread....or maybe cop it on vinyl
@FunkDawg0711 The version of 'the red' on champ sounds is not the original :( ? Do you by any chance know where I can listen/get a hold of the original, just for comparisson? Much thanks in advance
@gsian187 The lawsuit threat was stupid in my eyes. I had never heard of her until The Red. I went out and bought this album for the sample as a result of Dilla's beat. The remade version isn't nearly as good as the original "The Red"
cris williamson sued stones throw cause dilla used the sample without permission..now because of this jaylib's champion sound contains a different version of the red. with a different beat. one of the best hip hop beat EVER (the original version of the red) is no longer available for those who are goin' to buy champion sound.
haha that's funny that every comment about this video is about J Dilla. but actually comparing these two songs, its fuckin crazy what Dilla did with this song to make it the red
you think? i think he just took the part from 0:44 to 0:48, maybe some high pass, and then looped it. beat is awesome, dont get me wrong but it wasnt really sampled amazing like unrecognizable.
yeah she really is, but dilla made a hell of a beat out of that joint, timeless classic. I've heard they changed the beat on the Champion Sound deluxe edition because she sued stones throw because of using her song
