I want to clarify they had agreed to surrender but not unconditionally. They surrendered unconditonally after and there were mutiple conditions more they had to agree to that they had refused.

Also they were still discussing taking an unconditional surrender amongst their own government but had officially refused it. So it's possible they would have eventually surrendered unconditionally.
