They'll more likely say, "smoker" like they say "buried" or "extinct." Especially since this is a health & safety issue, not one about freedumb, as in free to make a dumb argument.

businesses have the choice to make their establishments smoke free, so if they don't do that and you don't like the smoke...don't go in there! simple as that!
