It should be a military commission. Civilian courts are for civilians, which KSM is not.

However, I think Robert Pape had it right about suicidal terrorism. He says the cause is foreign occupation, and nationalism moreso than religion.

I understand the moral/political statement that is being made by this maneuver, and there is little danger of anybody being acquitted or escaping from prison. The real danger is to mix religious fanatics in with a prison population that may be released at a later time. Hopefully we are wise enough to hold them in isolation so we don't have to deal with former prison buds newly paroled that adopt a radical Islamic world view.

With the Justice system we have its quite possible that some high priced liberal defense lawyer could get these clowns off the hook, not to mention intelligence community and soldiers would have to testify compromising there anonymity and safety...either Obama does not understand what he is asking or just does not care...I don't know which one is worse.

If he had any balls, he'd either want them dealt with by the military OR given a civilian trial that includes the very real possibility they'll get off on some disproportionate technicality.
