Thats singing live. Britney doesnt Lip sync, she really sings under a backing track, so technically, she is singing and should be "allowed". She never claimed tio be a singer, she claims to be a performer, and as you can see by this vid, or if you have ever been at any of her concerts, you would know she is!!

I'm a britney fan, but she lip synched this. Yes, you hear her laugh and some live bits cos her mic was on, however, any Britney fan knows that her voice is deeper. There are other live versions of this song. Her voice is kinda deeper when she sings this live. But this sounded a lot like the album vocals. But, anyway, it was a good peformance!! Loved Britney since Baby One More Time and i'm gonna love her forever =D

If you don't believe (you're not a Britney fan) just see the documental Britney Evolution of her Voice here in youtube. She didn't lipsync her first two world tours... her voice was good right there. I think it has to do with her lung capacity. As I researched her vocal range is 3 octaves and five tones. Then it would not be so difficult to sing for her. SMOKING may take away lung capacity and therefore she has not air even for sing a ballad, though her voice can handle the song.
