You can't in a constitutional democracy allow the majority to stomp on the rights of the minority just because they elect to do so in a case like prop 8. The Purpose of the constitution is to prevent this very occurrence.

Prop 8 was an organized political attack on the rights of a minority by an ideological cult, motivated by hate and enabled by fear and ignorance. The fact that a bare majority was persuaded to vote for it notwithstanding, this is exactly what the Constitution was designed to prevent, and the Judiciary is only doing its job in overturning it.

The purpose of the judiciary branch is to defend the will of the people when it is threatened, in this case by other people. At the time of Loving vs. Virginia, approximately the same amount of people who supported Prop 8 were opposed to interracial marriage. Just because a belief is popular does not make it right. For the record, here's the funny thing about rights: you're not actually supposed to vote on them. That's why they're called rights.

This argument that the majority has a right to vote away a fundamental right for a minority simply does not meet the constitutional requirements of law. Mr. Brown fails to address the serious concern that is posed when one looks at the guarantees of due process and equal protection in the US constitution and the complete lack of rational basis for such discriminatory law targeting gay and lesbian Americans. If the majority could vote on the rights of a minority we would not need a constitution.

I'm going to throw out a wild prediction right now though: Clarence Thomas upholds this decision. He'll rely on his reasoning in McDonald, overturning the Chicago handgun ban. It's sound and solid and rational: Prop 8 does nothing but tries to further the ideas of "a traditional marriage", meaning a man and woman... simply because that's how it's been in the past with no rational reason except for, "'cause we said so." Wasn't that the same rationale for saying Black and Whites should never be married? Sorry - your arguments, and your proposal, are nothing but fear-mongering.
I read Walker's 136 page decision. It seems to me that the problem wasn't that he was "zealously" pro-same-sex marriage. The problem was the absurd incompetence of the prop 8 legal counsel. Please, read the decision. I am for same-sex marriage and am only mildly happy with the outcome. It's hard to know that we won -- not really on a hard fought rigorous court debated merits -- but by default in the absence of any meaningful contribution on the part of prop 8 counsel.
Principles, even equality, are inconvenient things. Often it means tolerating things you don't like. In the case of gay marriage, it just means minding your own business.
If someone tries to stop you from marrying a women, or forces you to marry a man, we will help you FIGHT BACK! Studies showed that if the prop was worded "shall we make a calif. constitutional amendment to deny gays the right to choose whom they could marry" it would have failed. I do not believe this was the will of the people, but the will of outside state interests and inside state bigots.

You live in a Constitutional Republic in which the voter may elect democratically representatives who must then adhere to over arching Constitutional Law which a simple public vote cannot modify the civil rights of other people, especially minorities.

Why is it that gay activist insist gay marriage is a civil right? It's not, what they are argueing is a restriction that they don't aree with. This can be compared to prop 19. The fact is that 'gay marriage' is nowhere in the constitution, and that restrictions on marriage are decided by state constitution with the people are allowed to define. You can argue that gay marriage 'should' be legal, but not under the title of a civil right, that is just insltive to true civil rights cases.

Prop 8 was an organized political attack on the rights of a minority by an ideological cult, motivated by hate and enabled by fear and ignorance. The fact that a bare majority was persuaded to vote for it notwithstanding, this is exactly what the Constitution was designed to prevent, and the Judiciary is only doing its job in overturning it.

There isn't anything in the Constitution that says one can redefine marriage, but last I checked the only thing that says it's a man and a woman was the Federal Marriage Amendment which has failed twice. The Constitution says nothing about marriage, but it does say equal rights for all, something people like NOM are trying to revoke.

And you're right, there is no spelled out definition of marriage. For most people, all that's required is that 2 consenting adults love each other and want to commit to taking care of each other.
Other people further define their own marriage by their capacity to have children, but they have no right imposing that definition on others.

The purpose of the judiciary branch is to defend the will of the people when it is threatened, in this case by other people. At the time of Loving vs. Virginia, approximately the same amount of people who supported Prop 8 were opposed to interracial marriage. Just because a belief is popular does not make it right. For the record, here's the funny thing about rights: you're not actually supposed to vote on them. That's why they're called rights.

The will of 7 million people was overridden by a single judge. Where is democracy after all?. People have a right to live as they choose, they don't have the right to redefine marriage for all of us.

@rickardo004 Yes, it does... The founders fathers of this country would agree with me, so the majority of people, this isn't democracy at all. I don't want my children to grow up in a country where the institution of family, moral and values is destroyed.. gay marriage would affect me, my family and this very society we live in..

@frannol Care to explain how exactly that works? The opinion of some men, several hundred years ago should not dictate the modern day, regardless of their opinions. Washington specifically chose not to implement direct democracy because he knew that the minority must be protected from the abuses of the majority.
To name a few, Canada, Spain, Netherlands, Sweden and Norway have legalised same sex marriage. Society has not been destroyed there; on the contrary: it's flourishing.

@frannol I stand behind Lyradin08's comment. our founding fathers didn't believe women should vote, let alone be involved in politics. They didn't consider slaves HUMAN BEINGS. should the 'moral' majority of the 18th century tell women to stay in the kitchen and blacks to be slaves? Society evolves.
What is tearing our society apart isn't gay marriage, but greedy wall street, neglectful oil companies and twisted politicians.

do these people not understand the point of judges? They're there to make sure unconstitutional laws DON'T get passed, otherwise the south would still have laws saying slavery is a pretty cool and acceptable idea.

This argument that the majority has a right to vote away a fundamental right for a minority simply does not meet the constitutional requirements of law. Mr. Brown fails to address the serious concern that is posed when one looks at the guarantees of due process and equal protection in the US constitution and the complete lack of rational basis for such discriminatory law targeting gay and lesbian Americans. If the majority could vote on the rights of a minority we would not need a constitution.

a majority vote is not binding in issues like these, if that was the case women would have never have gotten the right to vote and civil rights would still be just a dream. The majority can never subjugate the minority, its one of the founding principles of the united states. If you are against same sex marriage that's fine, don't marry someone of the same sex and keep your noise out of the private lives of others.

I disagree with what you say but I support you're right to say it. I look forward to this issue heading to SCOTUS. I'm going to throw out a wild prediction right now though: Clarence Thomas upholds this decision. He'll rely on his reasoning in McDonald, overturning the Chicago handgun ban. He wrote a brilliant concurrent ruling about how owning a firearm fell under the 'priviledges and immunities' clause of the 14th and he'll do the same for the right of citizens to marry whom they choose.

@dangerousjo123 In the original Aramaic, Arabic and Latin texts, it says that homosexuality wasn't a sin, just a deviation. The texts also originslly said "Thou shalt not suffer a poisoner to live...", not 'witch', so people pick and choose what "truth" to share. One person's truth may not be another person's truth. You all would do well to remember that!

I just read the entire ruling. It's sound and solid and rational: Prop 8 does nothing but tries to further the ideas of "a traditional marriage", meaning a man and woman... simply because that's how it's been in the past with no rational reason except for, "'cause we said so." Wasn't that the same rationale for saying Black and Whites should never be married? Sorry - your arguments, and your proposal, are nothing but fear-mongering.

I read Walker's 136 page decision. It seems to me that the problem wasn't that he was "zealously" pro-same-sex marriage. The problem was the absurd incompetence of the prop 8 legal counsel. Please, read the decision. I am for same-sex marriage and am only mildly happy with the outcome. It's hard to know that we won -- not really on a hard fought rigorous court debated merits -- but by default in the absence of any meaningful contribution on the part of prop 8 counsel.

If someone tries to stop you from marrying a women, or forces you to marry a man, we will help you FIGHT BACK! Studies showed that if the prop was worded "shall we make a calif. constitutional amendment to deny gays the right to choose whom they could marry" it would have failed. I do not believe this was the will of the people, but the will of outside state interests and inside state bigots.
