They don't have constitutional authority for the majority of what the federal government does. We ceased being a country of the rule of law some time ago and have since been ruled by whatever the idiots in power can get away with.
Wouldn't it be nice though if we could reign in these idiots with the constitution and once again rely on the laws to protect our individual rights and determine the actions of government?
We have to pull these politicians back to constitutional reality. Off-topic comment, but people fought for our freedom 200+ years ago; we owe the same to future generations.
Yes we do and I think that we are on the brink of seeing that change with BO working as the catalyst. He may actually unintentionally be doing something great for this country right now.
I'm watching my friends who traveled to DC on Cspan right now. Ms. Pelosi may be deaf to what's happening, but thanks to President Obama for shaking us from disinterest and lethargy.
Actually the constitution is very easy to understand and given it's modest size it's a quick read. When the constitutionality of most of the nonsense of what the federal government does today is questioned one of two clauses is usually mentioned. One is the general welfare clause the other is the commerce clause, neither of these was meant to transform our federal government from a simple, strong, and limited entity into the do anything and everything monstrosity we have today.
James Madison the author of the constitution said it best:
"The powers delegated by the proposed Constitution to the federal government are few and defined. Those which are to remain in the State governments are numerous and indefinite. The former will be exercised principally on external objects, as war, peace, negotiation and foreign commerce."
James Madison was strongly on the side of the Democratic Republicans, one of the two major parties in the first party system. Not all the founders agreed with the position he took there - Washington and Adams, our first two presidents, believed in a strong federal government and strongly disagreed with quotes like the above.
Not that either proves an opinion correct, but pointing out that there never was agreement on what you take for granted.
While many of the arguments we have today existed between the founding fathers I don't think any of them looked at the general welfare clause as carte blanche for doing whatever the federal government wanted to do as it is seen and practiced today.
While Washington, Adams, and others wanted a stronger central government they lost out in the constitutional convention and we have a constitution that provides for a strong yet very limited central government.
Not really. Remember that the whole point of the convention was to replace our first, failed government under the Declaration and Articles. The failings of that government were precisely that the central government had no authority. I don't think it's so clear what the limits of the federal government were meant to be by the founders (not that they ever agreed on it), what we're left with is modern legal scholarship on that matter and the large variety of opinions the founders had.
"With respect to the words general welfare, I have always regarded them as qualified by the detail of powers connected with them. To take them in a literal and unlimited sense would be a metamorphosis of the Constitution into a character which there is a host of proofs was not contemplated by its creators."
