  • I see the haters talking about the guys who got tickets, the haters dont understand that our rights are being taken away one at a time so these 2 fellas were just standing there ground, so the haters can kiss cop ass all day long as people like myself work hard to get OUR rights back.

  • I thought the Cop handled it very well due to the me constantly questioning him. but taking a picture of a person because you want to win a case? As a future Game Warden I would have never treated these men in such a crude manner.

    You clearly have done no research into what your Rights are, or what the law on this says. That cop testified in a court of law he has violated motorcyclists Rights, this same way, over 50 times. If it doesn't matter to you that a cop will disregard you and your Rights, then what Soviet Block country are you from?

    This video has nothing to do with macho or cool or stupid; it is about insuring you have your Rights. Wake up.

    The law HAS been changed - that's what this cop doesn't want to believe.

    There are 3 branches of government, and the Judicial Branch changed the law, by limiting what cops are allowed to do and telling them what not to do. It's called Case Law. This cop ignores all that.

    He's the dumbass, to use your phrase.

    Judge's rulings change how laws are enforced constantly, but if the cop ignores those rulings, you can get a ticket for not doing anything wrong.

  • I appreciate the video and it clearly illustrates poor officer training, a lack of knowledge regarding helmet law and bias.

    While I can appreciate the job many officers choose to do in trying to prevent crime and protect public safety, this is an example of what an officer should not do or say.

    The biker acted properly and was within his rights to both ask for the officer's Supervisor and to refuse to remove his helmet. Allowing himself to be arrested may have added impact to the case.

  • That seems like a foreign word. I looked it up. My ancestry is the type that would not wear one of those.

    Although motorcycling is similar to a Religion for me, believe me, this aerodynamic helmet is strictly for complying with the law; especially the legislative intent of giving me an additional safety benefit.

    Some legal helmets look like racing equipment, even though racing equipment is not legal to use on road. Looks are not relevant to legality, as case law states. Thanks, Johnny.

    For what? Correct. I have no doubt the officer, who claimed to be acting only in the interest of my safety (heheheh), knew full well, the California Penal Code does not authorize any cop to Jail any citizen for an alleged violation of any type of traffic infraction.

    Maybe he really was unaware, and was not trying to BS me into sumbitting to an empty threat?

    (Naw, you're right; nobody on the planet would believe that.)

That "is unreasonable. . . because . . . it would mean that a DOT symbol affixed to a yarmulke, a doorag, or a New Year party hat renders each presumptively compliant with the . . .Helmet Law . . . Such a notion is absurd." CHP v. Superior Court. The "helmet" here does not comply with DOT coverage requirements. 49 CFR § 571.218.

    Some rogue cops have a 17 year history of ignoring the Manufacturer Certification and the Presumption of Compliance for legal helmets, yet never writing a ticket for a single recalled helmet, whose legality has actually been rebutted, as defined in the law and title 49 regulation which determines all this.  A helmet the size of a yarmulke is a yarmulke and not a helmet, the same way a legal helmet the size of a bowling ball is really just a bowling ball, not a helmet.

  • Adirondack, Your opinion is contradicted by statistics. Only if you cherry pick certain stats the way some pro-helmet lobbys do, will your stated opinion seem valid.

    Far more serious injuries and deaths occur from damage to the chest and abdomen, yet helmets are a focus for anti motorcycling lobby because helmet laws keep ridership amd miles at a minimum.

  • The "public burden" argument is a myth that has statistically been disproved many times. It is commonly heard by helmet law proponents who want to think that a public financial burden gives them the right to dictate what type of safety equipment a rider should wear. This despite the fact that as a percentage, bikers carry more private insurance than the non-riding public.

    Using this logic, can I then state that all motorists should wear helmets while driving so I have less monetary burden?

    Maybe 2 guys got some legal knowledge. Shouldn't a cop that is violating the law and violating your 4th and 14th Amendment Rights be stopped? I filed the Internal Affairs Complaint last Thursday. Case law in CA says it's a helmet and case law says the cop's in trouble.

  • What happened in the video is a little bit like wearing your seatbelt, then getting a ticket for not wearing one. The cop then says you weren't wearing the type of seatbelt he would wear.
