Why not just say you don't want people to be able to smoke in public so that you won't have to smell it? Using that argument for it not to be legalized sounds like you just don't want people to be able to enjoy weed. Also, it takes more than smelling the smoke to get you high, so this won't cause a bunch of people to be running around accidentally high.
Getting a contact high is unlikely, and borderline impossible. I can speak from firsthand experience. I dont think it should be legal, but there are better arguments for it than that.
