The supremacy clause in the 10th Amendment does have merit. However, only if a State Law, or Ruling, is MORE BENIFICIAL TO THE GENERAL PUBLICS WELFARE AS A WHOLE. The Constitution does not give Congress the power to require that Americans purchase health insurance. Congress must be able to point to at least one of its powers listed in the Constitution as the basis of any legislation it passes. None of those powers justifies the individual insurance mandate.

What ever powers not delegated to Congress in the 9th and 10th amendment are delegated to the states.

This all effects checks and balances and separations of power. Giving Congress more powers.
