It is incredibly rare that an issue be sent straight to a direct public vote. The only problem with your logic is we in the USA don't live in a democracy. In America, we have a king. It's a piece of paper called "the Constitution". You're not allowed to make laws that violate it, even with the will of the majority behind you.

Read Amendment 14, secion 1 and weep. You can't grant special privilages to one group and deny them to another.
