In his case the ruling was that police officers are private contractors, with no more power than a security guard at McDonalds. He has shown how they make a choice to work under their oath or under the corporation. The National Defense Authorization Act just passed the Senate Tues 29Nov2011. It authorizes the US military to detain - on US soil - US citizens indefinitely without charge or trial.

A US Citizen is under US Federal Jurisdiction. A state Citizen is under the jurisdiction of the state of his nativity while in that state. Almost ALL claims to be a US Citizen are false unles one is born or naturalized in Wash. DC, Puerto Rico, or another US Territory. The 50 states are NOT US territory. Here's what cracks me up when I get to these checkpoints, since I'm an American born Mexican and so is the last 2 generations of my family...immediately these officers start speaking to me in spanish. I'm singled out right away. First off, I don't speak a lick of spanish nor do I know spanish. I speak fluent English only. Even after I establish that, I am still asked to give my keys to them to check the trunk. Never fails...happens everytime. Why? Because I was born in the USA with brown skin.

There are a lot of ways a person can become a US citizen, but, obviously, the most common is whether or not you were born within the boundaries of the US and at the time of birth you were subject to US laws.

@ernesthancock If you state that you were born in the US by naming a US state, than you are a US citizen. So, you still answered the question. It's not a game. It is an immigration checkpoint. By law, once legitamate US citizenship is established, the agent must release you (exception being if you are suspected of criminal activity within our enforcement authority). If US citizenship is not established, the immigrant or non-immigrant must prove lawful presence to be in / reside in the US.

If you say nothing, the agent(s) will not be able to determine your citizenship, which is the whole damn point of these checkpoints...to catch those illegally present in the US. They know there is no such thing as a U.S. Citizen. Just people. To claim you are a citizen is proof that you are incompetent to handle your own affairs. In his case the ruling was that police officers are private contractors, with no more power than a security guard at McDonalds. He has shown how they make a choice to work under their oath or under the corporation. A U.S. Citizen was born or naturalized in D.C., Puerto Rico, Marianas Islands, or some other U.S. Territory. State Citizens aren't U.S. Citisens. U.S. Citzens are Subject to U.S. Jurisdiction. Here's what cracks me up when I get to these checkpoints, since I'm an American born Mexican and so is the last 2 generations of my family...immediately these officers start speaking to me in spanish. I'm singled out right away. First off, I don't speak a lick of spanish nor do I know spanish. I speak fluent English only. Even after I establish that, I am still asked to give my keys to them to check the trunk. Never fails...happens everytime. Why? Because I was born in the USA with brown skin.

well if those border patrol agents understand the constitution, if you said you were born in a city clearly in the borders of the United States of America, that means you're a US citizen. NEVER answer a cops questions straight forward, they're designed to screw with you

@jonerton67 Yeah, because it's not like we have more important things to do than screw with people :P If you're a dick and give shifty or evasive answers to a straighforward question it sends up a red flag. However, most of the guys who have been around awhile know the difference between someone who is being evasive because they are hiding something and someone who is doing it to fuck with us. If you're just being a dick than you should expect us to return the favor. We are human after all.

Are there experts on Citizenship? I would say most probably. Are you an expert on citizenship? If not hw can you answer their question when you do not understand all the facts surrounding citizenship.
Try asking them "what's a citizen'.

@jamb027 The law is pretty clear on what criteria warrant a person to be classified as a US citizen. There are a lot of ways a person can become a US citizen, but, obviously, the most common is whether or not you were born within the boundaries of the US and at the time of birth you were subject to US laws.

OK, ok. First of all. Arizona is a shit hole. Second, you guys living in the shit hole are in the middle of some freaky war shit. Third, if you are asked if you're a US citizen, you can just say yes, unless you're attempting to relive the glory days of the confederation. Then you're on your own. Now that being said, get out of the desert. Youre frying your brian and you're making no sense anymore. Most of us refuse to travel through Arizona, and it's not because of the Border Patrol.

Why don't you just say it? Those officers get shot at and killed all the time and you have the nerve just to give them crap about that silly little thing. Just be proud that you're an American Citizen. I always answer proudly. Just because you're born in Florida doesn't necessarily mean you're STILL a US citizen...

@ernesthancock If you state that you were born in the US by naming a US state, than you are a US citizen. So, you still answered the question. It's not a game. It is an immigration checkpoint. By law, once legitamate US citizenship is established, the agent must release you (exception being if you are suspected of criminal activity within our enforcement authority). If US citizenship is not established, the immigrant or non-immigrant must prove lawful presence to be in / reside in the US.

That being said, to be perfectly clear, what I meant was that if you are committing a criminal act, the agent(s) are aware of it / have enough articutable fact to justify further investigation and the criminal act is within the agent(s) enforcement authority than it is perfectly reasonable to expect the agent(s) to investigate/effect an arrest.

@fo694013: OK so you agree that the driver does not have to say a thing, and that agent cannot continue a detention based on the driver being mute.
In other words, about the only thing thing the driver is required to do, is stop. About the only thing the agent can do is ask a few questions, and look for plain sight violations of the law.

@Pafoofnik1 Again....didn't say that. Being mute is enough suspicion to secondary a driver of a vehicle for further inspection. If you say nothing, the agent(s) will not be able to determine your citizenship, which is the whole damn point of these checkpoints...to catch those illegally present in the US. Now if you say nothing and hand the agent(s)...say a birth certificate or a passport than that should be proof enough and citizenship has been established.

@fo694013: Our legal system is based on the belief that a person is innocent until proven guilty. It is not my job to help an agent determine a thing.
Refusing to converse here is perfectly legal. Courts have repeatably held that doing something legal cannot be used as a reason to investigate. For example:

@Pafoofnik1 Your misintpretation of Martinez-Fuerte is legendary Pafoofnik. I've argued with you before and everytime you bring up that quote from the case. You don't need probable cause to secondary a vehicle. If you did it wold be impossible to get that (save for a k-9 alert) at primary by only asking a few questions. A car can be sent to secondary with very little suspicion (of an immigration offense). After that suspicion has been resolved, than you need probable cause to continue the...
