@neechee5150 It would be tricky to prove that the person had malicious intent and definitely was not raped, since many rape victims will go back on their word because they are terrified to come face to face in court with their rapist, or are just plain in denial. Rape cases alone are extremely difficult to prove and let alone prosecute. But a definitive false allegation is slander and should be dealt with as such.

The fusiform gyrus (facial recognition area) and memory become scrambled when under trauma, which is why many accidentally accuse the wrong person during identity line-ups. But of course false accusations are an injustice to everyone. @neechee5150 Any type of false accusation harms a person. Plenty of people are falsely accused of more crimes than rape, the FBI states that only 2% of all rape allegations are false. So, however the legal system already deals with other false accusers should be applied to these cases.

@neechee5150 Here's some statistics from RAINN: Only an estimated 40% of sexual assaults get reported. Of that 40% only 50% of those will be arrested. Only an estimated 6% of rapists will spend a day in jail. You could look it up on their site, they give all the research. The family court system in Canada is overrun and broken - A complete joke of preconceived notions. The woman simply need create some false accusation of abuse or violence and the father gets dragged through the system for years.

Turvey, 2008 is not a study, but a one paragraph critique of McDowell. The McDowell team did a followup analysis. They recruited three independent reviewers to evaluate the inconclusive cases based on a list of criteria that were common among the women who had acknowledged they lied.
The end result: 60% of the rape allegations were determined to be false.
Turvey has a pretty nice CV so I'm not sure why we should doubt his interpretation. I have read the story you are delivering on miscellaneous websites but not been able to locate a trustworthy source. So I ask again, what are your sources?
(I read that the independent reviewers found all but two of the unexplained cases to be false reports, which is undoubtedly a peculiar result).

Heck some companies even have stickter policies than that government. The government does not have a policy forbidding you to have a relationship with a coworker. RAINN and the US government cites the rate of rape for women as being 1 in 5. 60% go unreported, how can you be sure that these cases were truly not rapes? The women could have been in denial, you know, like most rape victims are, and just went back on the case because a court trial is very traumatic for a rape case.

Did you know that at rape centers a woman is considered raped if she was drunk and doesnt really remember having sex that well? Even if she said yes, had the man in her home and he was as drunk as she was. If she wakes up and says, "hey, my night is hazy, I regret what I did" she can call rape. Now not drugged...drunk! Rape while the victim was drunk is one of those more difficult areas because sometimes the person truly was raped but only remembers flashes, or sometimes the person mistakenly thought they were raped. Regardless, if a person is so intoxicated that they CANNOT give their consent to sex, it's rape. Legally, "lack of consent is a necessary element in rape" according to the legal dictionary.

Then look at Duke Lacrosse players case. The alleged victim turned out to be a fraud, and their lives were damaged severely. Yet the woman was not prosecuted.

@neechee5150 It would be tricky to prove that the person had malicious intent and definitely was not raped, since many rape victims will go back on their word because they are terrified to come face to face in court with their rapist, or are just plain in denial. Rape cases alone are extremely difficult to prove and let alone prosecute. But a definitive false allegation is slander and should be dealt with as such.

The Lacrosse playeres lives were permanently damaged. Yet even after it was absolutely clear that Crystal lied and did so on purpose, she was not held to any kind of penalty. Granted the attorneys are not going to persue her in civil court due to her lack of assesst, but she should have been prosectued and she wasnt. What should happen to her?

Besides that, people falsely accuse others for crimes often, because of how our brains are wired. The fusiform gyrus (facial recognition area) and memory become scrambled when under trauma, which is why many accidentally accuse the wrong person during identity line-ups. Especially, children identifying their rapist have a history of false accusations.

FBI Uniform Crime Reports from 1966-1994 reveal that the rate of unfounded rape accusations to be 8% to 20% compared to a 2%-4% for other index crimes such as murder or robbery(Russell & Bolen, The Epidemic of Rape and Child Sex Abuse in the US 2000) 1997 US DOJ reports a 8% false allegation rate but this is not based on real studies.

There is consensus that the 2% rate is not based upon legitimate research and statistical analysis. Given that legitimate studies find the rate to be much higher than 2%, the 2% figure has to be held suspect. Given that the 2% figure does not match the DOJ rate of 8%, it is clear that the real rate of false allegations of rape is much higher than 2% (at least four times)

The FBI definition and standards for "unfounded" are very clear and it is the gold standard. I would like to read this APRI study and find out why they do not use the FBI's standards

I have had experience with many women who had rape kits done that were obviously raped, but the evidence was still not quite enough and the case was dropped and filed as unfounded.

@neechee5150 Here's some statistics from RAINN: Only an estimated 40% of sexual assaults get reported. Of that 40% only 50% of those will be arrested. Only an estimated 6% of rapists will spend a day in jail. You could look it up on their site, they give all the research. It's logical to conclude that false rape reporting has a piss poor chance of coming to any fruition. I mean, there's only a 50/50 chance the victim of a false report will even be arrested.

My father (i'm a girl) was falsely accused of sexual harrassment when i was younger, i remember how it ruined our lives, both my parents got depressed but when the verdict came out they said that my dad was innocent, yet nothing happened to that women, she went on with her life. The family court system in Canada is overrun and broken - A complete joke of preconceived notions. The woman simply need create some false accusation of abuse or violence and the father gets dragged through the system for years.
We are at the mercy of lawyers, judges, psychologists, parenting "co-ordinators", child protection agencies, etc...
In the end, the outcome is usually the same: The father loses custody and is wiped out financially, regardless of being right, regardless of the fight.

People who make false accusations need to spend more time in jail.
However not all false accusations are true. That is why rape kits are necessary to convict males. You need the forensic and circumstantial evidence. Regardless of whether the woman is a drug addict or not she still deserves the right to a fair trial.
Yes, every sex fakes and every sex lies. The majority of women and men do not lie about rape. It takes a while to process forensic evidence but it is needed to convict someone.

It's a 45% percentile which is less then half. I doubt that this fact is correct. I mean some women lie about rape but the majority of are not lying. Maybe if men were comfortable with their sexuality and weren't afraid of reporting things then it would happen.

Turvey, 2008 is not a study, but a one paragraph critique of McDowell. The McDowell team did a followup analysis. They recruited three independent reviewers to evaluate the inconclusive cases based on a list of criteria that were common among the women who had acknowledged they lied.
The end result: 60% of the rape allegations were determined to be false.

(I read that the independent reviewers found all but two of the unexplained cases to be false reports, which is undoubtedly a peculiar result).
