Yes, it is true that one can oppose same-sex marriage and not hate gay people. Hate is a strong word. However, I don't think that the gay residents of California are upset because they think you don't like them. I think they are upset because you've denied them equal civil rights and their relationships equal recognition. Prop 8 has nothing to do with federal laws. Has to do with CA law, and CA law (Family code 297.5) requires that Domestic Partners be offered the same rights and protections as married spouses. Prop 8 doesn't change that, and neither voting no nor yes changes the federal laws you refer to.

States started giving incentives to keep married couples together YEARS ago because it was an effective way to prevent abandoned mothers with children. "Back in the day" most mothers didn't work outside the home and could not support their children. It wasn't about equal rights then, and still isn't. Vote Yes on 8 to protect the needs of children.

I believe in Children's rights over Adult Preference. Kids come first. Which parent would you deprive a kid of? Mother or Father? It shouldn't even be a question. That's only true for government benefits or entitlements, I'm still not able to have my insurance carrier give us both benefits because we are NOT legally married.
Plus my partner testified in court against me even though we are registered domestic partners, the judge said that we were not married so legally he was forced to.

Four lone judges could come up with a lot of bad ideas, so it's a good thing that a majority of the citizens can disagree with them. But the majority didn't argue with segregation because it was the right thing. On Nov. 4 we'll see what the majority thinks is right. Sometimes the majority is wrong, but that's our system.

If the law is trying to extend every legal right that lobbyists have asked for, then what is unequal? The Prop 22 people fought against California's domestic partnership law when it was going through the legislature saying that California voted against any type of marriage rights for gays.
Now the same people are whistling a different tune with the same melody, claiming that gays have civil unions so they don't need marriage. Right, like the Prop 8 people really support domestic partnership.
Jerry Brown - biased in favor of same-sex marriage - wrote that title specifically to evoke reactions such as yours. Those rights were only extended in May, and immediately contested by those who had passed prop 22 in 2000. Sometimes separate is necessary (public bathrooms) and sometimes equal (domestic partenerships and marriage)
The proposition had a different title when it was first registered for placement on the ballot back in November 07: LIMIT ON MARRIAGE. CONSTITUTIONAL AMENDMENT. Why does did that title change? Because on May 15 4/7 of the CA Supreme court controversially ruled to overturn the existing law that defined marriage as between a man and a woman. Until May 15 same sex marriage wasn't a "right" in CA.
Part 2: Why controversially? The other 3 justices in the court found the ruling to be overstepping the court's authority because the law defining marriage in the traditionoal way WAS constitutional. Why? Because Domestic Partnership extends the same protections (read equal protections) and priveleges as marriage in the eyes of the law of the State, and because the law defining marriage as between a man and a woman doesn't restrict those rights (or protections).
Part 3: So, yes cryan71, Jerry Brown did write it because the law had been changed by the May 15 ruling. The problem is it had been changed by the justices, not by the legislature or by the voice of the people.
I agree with the minority judges. The majority overstepped their prerogatives in redefining marriage without granting same sex couples additional "rights" other than a different label on a certificate. I believe the will of the people should be reinstated. I'm voting Yes on 8.

Supporters of Prop 8 are the same people who seek to lay blame just in case their child/neighbor happens to grow up to be gay. At least if someone they know is homosexual, they can say that they voted to "keep the gays from getting rights" to shame young adults into never accepting themselves, should they happen to be gay. It makes no sense, unless irrational fear based in ignorance is to blame. Prop 8 is a total waste of time, energy and money. No on 8 means equal rights to all citizens of CA.

I have a copy of it. Don't worry. The legislature twice passed legislation to allow same sex couples to be wed, the gov. vetoed it because he wanted to know if prop 22 was constitutional. It wasn't so here we are.
@MJoseOC: Glad you have a copy. It can be a bit hard to find online. Did you happen to read the dissenting arguments? They strongly opine that Prop 22 was constitutional and that the majority was overstepping the powers of the judiciary in ruling the way they did.
PS- I think the Gov made a wise call in waiting for the Court to rule then supporting the ruling, as it's his duty to uphold the law and Constitution. I just agree with the dissenting justices that the Court ruled the wrong way.
I also have a copy of the domestic partnership legislation. It does not grant all the privileges and responsibilities to a gay couple.
I guess you have never tried to file for one. Me and my partner did. We had to do various loopholes to get it. My insurance wont cover him because were not legally married, we had to report all my gifts I gave him (his tuition) and he was taxed for it, I have no legal right to sue on his behalf and he can testify against me in court. (which he did)

Either way, I agree that the hurdle shouldn't be higher for Domestic Partnership than for marriage and the law should be changed such that the requirements and protections are equal. But it should be done through the legislative process.
No, they upheld the idea that marriage IS a fundamental civil right, which was an idea first put fourth in earlier rulings from Perez v Sharp and Loving v Virginia.

Yes, it is true that one can oppose same-sex marriage and not hate gay people. Hate is a strong word. However, I don't think that the gay residents of California are upset because they think you don't like them. I think they are upset because you've denied them equal civil rights and their relationships equal recognition. Equal legal protection and the right to not be barred from marriage to the person you love on the basis of gender is actually more important to most people than popularity.

Prop 8 has nothing to do with federal laws. Has to do with CA law, and CA law (Family code 297.5) requires that Domestic Partners be offered the same rights and protections as married spouses. Prop 8 doesn't change that, and neither voting no nor yes changes the federal laws you refer to.
Yes, we should have the same rights under the law. If your quarrel is with federal laws, fight them.

States started giving incentives to keep married couples together YEARS ago because it was an effective way to prevent abandoned mothers with children. "Back in the day" most mothers didn't work outside the home and could not support their children. It wasn't about equal rights then, and still isn't. Vote Yes on 8 to protect the needs of children.

Domestic partnerships do not afford the same rights as marriage, and the State has more requirements from each individual in a domestic partership than a marriage. It is not even "separate yet equal"...it reduces gay Americans to second class citizens. No on 8....there is no "alternative" marriage. It's a lie.

rodgierad, I would like it explained again. What are the additional requirements of individuals in a Domestic Partnership? Cause Family Code 297.5 says, "Registered domestic partners shall have the same rights,
protections, and benefits, and shall be subject to the same
responsibilities, obligations, and duties under law . . . as are granted to and imposed upon spouses." Are we arguing about rights here, or the requirements to qualify for those rights?

That's only true for government benefits or entitlements, I'm still not able to have my insurance carrier give us both benefits because we are NOT legally married.
Plus my partner testified in court against me even though we are registered domestic partners, the judge said that we were not married so legally he was forced to.

First off no the bible was not written by god himself; it was the word of god and accounts of god and his will written by people, you can ask your priest about that one. Second off, there has been tons of reasearch done now to show that homosexuality is a genetic predisposition, not a choice; you can ask your biology professor about that one. I believe that the "right", the "consent" of marriage should be one of your spirit and of your heart. Perhaps, one that agrees with your particular motive of belief, your religion, your faith. Fine. Marry and carry on with us all, but please stay away from trying to and wasting time to pass a "law" that goes against the constitution of the government that allows you to pursue your motives, your beliefs, your faith and your conscience with out judgement from others.

cooljuno- Should we just go back to the original constitution with no ammendments? Many of today's civil rights were not in it. Four lone judges could come up with a lot of bad ideas, so it's a good thing that a majority of the citizens can disagree with them. But the majority didn't argue with segregation because it was the right thing. On Nov. 4 we'll see what the majority thinks is right. Sometimes the majority is wrong, but that's our system.

If the law is trying to extend every legal right that lobbyists have asked for, then what is unequal? It is only in the eyes of individuals that it is not good enough, but we can't fix peoples opinions by redefining marriage. Even today not all schools are equal - some just have better teachers, administrators and a stronger PTA raising more money. But the law has provided for them equally. Marriage and domestic union are the same - govt provided equally, people then make the difference.

Well if you can take marriage away from a group of people, what is stopping you from taking away domestic partnership? If this prop passes you could legally argue to make any type of civil union illegal since these institutions are posing as marriage therefore unconstitutional. This is only the beginning before every gay man and woman will be thrown in jail for voilating the law.

The Prop 22 people fought against California's domestic partnership law when it was going through the legislature saying that California voted against any type of marriage rights for gays.

Jerry Brown - biased in favor of same-sex marriage - wrote that title specifically to evoke reactions such as yours. Those rights were only extended in May, and immediately contested by those who had passed prop 22 in 2000. Sometimes separate is necessary (public bathrooms) and sometimes equal (domestic partenerships and marriage)

The proposition had a different title when it was first registered for placement on the ballot back in November 07: LIMIT ON MARRIAGE. CONSTITUTIONAL AMENDMENT. Why does did that title change? Because on May 15 4/7 of the CA Supreme court controversially ruled to overturn the existing law that defined marriage as between a man and a woman. Until May 15 same sex marriage wasn't a "right" in CA.

Part 2: Why controversially? The other 3 justices in the court found the ruling to be overstepping the court's authority because the law defining marriage in the traditionoal way WAS constitutional. Why? Because Domestic Partnership extends the same protections (read equal protections) and priveleges as marriage in the eyes of the law of the State, and because the law defining marriage as between a man and a woman doesn't restrict those rights (or protections).

Part 3: So, yes cryan71, Jerry Brown did write it because the law had been changed by the May 15 ruling. The problem is it had been changed by the justices, not by the legislature or by the voice of the people.
I agree with the minority judges. The majority overstepped their prerogatives in redefining marriage without granting same sex couples additional "rights" other than a different label on a certificate. I believe the will of the people should be reinstated. I'm voting Yes on 8.

Supporters of Prop 8 are the same people who seek to lay blame just in case their child/neighbor happens to grow up to be gay. At least if someone they know is homosexual, they can say that they voted to "keep the gays from getting rights" to shame young adults into never accepting themselves, should they happen to be gay. It makes no sense, unless irrational fear based in ignorance is to blame. Prop 8 is a total waste of time, energy and money. No on 8 means equal rights to all citizens of CA.

Your "never comment" was technically correct to begin with, with respect to the state of California.
The real point is that, again, civil rights are not a matter that you leve up to the vote of the people.
The people would not have given black people their civil rights, the people would not have given women the right to vote, and the people would not have given interracial couples access to legal marriage.
These things had to be fought for, and so does modern marriage equality.

The question of whether the label of "marriage" is a civil right in the eyes of the law is an interesting one. In the May 15 CA Supreme Court ruling, the dissenting opinions (one from Justices Baxter and Chin, the other from Justice Corrigan) say no. Why? Because CA's progressive Domestic Partnership laws (Family Code § 297.5) provide the same legal rights and privileges as marriage. In their view Prop 22 didn't take away those rights, therefore was not unconstitutional.

I have a copy of it. Don't worry. The legislature twice passed legislation to allow same sex couples to be wed, the gov. vetoed it because he wanted to know if prop 22 was constitutional. It wasn't so here we are.

@MJoseOC: Glad you have a copy. It can be a bit hard to find online. Did you happen to read the dissenting arguments? They strongly opine that Prop 22 was constitutional and that the majority was overstepping the powers of the judiciary in ruling the way they did.
PS- I think the Gov made a wise call in waiting for the Court to rule then supporting the ruling, as it's his duty to uphold the law and Constitution. I just agree with the dissenting justices that the Court ruled the wrong way.

I also have a copy of the domestic partnership legislation. It does not grant all the privileges and responsibilities to a gay couple.
I guess you have never tried to file for one. Me and my partner did. We had to do various loopholes to get it. My insurance wont cover him because were not legally married, we had to report all my gifts I gave him (his tuition) and he was taxed for it, I have no legal right to sue on his behalf and he can testify against me in court. (which he did)

Seems like they go against the CA Family Code. Is that because the examples you site are subject to Federal statutes vs. state law?
Either way, I agree that the hurdle shouldn't be higher for Domestic Partnership than for marriage and the law should be changed such that the requirements and protections are equal. But it should be done through the legislative process.

No, they upheld the idea that marriage IS a fundamental civil right, which was an idea first put fourth in earlier rulings from Perez v Sharp and Loving v Virginia.
