Special Constable Lightfoot has just got 3 years jail for this attack. 1 for perjury & 2 for assault to run consecutively. The two othe 'cops Sgt Stephen Russell & P.C. Richard Kelsall' were cleared of the assault. As for L/Cpl Mark Aspinal, he had the verdict of assault quashed by Liverpool Crown Court.

I am a serving police officer and this sickens me, I understand reasonable force at times is used by police I myself have been assaulted many times whilst on duty and have found myself dealing with determined aggressive assailants, from my viewing of the video I cannot conceive how the any of the three officers can justify their use of force, I cannot condone this assault which makes it harder for decent officers to do our job

They are called shoulder strikes,when you hit the shoulder it deadens the arm to make it easier to put the arm behind the back, its safer ...for both the prisioner and the officers and was used because they had to restrain the man quickly as all were at risk being in the middle of the road. If what I have about this case is correct, then a very disurbing aspect is that the magistrates who convicted Mr. Aspinall had access to the same video but nevertheless concluded he was guilty, in marked contrast to the appeal court judge's opinion. Indeed, the magistarates saw nothin illegal in the police's behaviour, again in contrast to the IPCC and CPS opinion. One wonders how many times the magistrates, who have limited knowledge of the law, convict the victims of police abuse of power.

The problem is that the system has become rather blind to the meaning of the term justice is blind, Magistrate and some judges allow their bias in favour of Police to sway their dicision on such matters.
It is highly unlikely that a 'working-class' person will ever get to be a magistrate. magistrates are drawn from the upper middle - upper classes - this is not democracy. Nine times out of ten, magistrates can't be assed to even get a fraction to the truth. I often wonder why the average magistrate even wanted to become a magistrate in the first place. And, are they really so stupid as to always believe the police are telling the truth? I kinda doubt it.

Special Constable Lightfoot has just got 3 years jail for this attack. 1 for perjury & 2 for assault to run consecutively. The two othe 'cops Sgt Stephen Russell & P.C. Richard Kelsall' were cleared of the assault. As for L/Cpl Mark Aspinal, he had the verdict of assault quashed by Liverpool Crown Court.

I am a serving police officer and this sickens me, I understand reasonable force at times is used by police I myself have been assaulted many times whilst on duty and have found myself dealing with determined aggressive assailants, from my viewing of the video I cannot conceive how the any of the three officers can justify their use of force, I cannot condone this assault which makes it harder for decent officers to do our job

I actually dont see what the problem is. They are called shoulder strikes,when you hit the shoulder it deadens the arm to make it easier to put the arm behind the back, its safer ...for both the prisioner and the officers and was used because they had to restrain the man quickly as all were at risk being in the middle of the road. It was excessive but not as excessive as the conviction taking into taccount the dangerous sorroundings he was trying to get all parties off.

Pretty sickening! Nobody should be assulted like that! It's shameful for the policemen, who are supposed to enforce the law, to abuse their power and acted above the law. The blatant abuse of power is the evil of democracy and unless the ordinary people speak up and speak out against such abuse, it will continue. I hope these policemen get the punishment they deserve.

If what I have about this case is correct, then a very disurbing aspect is that the magistrates who convicted Mr. Aspinall had access to the same video but nevertheless concluded he was guilty, in marked contrast to the appeal court judge's opinion. Indeed, the magistarates saw nothin illegal in the police's behaviour, again in contrast to the IPCC and CPS opinion. One wonders how many times the magistrates, who have limited knowledge of the law, convict the victims of police abuse of power.

@sunaru1 That is the problem with magistrate, they are not educated in law and have no real Idea about such matters, they are generaly people of what is considered moral standing (whatever their views are). The problem is that the system has become rather blind to the meaning of the term justice is blind, Magistrate and some judges allow their bias in favour of Police to sway their dicision on such matters.

It is highly unlikely that a 'working-class' person will ever get to be a magistrate. magistrates are drawn from the upper middle - upper classes - this is not democracy. Nine times out of ten, magistrates can't be assed to even get a fraction to the truth. I often wonder why the average magistrate even wanted to become a magistrate in the first place. And, are they really so stupid as to always believe the police are telling the truth? I kinda doubt it.

@sunaru1 As I said it is all based on Subjective morality, people from certain walks of life will have a different prespective view than, often school headmasters are choosen for magistrate service, this gives an idea of the menality type used, disiplinairians who will defend the system and it's coggs blindly, the mentality is often this! 'You are before because the police say you have been a bad boy, therfore you have been a bad boy, and need to be punished' then it's off to the Pub.

So, how do we change it? I am, perhaps surprsingly, a 'pillar of society' and pretty old. I have considered applying to be a magistrate. But, the forms and protocols themselves are geared to ensuring only middle-class / upper class with a certain attitude (pompous) will ever have a chance of success.
Perhaps you and I should apply to be magistrates. In fact, let's encourage every British citizen to apply to be a magistrate. There is nothing to say you should not do so.

Have you heard of John Harris, (you need to consider his thought with an open mind and not a literal one, but he makes interesting points) Also there is a growing movement concerning the understanding of Law, interesting times are afoot.

I'll look up John Harris. I think people from all walks of life should apply to be magistrates. Of course, the likes of you and me will be rejected, despite our 'respectable' backgrounds for the simple reason - we question police behaviour.
And, another point you make. The avearge police officer has exeedingly limited knowledge of the law but arrogantly believes they are the law.

I would certainly not be liked in the present system with my views, but my sister does have professional dealings with both Magistrates and Judges (she used to help the former try to understand the law:)

Piece of shit deserved to be locked up. He was abusing ambulance crew, when approached by cops he tried to run of but fell on the floor like a bag of shit cause he was so pissed. He compered this expeirience to fighting in afgan. How disrepectful to the REAL soldiers out there risking there lives and limbs for us. And by the way he resited arrest by puting his arms underneath himself and got distraction blows to make him release.

Well need he got release and found not guilty of all charges, though I don't think they charged him with the particular you cite. If there was a law stating that all dicks should be beatten on sight it would become a much more brutal state, and the police would become nothing but street thungs.
