This guy was blatently honest and he seems to have turned his life around. A bad call by her in my opinion, but as far as legality is concerned, the 12 month visa limit for jail sentences still applies. Grounds for compassion is a difficult one to call when offering leniency. It's true you can't base it off emotion, but willingness to rehabilitate oneself should be taken into account in these cases.

You ARE correct that Persian is spoken in Afghanistan, and it is indeed the national language. However, this language is known as Dari, and not often referred to as Farsi.

Additionally, Ethnologue categorises Dari and Iranian Persian as two different languages.

One thing that must be said, NZ criminals seem to be really nice guys! I do feel sorry for this guy because he was flat out honest, but the 12 month thing was the problem and thats how it goes. If I was the officer I wouldn't have let him in either so she did her job perfectly well in my opinion.

@mrbollocks1979 Canada is even stricter, a single conviction (no matter how minor, even if you weren't sentenced to a prison term) will indefinitely disqualify you for a visa and there is absolutely no discretion on the part of immigration. That said, unlike Australia where exclusion is for life, there is a way you can regain eligibility after 5-10 years have passed.

By comparison, in the US our threshold is 5 years combined prison term.
