Make sure you are going there at around noon. Is this after you collected all the books? You could wait until noon again and if it doesn't work that time just keep trying. Anytime around 11:50 is fine.

you can save the prisoner just start a big fight and they will disapear and then save him and leave thats what i did

Do you know if you have to kill the Prisoner they make you kill? It has been awhile since I played this and in the second part right after they gave me the dagger I just went up to him and killed him without clicking on the icon.
