  • I'll tip if I want to, call me cheap whatever, I will not be pressured by society to do what they say it is my decision. I can go out if I feel like it. If you don't like being a waitress find another job but don't blame people because your employer is cheap and you are too stupid to find another job that pays better.

  • I wish my employers had my back like that. People are ignorant. I think everyone should have to work as a server for at least a year because I can't pay my rent on 1$ tips all night. Why shouldn't the gratuity be included. Do you know how much we make per hour? In some states it's as low as 2.13 an hour. And people come in and rattle glasses at us and think they can talk to us however they want. Fuck that. Learn to tip and we won't have to add it to the bill. Ignorant assholes.

  • You Are so stupid! They received a bill with a total that had included a gratuity in the total bill! So you can't just say I will pay this but not that... They knew they were getting charged 18% the moment they sat down. They were given discounts for the appetizers arriving late. Seems like they wanted everything for free. Sit at home if you're not going to tip. It's not always the servers fault.

  • In England servers get paid a decent wage. America invented the tipping system as we know it. Capitalism, baby! We pay our servers 3 bucks an hour and make the public think it is expected to tip. One of the best labor cost cutting ideas ever.

  • @kd10230 Servers don't make minimum wage. If you've never served you don't know that. Plus most places have tip outs so the gratuity is not just for the servers it's also for other employees. Tipping is not an option. If you can afford to eat out at a nice place you can afford the tip. If you can't then go to McDonalds. They have a dollar menu for cheapskates.

  • We had a party of eight come in who refused the 18% gratuity.. Service was fine, they just said it was one party of four and two parties of two.... Server ended up getting 10% for each "party"..

    An employee gets paid atleast $7.25 if they don't earn enough tips. If they don't like the job, get another one. It's not my problem they didn't develop skills to work in well-paying jobs. We all EARN our fate.

    Bad (ie rude or neglectful, (btw slow is usually not waiter fault but kitchen and expo)) = Tip of 7% to 15%

    horrible (like really horrible) service = no tip

    If you receive any kind of service that wasn't bare rock bottom horrible... you tip. period.

  • There would be a note made of an automatic gratiuty on the menu. If there was not mention then they are not obligated. The 18% gratuity belongs to the restaurant if it is mentioned on the menu and added as the "service charge" on the check. This tip amount would not necessarily going to the server directlly. The service charge is owned by the restaurant. I think some added investigation into state at federal law regarding tipped employees in the state of PA should have been done.

    I don't tip people that have a wage or can set their own price if self-employed - that's right. If your a barber and rent the station fine charge what you want for the haircut without a tip. And ministers if your performing a marriage for one of the faithful its yuour JOB you get a SALARY so do not ask for more money.

    If someone only makes tips and does something for a tip or entertains me ,buskers, then its okay.

  • If the policy is "18% gratuity is added for parties of 5 or more", that becomes just as much a part of the contract as the price of the steak on the menu.You dont pay, that is the same as saying you wont pay the posted price of your meal.

  • @justcallmeassinine Well, that'd be unfortunate. We should be supporting this restaurant, not wishing for its demise. After all, they did the right thing and stood by their employee - many bosses, including several in my long-gone serving days, would have just shrugged it off. At some point, we have to stop catering to entitled jackasses who want something for free. They knew the gratuity situation and chose to eat anyway. Contract constituted, book closed.

  • I think you should always tip. Everyone is worth something whether it's a penny or 10 dollars on a 3 $ check. Some servers bust their ass and others sit down and visit the table once at most, Some customers think a 3 dollar bills means a quarter tip. Now if the server worked hard skip the % rule. If the didn't leave what they're worth then shame. I am a server and I am disgusted by my coworkers who don't work hard. You own a business you EXPECT customers to come just like customers to tip.

If it was busy, and the kitchen was jammed up, It means that the kitchen couldn't handle the volume, pure and simple, the server should have communicated this to the customer. If it was indeed an empty restaurant, it means that the line was more focused on setting up for the night, or too busy smoking a blunt out back.Sometimes it's the kitchen at fault, sometimes it's a shitty server to blame. eventually the blame falls squarely on management.

  • If you don't tip your waiter, then you are simply a huge dick. Even if they do a terrible job, you still need to tip, just very low, like 8-10%. If not, then they basically just worked for an hour and a half (usually how long people dine-in) for free. If you do a shitty job at work one day, you might get yelled at, at the most, but you still get paid. Why should servers be treated differently?

  • When I go to buy a car, a car salesman waits on me, and I don't need to tip them for that, even if I buy a car from them. If I go to the dentist, I don't tip the dental hygienist who preps me for the dentist.

    Why in the world would I tip a waiter or a waitress at a restaurant? It's up to their employer to pay them. I pay for is the meal, and that's it. Let the server and the business owner deal with any server's pay issues. I simply won't patronize any place that makes tipping mandatory.

  • @SuperSam424 If the service is actually terrible and it's not just a douchebag complaining their waitress brought the ice cream with 16 sprinkles instead of the 17 you demanded, then no, it's perfectly fine not to tip. If you service was ordinary, 15%. If you had a great, friendly, attentive server, 20%, though I usually tip even more than that, my base being 20% for regular service. I like to give people working a thankless job a little extra, because I've been there.

That's all. People are not honest. Therefore, an 18% gratuity should be placed on every bill. MOST people do not even tip 18% for that matter--people keep trying to lower the percentage and it is unacceptable.

  • I laughed and cried. Actually, if the lady in the video ever went outside the U.S.,she would find than many COUNTRIES in the world automatically add a gratuity to the food bill. This is because many people assume that waitpeople make at least minimum wage. This is not the case. She said it was illegal to add a service charge, but if it is stated on the menu and bill, there is nothing illegal about it. Many establishments have NO TIPPING signs posted.

    Sadly, many people do not tip.

    If the business explicitly stated the gratuity policy upfront (by for example printing on the menu itself or verbally telling the customers), and the customers accepted this policy by ordering, then they must comply no matter how stupid they think it is. If you accept, you must comply.

  • The BOTTOM LINE is, if you apply and accept being hired for a job where your income is based off of gratuity, that is YOUR problem and YOUR fault if you don't get tipped. You knew the good and shortcomings of that job before you started. If you are unhappy with how much you make, get another job. It is not society's responsibility to pay your paycheck. Don't complain about not getting tipped, you CHOSE to work there, it is not mandatory or expected automatically! Period!

With that said, you don't have to like the system - but to choose to participate in one part of it (dining out) while completely ignoring the other part (ensuring that the server doesn't work for free) is just in bad taste. So yes, you CAN choose not to dine out.

  • @nekkidandrew Of course the consumer is 'paying' the employee in the sense that without the business of the consumer, there would be no employer to hire the employee. The point I made quite clear is that the employer should pay a decent wage to begin with.  I don't have a problem with the concept of tipping so much as the notion that without tipping, an employee would not earn a decent income.

Maybe one day, some sort of reform act will be passed; I'm sure that will remove a lot of the allure of the job for people with outsized personalities and people skills that can really work a table and have the potential to be paid excellently for providing excellent service, but that's neither here nor there.

What I'm wondering is why the empoyer doesnt have a system of management that rewards good conduct by the employees? If they can't incentivise their employees to do their job well maybe they're in the wrong line of work.

  • @SupermarketsRevil Many places do offer this. One of my first serving jobs offered a battery of monthly-awarded collar pins in a number of categories (fun, guest service, teamwork, etc). A small trinket, sure, but it put you in the running to be employee of the month (which came with a nice bonus check) and, hey, there was some sort of prestige to be had being the shiniest server on the floor. I agree, more incentives would be ideal, but it's not like it NEVER happens.

But not tipping is just like spitting in someones face. When you don't tip, the waiter OWES the restaurant money from their own pockets. Gratuities are usually added in places where bad people usually dine. Don't give me that "you must earn" shit. Any old asswhipe can just SAY "I got bad service". Don't tip--don't eat.

  • Maybe it's cause I've lived in Asia where there is service tax and noone tips, but I just don't understand the concept of HAVING to tip someone. I thought a tip was a surprising, out of the blue act of generosity, not "If you don't tip me Ima spit in your coffee".

  • Gratuity does not mean fucking less service. An 18% tip isn't an ideal tip you tools. Any server will tell you that they want tips within the 20% - 25% range.   • The DA told the restaurant to drop the case against the couple because the restaurant would lose the argument in court. The restaurant never should have pursued it in the first place. They've gotten more bad publicity over this single incident than most other businesses would expect to see over a lifetime.

  • There isn't an obligation to pay even though x-number of dollars is granted to the total if the service was not provided. Gratuity is an award or gift that is given in exchange for the service, so since no service was given the customers really have no obligation to pay.

  • The law supports the traditional view, and is the reason why all restaurants/bars lose court cases over customers not paying tips. The only way to stop bad tipping is to pay waiters at least the federal minimum wage ($7.25 as of 2011). They do it in Europe and in Japan.

  • Customers and Waiters have two different definitions of tipping. Customers have the traditional definition (A non-mandatory gift for good service). Waiters/Bartenders/Delivery drivers have a new definition of tipping (A flexible mandatory payment for bad or good service).

  • @shaynahertl No, a restaurant cannot force a gratuity on the customers even if it's printed in the menu that parties of __ or more will be charged X% gratuity. If you want proof, go research the court cases where the judges upheld that a gratuity as defined by the federal government is a "voluntary sum of money as payment or a gift for services rendered". However, the restaurant can force a service charge, which the customer must legally pay. If it's called a gratuity, it isn't mandatory.

  • Mandatory tipping should be illegal? Are you an idot? Tipping was only invented so cheapskate restaurants could make their menu's appear cheaper by not having to compensate for service. Gratuity guarantees payment on large ass bills, because most citizens are cheap asses who invent excuses to pinch a penny. You can't just walk out on a bill, & then act all confused when the cops are called because you stole. Which, it is stealing by the way. People are dumb.

    either way, here's a good suggestion for police officers: do peace and justice a favor by also standing up for people's civil rights as you are enforcing laws. sound good? :D it's the right thing to do.

So by your definition of "theft" it is perfectly acceptable for me to walk away without paying for a cab ride (because of whatever complaint I choose), or a haircut, or any "service" that doesn't involve trading a "physical object" for money.   • Unfortunately, if the charge was part of the bill, they had to pay it. I would have taken the joint to small claims court. Then go for pain and suffering. But why did they stay there for an hour? That said, the management should have comped it. I agree with Cenk. Let 'em go! Furthermore, I think including a tip in a bill should be illegal. Certain unethical and predatory business practices are not legal in this country. It doesn't make us commies or anything, certain things are just not okay.

  • Gratuity is included on big parties because of people like them and the two people hosting that show.....i bet they tip 10% no matter how good the service is. By the way servers arent going give you crappy service just because the tip is included. As being a server....i give the same service sometimes better just on the hope that the customers would tip me over!

If the restaurant has a "stated" policy that they add grat. on to the bill of a large party and you agree to eat there then you have entered into an aggreement to pay for the product and service that you recieve. It's pretty fuckin' simple, but I wouldn't expect this meat-head to be able to follow linear thinking like that.

For instance, "I've been waiting for my food for an hour" can mean "i was told the wait was 45mins for a table, I waited 45min for a seat, and now it's been 15min since I've recieved my food." Apparently, they just walked out without paying the total of the bill and then got confrontational with the manager when approached, and I think it's funny they got arrested; Sue me.   • @kaminarigaston You do realize that "arrest" and "conviction" are two seperate entities, right? They are not mutually exclusive. Was OJ Simpson "falsely arrested" because he was found innocent by a jury of his peers? Forgive me for answering a question with a question but, hopefully, you can see the disconnect in your conclusion. Counter-culture idealism often trips up our nation's youth but it should diminish as you get older.

    a)What happened

    b)Who did it.

    Since there's no question about a) and b) and the judge says there was no crime, then they were falsely arrested.

    It's not like when they arrest someone for something and it turns out it didn'g happen or it weren't him.

  • As a sever, I bust my ass to make sure that my customers are happy. I dont understand how someone whose pay depends on their tips would not take their job seriously and do they best that they can do. Like the guy said, tips are rewards for a good job. If you are half assing it you dont deserve any tip you get.

    Why someone HAVE to pay you money when I've already covered my bill when I ordered my food.

    I tell waiters when I go out upfront I don't tip, because it's disrespectful.

  • @AgrivatedKillah That's kinda sad. A tip is simply a kind gesture to let the server know they are doing a good job. Most servers get paid 2-4$ an hour and their tip is a way to keep them in line in a way to make sure that they a do a good job and the customer is satisfied. The fact that you tell the server up front that you stiff is just rude. Its kinda sad that some people just can't let go of five extra bucks to someone else. Cheap pathetic human beings.

  • We add grat at our restaurtant for parties 8 or more but we dont slack off because of it....well at least I don't. I work hard for my tips
