@Pafoofnik1 The taser didn't "have" to be used for this, but it was still unlawful to not follow border laws and allow his vehicle to be searched regardless of the dogs not being there. I call it karma--wishing death upon your President is just asking for trouble. He may have only warranted a baton, but if someone doesn't show their goods to cops etc, they are considered a threat. Carrying on, no, but he is still not crime-free. Obey laws of the states you go to--ignorance isn't an excuse.

Far as I know the whole PC was based on a police dog detection of drugs. That is a strong PC and warrants a search without consent. However if it can be proven that the dog never detect or gave a sign detection then it is without merit and the lie is criminal and liable. That is the point on whether the dog did detect drugs.

There are three legal tests as laid out very explicitly by teh court; threatening, flight and seriousness of offence. The nebulous "resisting" or in this case simply disobeying commands is NOT one of the 3 legal criteria. You are categorically wrong and the 9th circuit has just ruled as such.
It would help if you read the rulling or a summary instead of just inventing what you suppose to be the case.
