  • I believe you mean article 3 section 2 which pretty much bars lower courts from deciding on cases such as this, in other words the only court who had the authority to issue an injunction and block portions of the law is the Supreme Court.

  • @1776blues, No, the US District Court of Arizona was the proper venue to take the cases. Next will be at the 9th Circuit Court of Appeals, in San Francisco which holds jurisdiction over Arizona. Lastly the Supreme Court will be the final venue for appeal, but only needed. Since AZ is appealing a USDCAZ ruling, then AZ wants 9thCCA to over turn Bolton's ruling. I expect 9thCCA will reverse Bolton and Feds won't challenge. Expect decision before November2010.

  • If all of the parts of the law were constitutional, it would be taking effect in it's original form.

    The fact that a federal judge who's sole duty was to determine whether or not parts of the law conflict with the constitution has declared parts of it unconstitutional should be proof enough.

    I agree is sucks to be asked for proof of citizenship if you meet "criteria" of an illegal when you're in an area that has a high rate of illegal immigrants. In this country you are innocent until proven guilty. If you are arrested or worse without given the opportunity to prove yourself innocent then that would be wrong in this country. People get accused of things in this country all the time because they fit the description or criteria of someone else. It sucks, but

    if I have to take 30 seconds to prove my innocents of something then its not that bad. I get asked to show my ID all the time for lots of different things. To get asked to show "papers" you have to have broken a law in the first place. It is NOT legal for a cop to stop someone and ask for "papers" just because they look Mexican. But once stopped for breaking a law, a white man will probably not get asked for papers in an area with high rate of Mexican illegals.

    So I see where the problem stems. How are law enforcement to find illegal immigrants in this country when they look like a lot of Americans? Asking for some sort of proof you have permission to be here, or are a citizen is one easy alternative to just arresting everyone who "looks" Mexican that happen to be in the area. There is no perfect way of doing it that will please everyone. People should be treated as people and not animals, and American laws exist to protect AMERICANS

  • SB1070 is unconstitutional because people who have been arrested and found innocent of any charges to be detained indefinitely until they have proven their immigration status. This is a clear violation of the Fourth and Fifth Amendments.

    In 2005, the U.S. Supreme Court handed down a unanimous decision in Muehler v. Mena that questioning someone regarding their immigration status is not a violation of Fourth Amendment rights - provided that person is already lawfully detained.

  • @borderraven: Muehler v. Mena is irrelevant. Mena's point is that police may QUESTION someone who has been detained. It sounds like we both agree police have that right. My point is that police do not have the right to PUNISH a person for not proving their immigration status, even though SB1070 says otherwise.

  • SB1070 is unconstitutional because it infringes on the sovereign authority of the Federal government over matters of foreign policy, of which immigration is one. The individual states DO NOT have the right to draft their own foreign policies. The Department of Justice has announced that it will challenge Arizona’s controversial immigration law SB 1070, it will not survive the legal challenge from the federal government.

  • @borderraven The States do not have the right to delegate Federal authority to their officers. The Department of Justice is attacking SB1070 on such grounds.

  • @AmericanBosniak, the federal government got its power and authority from the states, but under the 9th and 10th Amendments the People retain control.

    Last four words of the 10th Amendment are, "or to the people."

    Also, under Article 1 Section 10, "States may engage in war when actually invaded," Arizona is being invaded by armed drug cartels and unarmed illegals.

    Art 4 Sec 4 says "Each State shall protect the Union of States."

And according to the FBI, the number of violent crimes reported in Arizona between 2005 and 2008 dropped by almost 1500 while the number of reported property crimes during the same time period decreased by 8000.

Anywhere in Arizona 200 feet from the border the state has jurisdiction to enforce all laws. How far from the border does the BP lose jurisdiction and ICE has jurisdiction, 30-miles, 50-miles, 100-miles? I see the problem has gotten out of control. The government ignored it and the illegals increased the rate of crossings. Unless your "immigrants" go peaceably, I only see Martial Law as the solution.

  • @utube917, I'm getting the impression you feel the Arizona law is constitutional, but enforcement of the law may be a civil rights violation by some cops -- not all cops. Only time will tell and every stop and arrest will require scrutiny and explanation. I suggest people who feel violated by the cops file a grand jury complaint with the local attorney general and also speaking at city council meetings..

  • @utube917, In my younger days I got stopped, for a violation myself 8 times, and as a passenger when a headlight was out, we got stopped twice in the same hour, in Coronado, CA at mid-night. Rodney King was not racially profiled. He was high on drugs, speeding and led the cops on a long chase. Yes he a beat down, but then he was on his knees and would not prone out. True the incident exceeded the point where I would have tied to get up and run for survival. Now I drive safe 15+years.

  • @utube917, yes I believe cops won't racial profile under SB1070. Cops need you to give them a reason for a stop. How often do Pomona cops stop you? Do you keep a count on a calendar? Do you know cops only stop 2 percent of the drivers -- unless there is a DUI/Safety checkpoint? SB 1070 goes into effect in 49 days, I'm willing to wait and see how it goes for a year, and how effectively it motivates the illegals to leave. If the law is applied equally, then it protects equally.

    US Constitution Article 4 Section 4 says every state in the Union is responsible for protecting every state in the Union. This constitutional duty goes to every political subdivision in the state, down to the local police who have first contact with people and who intimately know every neighborhood.

SB 1070 is not intended for stopping illegals at the border, but is a "detection" tool for finding illegals. Article 4 Section 4 makes it a state responsibility to detect illegals, and that means the cops can do what Arizona law says.

  • Doesn't U.S. immigration law require non-resident aliens to produce I.D. when asked? To my knowledge, the Arizona law only gives law enforcement additional tools to identify non-resident "illegal" aliens after they've already been detained for other alleged crimes, and then only after probable cause has been established. After they're detained, the officer must have reasonable suspicion that the detainee is in the country illegally before he can ask for I.D.

I carry 4 photo ID and have no problems showing to cops if it protects the USA. The police should hold ID checkpoints over the next 5 years and ID everybody who goes into a sports arena, train station, airport, and shopping mall. We need to run off the illegals.

  • As a graduate of the Cato Institute I can assure you none of the above mentioned articles say anything authorizing the state to mandate carrying a birth certificate or any ID.... sorry, but you're completely wrong and even the sections that talk about protection from invasion is specifically talking about the federal government. Read US Constitution Article 4 Section 4, which basically says, "Every state in the union, is responsible to every state in the union, for securing our union against INVASION."
