Of course, this is not to say I support any restriction in exchange for protection, there are many cases of governments going too far throughout history, the patriot act being merely one example.

However, I do think the phrase is overly simplistic, as to be able to exercise liberty you must first give up at least some potential liberty. In the end, gravitating toward one extreme can be just as devastating to society as the other.

I guess the spirit of that statement is that it's a general rule once a society is established, saying that you should be very wary of giving up freedoms, but in the end if you take it to the logical conclusion you have no society at all. After all, what is rule of law but a person agreeing to give up some freedom in exchange for protection? When you have a law, any law, you are restricting what someone, somewhere can do.

As for giving up liberty for security, the problem with that phrase is it gets a bit tricky at point zero. In the state of nature you technically have unlimited freedom, but can't exercise it, not until you give up at least some to establish a society in which freedoms can be realized at all.

Besides, you are neglecting what the government gives in return. Ultimately it is a trade, we give it form and power, it gives us rule of law, the idea that no matter what it will protect certain rights and liberties. If it falls short on the bargain that is certainly a reason to criticize the specific government, but the failing of one example is hardly cause to condemn the idea of government in general.
