all these that are at Gitmo were arrested in war, by the military. Were rights don't have be be read. But if taken to a civilian court, all they have to do is claim they were not read their right or a lawyer wasn't there when questioned.
by law they have to be let free to come back and or plan another attack on the USA.

We were discussing terrorism.
Saying the country is at war opens up new issues and not one you wish to go down.
Osama declared war on the US (in writing), so any member of AlQaida would be a POW, it would also make 911 an act of war and the deaths of civilians collateral damage, the focus would then turn US treatment of "POW" and water boarding which is illegal and punishable by death.
Much easier to prosecute AlQaida as criminals in a civilian court where POW arguments would not work.
