El hecho de no especificar lo puedes ver como un vacio de la Ley o como una forma ingeniosa de incluis todos los casos, presidente o diputados mas jueces mas presidente, etc. Como considera todos los casos no especifica el proceso para inhabilitar o suceder al presidente, es decir parte de lo generico a lo especifico.
1. Declara que quien la viole Cesa en sus funciones inmediatamente

They use the reelection amendment storyline, but there was no such referendum. Zelaya never proposed this forbidden amendment, and for Fox to claim that he did is nothing short of a lie.
And by the way, a constitution written by the previous military dictatorship to preclude any meaningful amendment denies democratic self-determination and is essentially disfunctional... but apart from that, Zelaya didn't even break the rule they say he broke.

El problema es que si revisás la constitución actual de Honduras, te dás cuenta que no hay argumentos juridicos para sacar a un presidente, ni mucho menos "sucederlo" antes de los 4 años que manda la ley y tampoco "inhabilitar", eso no existe en esta constitución, si hay alguno de los "leguleyos" ha sido cuidadoso de leerla, por favor, digame en donde está, por que repito, NO EXISTE y al no existir esto se convierte en un vil y vulgar golpe de estado narco militar.

En realidad la constitución es muy estricta en este punto: Art.4 La alternabilidad en el ejercicio de la Presidencia de la Rep. es obligatoria. La infracción de esta norma constituye delito de traición a la Patria y Art.239 El que quebrante esta disposición o proponga su reforma, así como aquellos que lo apoyen directa o indirectamente, CESARÄN DE INMEDIATO en el desempeño de sus respectivos cargos.

Zelaya legitimately wants to change this so he could continue as president. same as Arnold Schwarzenegger would like to change the constitution so that he could be president.. in a democracy - there should be a process for changes to occur.. or it isn't a democracy. The violent nature of the takeover reveal it for what it is.. conservative right wing backlash.. and a coup.

The Honduran Constitution can be changed. Only 4 articles are not negotiable. One has of them is re election. Who wants bad and corrupt presidents re elected. No one. 95% of the Honduran constitution can be changed via congress.... mmmm I wonder why Zelaya did not go that route. You and Zelaya are liars.

ignorance is no argument. Honduras had problems with elected presidents who turned into dictators through fraud and corruption (like zee liar). So they named a few articles unchangeable:
--Election to presidency is banned forever to all former presidents. (Treason by constitutional definition)
--The republican form of government...
--Giving away Honduran sovereign territory is banned.

his proposed change to the constitution was through a referendum.. which is a legal procedure in honduras -- it's basicly a public opinion poll - though specifically the honduras constitution does not allow presidential terms to change.. his request for a referendum was legal. - he was favored by the poor - and hated by the rich. - yes... it was a coup. - they arrested him for the INTENT to change the constitution.. not actually changing it - and he had strong support.- and it's a democracy.

Congress passed a referendum law and Zelaya did not use this channel. He used one under his totl control, not one that would have been transparent. The week after he was ousted, a poll center was found that had results in his favor for his poll which never took place. how rigged is that? Zelaya is a Liar!

#1..the Honduran Supreme Court (15-0), #2.the Honduran Congress (124-4),
#3.the independent Superior Electoral Commission (TSE) that runs elections outside of government control,
#4.the Honduran Human Rights Obundsman,
#5.85 percent of the Honduran people.
One good thing comes from Zelaya's treason: Everybody in Honduras pays close attention to their Constitution now.

The only one who should be arrested is Manuel Zelaya. What sort of man is willing to plunge is country into a bloody civil war just so he could regain the presidency for a couple months? Should he return to office, don't look for him to go ahead with elections and give up power. Somehow he wil discard their constitution and be exactly what Hondurans rejected long ago.
