The chinese have been breaking copyright law for years. There is some irony here.

Well, the programmer being Chinese definitely was a factor in the court's decision process. But the federal caselaw will be applied to everybody. Copyright is something created by the law. So, according this ruling, the Chinese people never infringed any U.S. copyright.

Yes but No. There are treaties and compacts that have been made and are supposed to be adhered to by participating nations.

My guess is that his contrcat was flawed and that because it was he lost millions. I think that once you give someone "ownership" it is there's to do what they please. Its like shooting yourself in the foot.

He should have paid a wise US lawyer to write the contract.

Jenkins was saying if you got one copy, then you can make any copies. That's kinda semi-retarded. It is a matter of permissions. When someone do not have permission to make a copy, it's pirating. That's common sense.

In the Anna Mae He case, we nailed the judges for lying and judicial fraud -- the crooks distorted facts and made sham arguments. We finally reversed the thing 100% at the supreme court. We will do the same here: expose the fraud.

It depends on the license restrictions.

You have to be very specific on the definitions. Aparently the judge decided that the definitions meant that the owner could copy it in any of his computers.

Possibly they failed to state in court that the computers that were installed on were not belonging to the same owner.

It does look like the Judge took a bribe to come up with such a decision.

It is so clear and plain the fact is SunMicrosystem and its subsidiaries have made unlimited distribution of the PowerRPC software owned by Netbula and Dr. Yue without legal permission.

This is an infringement and the worst case of violation of Copyright Law.

Stop the double standards of U. S. Copyright Law ! SunMicrosystem has to pay for their infringement and violation of Copyright Law

To the companies, they probably thought as long as they got a court order in their favor, they as pure as a baby. But, regardless of what the judges chose to ignore, the facts are plainly there. The fact the facts were ignored or twisted only makes the whole thing stinks more. So, the main conflict here is the difference of opinion on what justice and truth are. Judges make law, not facts.

Yong Li, a pro se, was seriously injured during her protest against judicial fraud. She was holding a big sign that says "fraud ruling." For unknown cause, she fell from a second-floor balcony onto a staircase, landing in front of Governor Deval Patrick and other dignitaries. Instead of tending the injured woman, Gov. Patrick quickly ran away for "safety". The woman was taken to hospital for surgery. Wish her recover soon and continue her fight. See Sep 4, 2008 report by Boston Globe.

The double hardstands of US court could be found often either federal and state courts. In Cook County court, judge Dolan threatened me no less than 20 times when I argued to expose his misconducts to assist the other party Scott Pollock's attorney Tyma. Finally I caught them by two emails of Tyma. They were so dirty to conspiracy outside courtroom secretly to plot out Dolan's intended order to hurt me and my justified lawsuit. I support Dr. Yue to fight evils. Yongping

Jedediah Wakefield openly stated that Sun's purpose was to cause personal financial stability problems for Dr. Yue. See the record on the web site.

Sun had distributed vast number of pirated copies of Dr. Yue's software. Evidence included defendants' sales records and internal emails admitting the wrongdoing. The judges ignored the evidence and ruled in Sun's favor. The judge made a stern warning: "Mr. Yue, I am going to have you taken out if you don't be quiet" (quoting transcript). The court then ordered Dr. Yue to pay $219,949.90 to Sun.

The ruling ignored the basic facts:

1) the Chinese owned the copyright

2) sun admitted stealing the software

The judges lowered themselves to the conspirators of thieves by siding with big money.
