  • so exactly how, again, did this all turn out? Was she, in fact, convicted? Was she just detained, then released? What REALLY happened, as we only have what is shown here to go by. We have nothing to show what happened before or after the video. I don't trust when I only hear one side. I think we also have to take into consideration the local laws. I am a police officer in the Midwest USA. I am not familiar with local law in Britain.

  • and you were violent and aggressive when you were being arrested. You have the right to complain later about false arrest, but the law does NOT allow you to resist arrest at the time it was happening, and by this video you were, in fact, physically resisting, thus, bringing it on yourself.

  • @balerick48 Incorrect. The use of reasonable force in self defence is a well established in common law and applies in the case of an arrest where the constable is acting outside of their lawful duties (what you call 'false arrest') exactly as if a person comes up to you in the street and grabs hold of you and you resist. The constable should demonstrate the arrest was both lawful and necessary. If they use force to effect the arrest, they must then demonstrate the use of force was reasonable.

  • @balerick48 You are obviously not trained in law, are you? Let me tell you something as a law student. In Australia where I live (and I am sure the UK law is identical in this regard), the police must disclose their name and station when asked by any citizen. It is illegal to conceal that information from any citizen. Also, unless the police had a warrant to arrest, they can only arrest if they see an offence being committed, or have reasonable grounds to suspect an offence has been commited.

  • @UnitedKorean I doubt the laws are all the same. What may apply where you are from does not mean it applies in every other country. For someone trained in law you seem to forget that this video is only part of the evidence, part of what happened.  What went on before and after the video? Do you know?Was she really arrested for asking for the name or was she arrested for interfering with an officer in the performance of their duty, a crime here in the USA. I think we need to be very careful.

  • @balerick48 The lady was not comitting any offence and the police had no power to arrest. Furthermore, the police failed to effect a lawful arrest by failing to state that the lady was under arrest and failing to tell the reason why she was being arrested. That is false arrest as well as false imrpisonment. A citizen has a right to object to and refuse false arrest by resisting. Resisting a false arrest is not an offence. Moreover, the police had no power to put her under arrest that long.

  • @balerick48 The police breached the doctrine of Habeas Corpus, committing false imprisonment. Refusing to bail for the offence they charged her with is also against the Bail Act. Not allowing the detainee to contact the lawyer is also illegal. Everything the police has done here is absolutely illegal and against the law. The plice committed many crimes here and need to be charged and punished.

  • @djasonj. The police do nothing for ordinary people. All they want is an easy life, overtime and a inflation proof pension at aged 50. Have you ever needed them ? I expect they did f*ck all which is what they have done whenever I have needed them. This was an excessive use of force. I doubt that an arrest was even needed.
