  • @iXmetalXi You shouldn't post "I do not own this" or anything like that when you post something on YouTube. If you get sued, your "I do not own this" proves that you are knowingly breaking the law. Not that you'll be home free if you don't say "I do not own this," but saying it can hurt more than it can help.

    Just a point of advice mate - when you are going to commit a crime (e.g. copyright infringement), it isn't a good idea to confess to doing so by stating that you don't have distribution rights to the song you are distributing.

  • @HisDivineShadow245 It's only (Truly) copyright infringement if you are distributing it (for profit) and saying it is yours. If he says "I do not own this music" it's not copyright infringement. Also the fact that he isn't making a profit makes it so too.

  • @6KingCooper6 Your understanding of copyright law is considerably deficient. Distribution rights mean the right to distribute, whether for profit or otherwise. If you disagree, show me the statute or case law supporting your opinion. And driving a car with a bumper sticker saying "I stole this car" doesn't make it any less stolen - it just means you confessed to the crime.

    I'm NOT a copyright expert but I am just chiming in to make one small but important point about rules of engagement in fair debating. It is not his burden of proof to show whether he has a right to distribute, it is YOUR burden of proof to show that he doesn't. It is a first principle that you have the right to do anything in any free society unless refuted - you should understand this is the assumed point of view of any enlightened western audience.

  • @mak2675 Mak, the poster is claiming right out in the video comment that s/he doesn't have the right to distribute the music, s/he is CONFESSING that the rights are not his/hers and belong to the Deftones (which is probably not true) and their record label exclusively! And your concept of what you have a right to do in a free society is also wrong - you do not have the right to do what you want with other people's property. This is a fundamental truth in enlightened western society.

    You are incorrect.

    The fundamental, PRIOR principle is that I have the right to walk ANYWHERE on this earth, however a subsequent narrative of argumentation has refuted this claim, arguing some human attachment and claim to property. But prior to you coming to argue that point, I could go on your property all day. Fortunately, you don't have to provide this refutation because your country has rule of law that already implied this refutation on your behalf before ur birth.

I said the PREMISE that you have the right to do ANYTHING precedes the premise that you can't do certain things - NOT IN TIME BUT IN LOGICAL PLOT. When u make an argument, you must have choose a first premise. I'm saying absolute freedom is just that. The premises that refute any part of it = subsequent premises.

    Because of your demonstrated limited abstract thinking abilities, let me give you an example. Ur at an "all u can eat buffet". The first fundamental premise at this restaurant is: 1. U can eat anything at this buffet

    So far there are no exceptions. However, u can't create a mess, dig ur hands in the dishes, and fill up plates w/no intention of eating, etc - these are SUBSEQUENT PREMISES in the justification the buffet makes for its rule system.

    Try this: try to reverse the premises in the all you can buffet example. You'll find it doesn't work: the buffet can not coherently form an argument/justification if u grant the exceptions logically prior to the rules and the rules and exceptions cannot be stated together in the same premise since they are different points . Conclusion: The rule comes BEFORE the exceptions not in TIME/CHRONOLOGY but in LOGICAL STEP. You must understand logical order-time distinction.

    I know I was a bit long winded, but are you serious? So you think there is something absurd about the idea that the "rule comes before the exception"?!My lack of concision may bar me from law (which is fine with me - I seek truth first and not convincing judges ), but I know what I'm talking about. Ask any logician or political philosopher and they'll say I'm right - I'd rather have their approval than smooth talking lawyers.

    It just baffles me how people in law lack any idea of how arguments really work. That makes sense: u guys are more interested in persuasion than arriving at the truth. Thats why ur smug and u don't even realize that the buffet example I gave u was not a law example, but a philosophical counterfactual. I'm sure ur not interested in that though. My philosophy degree is a bit rusty, but I still remember a thing or two.
