  • The Geneva Convention did'nt save my Dad or Uncle during WW2, both parished in prisoner of war camps. So it only pertains to our prisoners. The Constitution is perfectly clear, that all persons, convicted of crimes in the United States must be held to the same rights as it's citizens.

    sure but most werent in the united states, most were not citizens, most were caught in war zone during declared war times. AUMF says they have no rights, even american citizens have no rights even if they are caught on american soil so long as they are designated "enemy combatant" by the president himself. personally if an american citizen was detaineed, then sure lets show proof. but non citizens are generally screwed, the Geneva Convention is meaninless these days.

  • Why would you be afraid to have all of the people face the justice system? Everyone has a right to a fair trial and you cannot just assume guilt. Many of these detainees were turned over and claimed to be terrorists by other people for money. If Bush had done things properly to begin with and followed the law and the constitution we wouldn't have to deal with this mess.

  • The Court's decision will never have the impacts that Scalia claims. Freedom and security can be reconciled within the framework of the rule of law and constitution. We have many bad people in jail, all of whom had lawyers and access to writs of habeas corpus. Scalia and others are just "cut and running" on basic civil rights!

    1. These POW's aren't even citiznes, so how are they entitled to any constitutional rights?

    2. Why do we the taxpayers have to pay for the trials of POW's who are more likely then not, terrorists?

    Now when a Soldier captures an Enemy Combatant he has to read them their Miranda Rights and charge them with a crime within 72 hours. So all the captives we have now will probably get off on a technicality if they were not read their Miranda Rights. Can a Solder legally charge someone with a crime? Do they have to be trained and authorize to write a citation? Soldiers now have to collect evidence at the scene while being shot at?

  • I understand what you're saying, but I think you're wrong. Let me clarify, I'm not one of those "we can't give up any of our freedoms" people but habeas corpus is too important to simply be brushed aside.

    Will more people die because of this decision? It seems likely. But that's a trade that I am willing to make. They can tap my phones and they can make me take forever at the airport but they can't lock me up without letting me know why. That's a problem.

  • yes i agree it cannot be disregarded unless there are grave consequences. I guess ultimately what we disagree on is the gravity of those consequences. We may also disagree on the idea the transparency should be encouraged in the executive systems over overseas intervention that are otherwise a potentially a very opaque system of 'justice'. This ruling may be detrimental to not only victims of terror but terror suspects themselves.

  • Remember, some that were going to be tried on these tribunals are picked up on the battlefield. If they now have access to our federal courts and have the same protections as American citizens under the Constitution, what does this say to an American soldier who captures one of these terrorists on the battlefield and may still be being fired at in terms of collecting evidence, rights of the person that he's captured and all of these types of things?

  • educate yourself. 90% of the detainees at gitmo were cab drivers and farmers kidnapped by norther alliance forces and turned over for a bounty. The reason bush doesn't want them to have access to the evidence against them is because there is no evidence against them.
