this decision facilitates terrorism within the US, by making it easier for captured terrorists to get released. whether this was the goal of those who support the ruling, or they just wanted a win against bush, it doesn't matter. the fact is that everyone (except terrorists) is a little less safe today because of this decision.
bull...do you really want anyone to be locked up forever just because someone called them a terrorist? that includes you also. are you some sort of lawless nut?
I find it very troubling that a United States Supreme Court Justice has adopted the language which states "The US is at war with Radical Islamist".
Based on these statements, how can Justice Scalia make a ruling on anything related to the issue with an unbiased opinion? If he views the many accused people picked up by Bush as Radical Islamist, which can be convicted of anything, then where does his level headed reasoning come in to debate the issue as they relate to the Constitution?
there's that racism! So you want everyone NOT A CITIZEN locked up without rights? And, you ignorant cow, the supreme court INTERPRETS the law. I suggest you read Marbury v. Madison for a primer on judical review, ok?
Your response is cruel. My problem is I have no arms or legs. Do you think that's funny. I don't. I hope you think about that. I hope you sleep well at night because without arms or legs I can't. Thank you for your cruelty.
From there, the radical Muslims can build themselves up, "preparing for fitness & then launching Jihad once they strengthen themselves." The trial, taking place in London's Blackfriars Crown Court, charged the three suspects with terrorism-related counts of possessing articles or documents." Damn, more bad guys putting financial strain on the courts at the expense of others. British courts, American courts. Wake up America! Close the borders. Demand justice from the S. Court! bnpDOTorgDOTuk
This was found at bnpDOTorgDOTuk: "Plans to set up a secret Islamist state in a remote part of Scotland & from there to wage Jihad, or 'Holy War' were revealed in the trial of four "British Muslims" yesterday. In secret conversations recorded by the police, one of the main conspirators, Aabid Khan, of Bradford, explained the plan as follows: "A group of Muslims can go to a remote place & set up a mini Sharia state & they can rule according to Sharia law, like this & stay there."
I haven't been a big John McCain fan up till now, but if Obama is going to give us more SC Justices like those five jackholes who voted for giving enemy combatants constitution rights I say McCAIN IN 08!
That is exactly Obama will do as President. The voters MUST look past his feel good speeches about "hope" and "unity" to stop these kinds of Supreme Court rulings. This is what liberals do. They don't know when to say when. They are for people's rights but what will they say when one of these likely-soon-to-be released Gitmo prisoners does a terrorist attack on US citzens? These detainees are NOT US citizens. The SC overturned the President AND the Democratic controlled congress! McCain 08!
Gillz17, "The voters MUST look past his feel good speeches about "hope" and "unity" to stop these kinds of Supreme Court rulings." Amen! Americans need to wake up & see what is happening in England with regards to radical Muslims having taken over complete neighborhoods & towns. The native Brits are being overrun. DO WE WANT THAT IN AMERICA? I mean, c'mon. It's crowded enough. We need to close the borders. NO more immigrants for now. Put up a "No Vacancy Sign." Take care of ourselves for awhile.
you're such a coward...willing to sacrifice liberty for a little imagined security. I love how you think only US citizens have rights. everyone that thinks like you deserves a little waterboarding.
if the reich-wing is so convinced these people in Gitmo are "terrorists" responsible for dastardly crimes why don't they want them tried in a court of law? are they afraid they have no proof?
This ruling is the most idiot decision lately by the Supreme Court. I AM SO PISSED! I've been paying taxes in this country for 40 years! And now OUR tax dollars are now going to fund these Muslim radicals to be able to have attornies & use our judicial system. This is ludicrous! Why didn't they ask me first?! I would've said, "NO! If you're going to steal my money, at least give it to the VICTIMS families of the 3,000 INNOCENT people killed at the WT Ctrs. Or to the thousands of maimed soldiers.
Try to take heart in Justice Scalia's comments. Unfortunately it will take another massive hit to awaken the people who think those dissenting are overreacting to the threat. You know...those beautiful and wise doves who think that the current tactics were devised by those who do not understand the myriad alternatives to deal with what they consider a manufactured and previously preventable problem :p
You might give your tax dollars to that purpose but it is highly unlikely they get that money, the arms dealers most likely benefit from your generosity. Ask yourself, what is a Representative Republic. Your answer is side tracked by the legislature that cares not what you need, they get what they WANT.
A huge nail has been hammered into America's coffin, thanks to the pussies in Supreme Court. I am literally in shock....I can't believe that these detainees are being given full rights. Now I fear this country is doomed for sure :-(
At the ethos of those who cheer this decision is a deep ignorance of both the nature of the threat (and of the history of such threats) and of the utility the methods used to combat such threats. Indeed they are also ignorant of the relative stature of American human rights practices and how they came to be.
I understand what you're saying, but I think you're wrong. Let me clarify, I'm not one of those "we can't give up any of our freedoms" people but habeas corpus is too important to simply be brushed aside.
Will more people die because of this decision? It seems likely. But that's a trade that I am willing to make. They can tap my phones and they can make me take forever at the airport but they can't lock me up without letting me know why. That's a problem.
yes i agree it cannot be disregarded unless there are grave consequences. I guess ultimately what we disagree on is the gravity of those consequences. We may also disagree on the idea the transparency should be encouraged in the executive systems over overseas intervention that are otherwise a potentially a very opaque system of 'justice'. This ruling may be detrimental to not only victims of terror but terror suspects themselves.
I mean to say that any president is going to maintain the intelligence community's right to snatch and grab terror suspects and hold them as assets. This practice is unfettered and unbroken in history and the moral outflow of our legal system is precisely what sets apart modern democracy's tactics from the mechanics of the systems that some critics have compared (gulags) the detention methods of late with.
Finally i would say that the integrity of that system we seek to defend is threatened here. A police state is only a few 9/11's away. The line between a state of equilibrium re habeas corpus and a state without regard for it is influenced by the integrity of that state.
All this has done is make life harder for intelligence assets. Instead of being transparent the executives who protect your right to rant on about human rights must now use offshore methods to preserve the ability to obtain life saving information. A little study in the global relativity of human rights could clear this in the minds of all but the most myopic, denial practicing ignoramus.
"According to Amnesty International, in an analysis of 500 detainees, a remarkably low number, only 5 percent, or about 25 detainees, were captured by US forces. Eighty-six percent, or about 430 detainees, were arrested by Pakistani forces or the Afghan Northern Alliance and turned over to US custody - often for a reward of thousands of dollars. " continued next post.
"The other 9 percent are not discussed in the Amnesty report. Many were sold to the United States to even scores or just for the money. Anyone living in Afghanistan - young or old - was fair game for sale to US forces. The oldest detainee shipped to Guantanamo was 75 and the youngest 10." -- Colonel Ann Wright, US Army, US State department, Retired.
Like I said in previous posts, everyone should know this by now.
I know the argument will be that Nancy Pelosi passed a minimum wage increase. LOL!
Well, at minimum wage, how many gallons of gas can you put in your car to drive to work for 1 week? Lets see. $7.25 won't even buy me 2 gallons of gas.
She is so worthless. Women, don't ask to ever be President or Speaker of the House or Majority Leader. Unless you force Nancy Pelosi to Impeach! I want to see 5 million women on Nancy Pelosi's door step promoting impeachment, or women in politics is dead.
For the record, I think he will be successful at bullying congress. Nancy Pelosi is a push over. She will introduce any legislation that undermines the vast majority of American Citizens, but will not introduce Articles of Impeachment.
I find it very difficult based on her track record to justify any woman ever obtaining a position of power which directly effects millions of honest hard working Americans. Its just too risky. I'm sorry ladies but Nancy Pelosi is your best example?
Will somebody please place handcuffs on George W. Bush? Please! You don't have to make them tight. Just place them secure, so he can't weasel out of them. For GOD's sake, is there anybody man enough to place handcuffs on George Bush?
He thinks he will be able to bully Congress into passing new legislation so that he can continue to hold innocent people and torture them, like he plays golf. Please, for the love of this Country, please very gently slip a pair of hand cuffs on him.
AP your video quality is so freaking bad if it were not for the fence we could not tell the detainees from the supreme court justices. It is not freaking rocket science. Youtube help can clue you in on how to upload video that does not look like crap.
Remember, some that were going to be tried on these tribunals are picked up on the battlefield. If they now have access to our federal courts and have the same protections as American citizens under the Constitution, what does this say to an American soldier who captures one of these terrorists on the battlefield and may still be being fired at in terms of collecting evidence, rights of the person that he's captured and all of these types of things?
educate yourself. 90% of the detainees at gitmo were cab drivers and farmers kidnapped by norther alliance forces and turned over for a bounty. The reason bush doesn't want them to have access to the evidence against them is because there is no evidence against them.
Allowing that system to go unchecked makes the US no better than Stalinist Russian or Nazi Germany.
what makes you think that cab drivers and farmers can't also be terrorists? that's like saying someone can't commit a crime if they have a day job. you are either ignorant, or you support the aims of the terrorists. for your sake, i would choose the former.
No, dork. I'm talking about Moore-style documentaries. I'm also talking about idiots who are taught by the tube like yourself. Think for yourself not what someone wants you to think. You are a sheep.
Sorry about the wait, I don't live on youtube. Your translation certainly applies. Let's just knock your "documentary" down quickly. Why was it that not all of the actors in the doc were willing to take a lie detector test? It was offered. Someone who watched a movie and declares themselves educated is becoming the norm but still idiotic. Habeas corpus was written for citizens and has always been suspended in time of war. You reaction was predictable though.
the film is just one of a thousand sources of information. Read my post farther down where I supply a quote from an interview with a retired US army colonel. Although she is just a Colonel, and you are a guitar player, so you probably know best.
And the colonels who state the opposite don't matter because the don't speak your reality that has been created for you. I can show you a video about leprechauns being real with eyewitnesses and pics. You would still be learning from a documentary with a purpose. Unfortuantely there is no such thing as informative braodcasting or documentaries about modern day events. It's all people's opinions and clever editing without clean sources. But you are right, it was a stab at Bush but w/o thinking.
So the media is only biased if they report information that runs counter to the interests of the conservative movement. A documentary is propaganda if its message is one you don't like to hear. If we don't like the facts we decide there are no verifiable facts only opinions.
Colonel Wright was summarizing a report by Amnesty International
If my beliefs about US conduct are in fact correct, that conduct is nothing new. It is in fact congruent with US foreign policy over the last 50 years.
If your beliefs are accurate, it represents a change for the better in US attiudes towards human rights. Even the law of probability is not on your side.
If my beliefs are correct, you have no idea about different cultures. You know nothing about the people you defend. Your mind sees only black and white. You do fall in the crybaby category. You took this as a shot at Bush without consideration of much else which still makes you happy.
NO. The media is biased when they repeatedly show one side more than the other. Besides, don't you know by now, news facts are extinct. It's all opinions. Nazis didn't get these rights that these pampered terrorists get who don't even appreciate them. You will come to change your mind on this decision...or just blame Bush when they come back. Do you know how many released prisoners were caught again on the battlefeild?
Yes Univerisity education in political science and anthropology teaches you nothing about other cultures. I think it is obvious that if anyone is ignorant it is you. Once again you call them terrorists.
Tell me this. How can a 10 year old be considered a terrorist worthy of idefinite incarceration? Yes I know how many released prisoners were recaught on the battlefield. Twelve. Scalia was citing false information when he declared that there were more in his discenting opinion.
"Antonin Scalia wrote in his dissent in Boumediene v. Bush: "At least 30 of those prisoners hitherto released from Guantánamo have returned to the battlefield." It turns out that statement is false."
"According to a new report by Seton Hall Law Center for Policy and Research, "The statistic was endorsed by a Senate Minority Report issued June 26, 2007, which cites a media outlet, CNN. CNN, in turn, named the DoD as its source. The '30' number, however, was corrected in a DoD press release issued in July 2007, and a DoD document submitted to the House Foreign Relations Committee on May 20, 2008 abandons the claim entirely."
"The largest possible number of detainees who could have "returned to the fight" is 12. The only one who has undisputedly taken up arms against the United States or its allies, "ISN 220," was released by political officers of the DoD against the recommendations of military officers."
--Marjorie Cohn, President of the National Lawyers Guild
I never said that there weren't bad guys at gitmo. I said they should have a right to a fair hearing.
We're fucked, voters dont elect anymore, you think that dumbass got elect 2 TIMES? or elected at all! the first president who got egged on the way to the white house? McCain is a fucking robot, just listen to him talk god dammit. 9-11 was an inside job, im not arguing on here im sick of that just wake up ppl, Guantanamo Bay could just join the lots of Concentration Camps in the U.S. such as the one in Beach Grove, Indiana. Just wake up and do somthing about on you own, dont follow a politician.
People should vote for Barack Obama since Barack is the same as McCain. Wants the embargo on Cuba, supports AIPAC and continues to support the status Q. F@ck YOU OBAMA! GIVE REAL CHANGE! FREE PUERTO RICO!
techklec you are an idiot. Anyone with a brain stem should know by now that 90% of detainees at gitmo where given to coalition forces for a bounty. Basically northern alliance militants picked up farmers and cab drivers and handed them over for money. Then your government put them in orange coveralls and called them terrorists so idiots like you would think something is getting done. The reason bush doesn't want them to have access to the evidence against them is because there isn't any.
qazwas2001 thinks that since everyone in jail who says they "didn't do it" should just be released automatically.Meanwhile,American servicemen are getting killed by Farmers and cabdrivers.
FACTS: 90% of gitmo detainees were never on a battle field. They were warm bodies NA warlords could collect a bounty on by kidnapping them and then saying they were Al Quaeda.
To not know this, you must have avoided picking up a newspaper since 2001.
Secondly, the latest National Intelligence Estimate clearly stated that Americans are LESS SAFE because of EVERY decision Bush has made since 2001.
"FACTS" from where? Do you absolutly know this to be fact??? I get a newspaper delivered daily, have several online subscriptions and have kept abreast of current events since the earlt fifties. While I don't have all the answers, YOU sure as hell don't. Stop dreaming and wake up to what's happening.
lol, do a google search. I love how this is news to you. It is your ignorance, you want to believe that the US is the world's hero, and you ignore/refuse to process any information that doesn't fit with your current belief system. If you are old enough to have been keeping abreast of current events since the early fifties, it is probably time you grew up.
Since I neither said nor implied that anybody is "the world's hero", so do yourself a favor and stop trying to make up your false accusations. I was grown before your mother got lost in the jungle and sat in a puddle of cum where all the monkeys jerk off.
as a guy who served in Viet Nam you should know better. You really think anything has changed? Like I said before, google it.
as for your "mother got lost in the jungle" remark. Not sure if this is some kind of attempt at a racial slur, but I can trace my lineage back hundreds of years to Ireland.
blah blah blah, take at look at the facts yourself and show me where I am mistaken. I form opinions based on facts, you avoid facts that threaten your childish belief system.
Let's send them ALL to Chicago land...into the waiting arms of another fine group of America haters,,,jessy jackson, luis farakoon, rev wright.danny glover etc etc etc.

This is a bullshit decision for two reasons:
1. These POW's aren't even citiznes, so how are they entitled to any constitutional rights?
2. Why do we the taxpayers have to pay for the trials of POW's who are more likely then not, terrorists?
Horrible call. Until this war is over, we have the right to hold these POW's indefinitely

this decision facilitates terrorism within the US, by making it easier for captured terrorists to get released. whether this was the goal of those who support the ruling, or they just wanted a win against bush, it doesn't matter. the fact is that everyone (except terrorists) is a little less safe today because of this decision.

LandOfTheBrave01 3 years ago
This is not a defeat for bush, this is a defeat fo the constitution. The purpose of the supreme court is to folow the law regardless what you think.

McCain 08!

Geo408 3 years ago 2
At the ethos of those who cheer this decision is a deep ignorance of both the nature of the threat (and of the history of such threats) and of the utility the methods used to combat such threats. Indeed they are also ignorant of the relative stature of American human rights practices and how they came to be.
diverdan00 3 years ago
I understand what you're saying, but I think you're wrong. Let me clarify, I'm not one of those "we can't give up any of our freedoms" people but habeas corpus is too important to simply be brushed aside.
Will more people die because of this decision? It seems likely. But that's a trade that I am willing to make. They can tap my phones and they can make me take forever at the airport but they can't lock me up without letting me know why. That's a problem.
jeremy22227 3 years ago
yes i agree it cannot be disregarded unless there are grave consequences. I guess ultimately what we disagree on is the gravity of those consequences. We may also disagree on the idea the transparency should be encouraged in the executive systems over overseas intervention that are otherwise a potentially a very opaque system of 'justice'. This ruling may be detrimental to not only victims of terror but terror suspects themselves.
diverdan00 3 years ago
I mean to say that any president is going to maintain the intelligence community's right to snatch and grab terror suspects and hold them as assets. This practice is unfettered and unbroken in history and the moral outflow of our legal system is precisely what sets apart modern democracy's tactics from the mechanics of the systems that some critics have compared (gulags) the detention methods of late with.
diverdan00 3 years ago
Finally i would say that the integrity of that system we seek to defend is threatened here. A police state is only a few 9/11's away. The line between a state of equilibrium re habeas corpus and a state without regard for it is influenced by the integrity of that state.
diverdan00 3 years ago

" continued next post.
qazwas2001 3 years ago
"The other 9 percent are not discussed in the Amnesty report. Many were sold to the United States to even scores or just for the money. Anyone living in Afghanistan - young or old - was fair game for sale to US forces. The oldest detainee shipped to Guantanamo was 75 and the youngest 10." -- Colonel Ann Wright, US Army, US State department, Retired.
Like I said in previous posts, everyone should know this by now.

Vikezupa 3 years ago
educate yourself. 90% of the detainees at gitmo were cab drivers and farmers kidnapped by norther alliance forces and turned over for a bounty. The reason bush doesn't want them to have access to the evidence against them is because there is no evidence against them.
Allowing that system to go unchecked makes the US no better than Stalinist Russian or Nazi Germany.
qazwas2001 3 years ago
what makes you think that cab drivers and farmers can't also be terrorists? that's like saying someone can't commit a crime if they have a day job. you are either ignorant, or you support the aims of the terrorists. for your sake, i would choose the former.
ellwyn 3 years ago
ellwyn, I'm sure I've had arguments with you before.
It is a known fact that they rounded up anyone and sold them for the bounty. Watch "road to guantanamo"
That entire system was inept, and the Bush admin wants to let innocent people rot to hide the truth.
What makes me better than you is that I would never support the Nazis, no matter what Fox news told me.
qazwas2001 3 years ago
Life Lesson #1: Quit learning from Michael Moore movies! You will be better off and more informed.
hanzender 3 years ago
If you think Road to Guantanamo is a Michael Moore film, it is you who is ill informed.
qazwas2001 3 years ago
No, dork. I'm talking about Moore-style documentaries. I'm also talking about idiots who are taught by the tube like yourself. Think for yourself not what someone wants you to think. You are a sheep.
hanzender 3 years ago
Translation: It is easier to believe whatever you want if you ignore all sources of information.
qazwas2001 3 years ago
Sorry about the wait, I don't live on youtube. Your translation certainly applies. Let's just knock your "documentary" down quickly. Why was it that not all of the actors in the doc were willing to take a lie detector test? It was offered. Someone who watched a movie and declares themselves educated is becoming the norm but still idiotic. Habeas corpus was written for citizens and has always been suspended in time of war. You reaction was predictable though.
hanzender 3 years ago
the film is just one of a thousand sources of information. Read my post farther down where I supply a quote from an interview with a retired US army colonel. Although she is just a Colonel, and you are a guitar player, so you probably know best.
qazwas2001 3 years ago
And the colonels who state the opposite don't matter because the don't speak your reality that has been created for you. I can show you a video about leprechauns being real with eyewitnesses and pics. You would still be learning from a documentary with a purpose. Unfortuantely there is no such thing as informative braodcasting or documentaries about modern day events. It's all people's opinions and clever editing without clean sources. But you are right, it was a stab at Bush but w/o thinking.
hanzender 3 years ago
So the media is only biased if they report information that runs counter to the interests of the conservative movement. A documentary is propaganda if its message is one you don't like to hear. If we don't like the facts we decide there are no verifiable facts only opinions.
Colonel Wright was summarizing a report by Amnesty International
If my beliefs about US conduct are in fact correct, that conduct is nothing new. It is in fact congruent with US foreign policy over the last 50 years.
qazwas2001 3 years ago
If your beliefs are accurate, it represents a change for the better in US attiudes towards human rights. Even the law of probability is not on your side.
qazwas2001 3 years ago
If my beliefs are correct, you have no idea about different cultures. You know nothing about the people you defend. Your mind sees only black and white. You do fall in the crybaby category. You took this as a shot at Bush without consideration of much else which still makes you happy.
hanzender 3 years ago
Do you know how many released prisoners were caught again on the battlefeild?
hanzender 3 years ago
Yes Univerisity education in political science and anthropology teaches you nothing about other cultures. I think it is obvious that if anyone is ignorant it is you. Once again you call them terrorists.
Tell me this. How can a 10 year old be considered a terrorist worthy of idefinite incarceration? Yes I know how many released prisoners were recaught on the battlefield. Twelve. Scalia was citing false information when he declared that there were more in his discenting opinion.
qazwas2001 3 years ago
"Antonin Scalia wrote in his dissent in Boumediene v. Bush: "At least 30 of those prisoners hitherto released from Guantánamo have returned to the battlefield." It turns out that statement is false."
qazwas2001 3 years ago
"According to a new report by Seton Hall Law Center for Policy and Research, "The statistic was endorsed by a Senate Minority Report issued June 26, 2007, which cites a media outlet, CNN. CNN, in turn, named the DoD as its source. The '30' number, however, was corrected in a DoD press release issued in July 2007, and a DoD document submitted to the House Foreign Relations Committee on May 20, 2008 abandons the claim entirely."
qazwas2001 3 years ago
"The largest possible number of detainees who could have "returned to the fight" is 12. The only one who has undisputedly taken up arms against the United States or its allies, "ISN 220," was released by political officers of the DoD against the recommendations of military officers."
