  • Been there done that. Cali law enforcement panic when they get a minority that can articulate and don't revert to profanity. It's a damn shame that many in law enforcement don't posses the people skills and cajones to change the protocols of racial profiling within their depts. They just go along with the program. Color of authority. Yeah right. Thank God for cameras or this guy may have been beaten for being right...

  • You better know your tipsy limit. As far as being tipsy, youre probably exceeding the alcohol limit. Best thing to do ride around with a high quality tape recorder, as soon as you are being pulled over turn it on and throw it in the glove compartment. And lock it up, they need a seperate warrant for the glove compartment if it is locked.

  • He's schooling that Officer. No probable cause, and yettttttt you want to conduct a sobriety test.

  • A cop can pull someone over for a random check, and just say that its a late night and there may be several intoxicated drivers. The police officer did overstep some bounderies, however the other man did as well. He should simply cooperate with the sobriety test, prove he is sober, then ask to go on his way. If he is not released, then he waits and does what he is told to do. He may later on file a complaint, however it is ALWAYS best to cooperate no matter what.

  • Nooooo theres no such thing as a random check where you pull people over in the process. There has to be a reason for pulling you over. Unless you are conducting a checkpoint, and that is a different case in it self. You are wrong. But you should comply and file your complaint promptly after.

  • I do not like your statement "You are wrong.". You did not clarify to which point in my statement I was incorrect. I don't think you would like to argue in court that you were driving perfectly when submitting a complaint. I do, however fully agree that you should always comply with a police officer, and I think that it was unwise for the driver to get him to "back down". This person won. Usually you lose. I would politely remind the officer what I believe my rights are, and hear him deny them.

  • It is illegal for the police to pull someone over for a random check. There has to be a reason, for example, driving iradically. And even then there have to be some evidence in order to preform a sobriety test, for example, you can smell an odor, you can see pot in the car/an open container. And even then, in court the police have to prove you are guilty. Thats one of the reasons police cars now have a dash camera. A random check? A check of what. Random is illegal.

  • You said you had a degree in criminology. First off its extremely easy to come up with a reason to pull someone over, however the next claim of yours should be false. To my knowledge, no amount of evidence can force someone to take a sobriety test, as it is always voluntary. Denial, however is taken strong note of in court. Random checks, legal or not, will always occur again due to the simplicity of accusation. 90% of people are 100% cooperative, and cops will risk if not, they have a record.

  • I am speaking of legal and illegal, not whether the police can come up with an actual reason or not. I am sure they can always make a reason up. So then yes random checks do occur, illegally. As far as a sobriety test, I know you do not have to blow, but you automatically forfeit your liscense without it, and you will have an opportunity to hire a lawyer and knock the felony down to a lesser charge (Usually with community service).

  • Ok well there would be where our differences came from. I'm not sure if it instantly becomes a felony if you refuse to take a test. Again, what if you turned a corner to tight, and get pulled over for DUI when your perfectly sober? I don't think you will get a felony for that if you had no other indications of any intoxication. Thats not something that I'm well versed in, however and you would probably know better than me

  • You cannot get a DUI charge, while being perfectly sober. The DUI refers to Driving Under the Influence. There has to be an influence of somthing, like drugs. You are charged with a DUI. But that is only a charge, thats why in DWI's, Driving While Intoxicated, if you don't blow into the test, there is usually a lack of evidence that a judge will consider. But it will cost you a good sum of money to higher a lawyer to take care of it.

  • Now you speak of cooperating with the police. Thats a tricky word, as in, the police officer is building a case against, they are not your friends, they are not trying to help you out with anything. So yes cooperate, but know your rights, know that the police must provide you with a reason of pulling you over, probably cause to search your vechicle, cannot detain you for a long period of time without reason. And in the end it is the prosecutors job to prove guilt.

  • Yea ha and I don't in any way suggest sucking up to a cop. But it is obviously true that whether or not you agree with him is irrelevant, you should normally do as he says, let him know of your disapproval, and deal with it later in court, rather than risk a violent situation that in the very least will take away the rest of your night.

  • No....n officer does not have 2 tell u y your pulled over....it is a courtesy not the law...if they arrest you they must tell u y within 48 hours.......

  • In my state they have to tell you. They aren't allowed to just pull over anyone and ask for id on a whim.

  • I do agree that kamau could have said things more nicely but I don't think his tone of voice was "illegal." It's important that police officers are held accountable for their illegal conduct. It's not okay to break the law to enforce the law. The ends don't justify the means.

There were actually two officers about to stop us as soon as we hit lennox/prarie ave in LA. He backed down because he knew what he was doing was illegal.

    For crazymofo1973 You can't be "detained" or arrested for refusing a DUI test if there was no probable cause & that CHP knew it. Many bad & good police-public interactions have been taped by this group and founder Diop Kamau--see policeabuseDOTorg. He does great and much needed work. Media bias had nothing to do with this--this was bad & illegal police procedure.

  • That's my point. He can be arrested if the officer suspects the driver is under the influence. If the BAC test shows he was below the legal limit, then he'll be freed. But, if he was driving in such a way that made it look like he was intoxicated, then the police have every right to pull him over. But, we don't know b/c this guy "forgot" to include that part on the video. Quit challenging authority and let the police do their job.

  • Field sobriety tests are completely voluntary, by law. All officers are supposed to be trained and told to tell all DUI suspects that field sobriety tests are voluntary but if the suspect refuses, they are to be warned that the "refusal" can be used against them in Court. Refusing to take a DUI test is not a legal reason for a stop. You got it backwards. There has to be a legal reason for the stop first before the officer can ask the suspect to take a DUI test.
