All Article 1 Section 8 says is that Congress has the power to collect taxes. Further, Article 1 Section 2 says taxes have to be direct and apportioned among the states. Apportionment was one of the main reasons why we DIDN'T have an income tax because it was logistically impossible to collect income taxes by apportionment. 1913 and the 16th Amendment is what changed that. The only argument you can make is that Ron Paul hasn't read the 16th Amendment.
Unfortunately, if you made that argument you would also be wrong because Paul has never argued the 16th Amendment doesn't exist merely that it was ratified in a questionable manner. Further, Paul has worked to try to repeal the 16th Amendment but has never said it was legal to not pay taxes. He's stated specifically that not paying taxes would be engaging in civil disobedience.
Paul's position is that the intent of the founders was never to levy a tax upon personal income and the sixteenth amendment was a short sited attempt to pay for a war we should never have entered.
Pollock v. Farmers' loan and trust clearly shows Paul's argument is indeed valid. The briefs of the majority opinion predicted the real effect of an income tax in a democracy. By 1945 the personal income tax got all the way up to 94%, it never stops to raise when the fair share argument is in play
If article 1 section 8 provides the ability to tax in a global sense as the IRS does, then why did we find it necessary to pass the sixteenth amendment?
