  • They negated Magna Carta that set limits on what the king could do. Magna Carta set up the jury trial, inheritance, Parliament and other rights of man that all Common Law Nations observe. The Courts are now attempting to negate the right to a Trial by Jury. Soon, America will be a more repressive totalitarian state that the USSR was.

  • I'm going thru condemnation (eminent domain) right now. Funny how a lot of projects that were on hold for years suddenly are going through now that home prices are at an all time low. Government-sanctioned theft. I live paycheck to paycheck and they are telling me that getting the loan paid off is "fair". I'm left with no house - forcing someone to sell their investment when it's not smart to do so is criminal.

  • corparations are trying expand eminent domain to aquire land at a forced lower price. they simply will not pay full price for something they are going to destroy. there needs to be eminent domain insurnce. Also everytime is sold the buyer must 1st agree with their town preditermed price in the event eminent domain, and can not changed.

    With so much corruption, arrogance and incompetence with legislators, it is also imperative to question whether 'public purpose' and 'public use' are in fact so.

    The courts must second guess' the legislature, not less.. Most politicians are more interested in themselves and perceived votes. Unholy alliances between bureaucrats, politicians, lobbyists and big business abound. Property rights must not be trampled by dirty politics of the day.

  • Judge Roberts is dead wrong. We have 3 branches of government for checks and balances. "Deferring' to legislators is like asking the foxes to guard the hen house - too much corruption, incompetence and incestuous bond with developers. This is common knowledge.

    Look at the city of New London today - plans have gone array. Lives destroyed. Private property rights buried. Eminent Domain Abuse is happening too often.

  • On December 10 1948 the United Nations General Assembly adopted The Universal Declaration of Human Rights. Article 17: (1) Everyone has the right to own property alone as well as in association with others. (2) No one shall be arbitrarily deprived of his property.

  • @LER77 As of 2010, the United Nations General Assembly has yet to 'adopt' a position from which anything they say is relevant to anyone. Some years ago, a group of people who actually had to deal with the prospect of governing a nation came up with this little thing:

    'nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.'

    You might trying looking in the US Constitution, maybe the Bill of Rights.

    During the hearings, I made this point to the dean of the law school at my institution -- a liberal Democrat with a PhD from Oxford and JD from Yale -- and he said that he had never seen anything like this. He was "flabbergasted" by Roberts' detailed recollection of the contents of *footnotes* in cases of secondary significance. And without notes.

And most of all what the hell does this have to do with Ron Paul? This is the same dude who was calling the IRS unconstitutional without even checking out, oh I don't know, Article 1 Section 8.

  • All Article 1 Section 8 says is that Congress has the power to collect taxes. Further, Article 1 Section 2 says taxes have to be direct and apportioned among the states. Apportionment was one of the main reasons why we DIDN'T have an income tax because it was logistically impossible to collect income taxes by apportionment. 1913 and the 16th Amendment is what changed that. The only argument you can make is that Ron Paul hasn't read the 16th Amendment.

  • Unfortunately, if you made that argument you would also be wrong because Paul has never argued the 16th Amendment doesn't exist merely that it was ratified in a questionable manner. Further, Paul has worked to try to repeal the 16th Amendment but has never said it was legal to not pay taxes. He's stated specifically that not paying taxes would be engaging in civil disobedience.

  • Paul's position is that the intent of the founders was never to levy a tax upon personal income and the sixteenth amendment was a short sited attempt to pay for a war we should never have entered.

    Pollock v. Farmers' loan and trust clearly shows Paul's argument is indeed valid. The briefs of the majority opinion predicted the real effect of an income tax in a democracy. By 1945 the personal income tax got all the way up to 94%, it never stops to raise when the fair share argument is in play

  • If article 1 section 8 provides the ability to tax in a global sense as the IRS does, then why did we find it necessary to pass the sixteenth amendment?

    Dr. Jorg Busse & I are currently in The 11th Circuit Cour t of Appeals over The State of Florida claiming approximately 90% of our waterfront property without any authority or eminent domain proceedings. Supposably this is against The Florida and US Constitutions but that hasn't stopped them. Here The State of Florida took Private Property for Private use without Eminent Domain!

  • Ironically, the 3/5ths clause favored the anti-slavers, not the slavers. The slavers wanted to increase their numbers in the House. The 3/5ths was a limit on their apportionment. SC and GA, as usual, were ready to blow the whole thing up. A sensible compromise, a monument to the stupidity of the slavers. It had nothing at all to do with how human or non-human a slave was. A slave was a slave.
