Tens of thousands of people will still die because it doesn't go into effect for another 6 years. What do you say to those who are going to die waiting for its enactment ? There is just no arguement you can use against me to justify mandatory health care. Even income taxes. I can choose not to work or get paid cash to avoid paying taxes. Forcing me to purcahse health care so everyone else is equal is not a Consitutional Republic. I would respect someone more who just comes out and says it. Yes it is forced, but deal with it.

  • It is mandatory to have car insurance to pay for the OTHER PERSON'S CAR. In Texas, you can opt out of car insurance if you send 55k into a savings account at the capital or if you have over 13 cars it isn't required.  In other words, if you show you can pay for the other person's car, you don't need insurance. So how does your analogy work?

  • The 55k is your insurance. Insurance companies only cover up to a certain amount and anything past you are liable, correct? It's the same thing.

    But you are responsible for paying for the other person's car. That is why when you have payments you get full coverage because the car you drive isn't yours.

    It is to pay for the other person, not yourself.

I don't use the freeways, are you suggesting that I can opt out, are commercial enterprises taking my money? Come on, they drive there damn trucks on it all day long for profit. That is big fat subsidy to the supply chain industry? Or is that the price I pay for living in society?

  • @cdog4100 Freeways are paid for by taxes on tires, oil, gas, etc. The more you use those things, the more taxes you pay. So the more you use public roads, the more you pay to have them. Is that an unfair policy? I claim it is fair.

    The discussion DTD and I were having ended up with a kind of robin hood principle. He felt that he was entitled to other peoples possessions. I said that no, they can choose to give or not to give, outside of taxes. Without that choice, it is theft.

  • @freakawill2000 Only 70% is funded by fuel fees, the other 30% is a big fat kiss to motorist (general fund money shared amongst state), and the 70% still is not a use tax i.e., people with more fuel efficient cars use more road per dollar than people without.

    I am fully supportive of a single payer system, because I think that the health of other people has an effect on all of us. And I don't need any altruism to get there. I think that it is logical to want to keep the working class healthy.

But this is health insurance reform and forcing me to purchase insurance to provide coverage to others infringes upon my freedoms more than I am comfortable with. Note: it is the forcing that makes me unhappy. I'm fine with helping others out, I just want the choice. Without that choice, I don't agree.

  • @freakawill2000 True, mandating health insurance does infringe on freedoms. But there is always a balancing act between safety and freedom. Here, it is our economic freedom that is at stake. Because the American Hospitals are required to treat critical people, many people without insurance simply wait to the seek help because they can't afford the cheap preventative care at the beginning. (And the severity of the sickness forces there hand.)

  • @freakawill2000 But in waiting, they now will never pay for services rendered, forcing the rest of us to eat the insurance premiums anyway. (Hospitals merely raise there rates to pay for the write off). It may be that this benefit will outweigh the cost issue you are raising (subsidizes for poor people to get base level of care). We spend so much of our GDP on health care compared to other developed countries, and yet we don't aren't ranked as high in service. This might just be a way to fix it.

    And I understand the waiting. I also understand the average cost people pay for doctor's visits. Let's say insurance is 300 a month. You pay that monthly and then you have to go in, it pays 600 for a procedure, let's say your hand was sliced open and needs stitches. Well, if you put 200 a month aside for doctor's visits and didn't have insurance and you go in for your hand, the procedure costs 300 cash. Why? Doctors charge more for insurance payers. That is why prices are high.

  • @freakawill2000 That's just not true. I can tell you unequivocally that hospitals charge more for a single payers than insurance, because insurance companies have better negotiating power. Google "medical bill review" and look at the companies that make TONS of money working for insurance companies beating down hospitals on complex medical procedures. Single payers, however, don't realize that you can negotiate, and don't have time or the power to do it effectively.

    And I can tell you that it is true because that is exactly what happened to my aunt. In fact, you can go through hundreds of doctor's testimonies saying they charge the insurance people more because they don't get as much money from cash payers.

  • @freakawill2000 I don't need anecdotes, I consulted for the industry for 2 years. They raise the rates for individual cash payers because they are non negotiated rates. HMO/PPO rates are significantly lower. When the individual defaults, those losses are allocated across the board. Most insurance plans are based of of HCPCS base rates, and hospitals will over charge by billing duplicate codes. Without medical bill review (services only Insurances comps can afford) the individual gets hosed.

    I know the difference between mine and yours. In yours, the cash payer doesn't pay everything. In mine, they do. So if they default, it costs more. If they pay everything up front, it is cheaper. That sounds reasonable.

Let's move on to the bigger point, because the solution to the problem that you have with insurance companies having to raise premiums to cover defaulters is fixed if everyone has insurance, because then NO ONE defaults. And, they are likely to seek care at an earlier stage (and thus cheaper care). This is exactly what, in theory at least, this health care law does. Will see how it works, but that is at least the economic theory behind it. QED.

    But what about forcing people to buy health insurance? There is no federal grounds for allowing that. State by state, I am unsure. But federally, congress was not given that power except in cases of interstate commerce. If you choose not to engage in commerce, how can it be regulated? I know that is a talking point, but I want to see an argument against it.

  • @freakawill2000 Well, as I understand the supreme courts interpretation of the interstate commerce clause, the Supreme court has interpreted that Fed Gov't can regulate any economic activity that, in aggregate, has an effect on interstate commerce. Wickard v. Filburn, 317 U.S. 111 (1942) is Supreme court case that everyone cites. Its a big one, can probably find it on wikipedia, and it will likely upset your sense of Federalism. (It does for me.)

United States (1964), and even illicit drugs (sorry no cite for that one). The constitutional challenge to the health care law is a long shot . . . but it is likely that Thomas will agree, because he is an originalist and likely hates the decisions I just cited. But they are law, and stare decisis has some pull.
