Game Stores and Video rental places have had the game just in the back/storage, having friends who work or if you work in one you can get any game sooner the the release date there's lots of people online already and have been for a few days now on Xbox Live

Actually, a lot of games lately have been released early, usually it's because the game is "Street Dated", or some call it "Shelf Dated". Which means stores get it a week or two ahead of the release so that they can prepare for a midnight launch, or just to make sure it's sold on time.

Some stores, usually the small business ones or Walmart sell it the moment it arrives, usually because they don't know or care.
