So, I've a question...If the Supreme Court ruled it unconstitutional for anything except brief detainment to make nationality status requests, why do all of the checkpoints check for drugs, criminals, among other things? Several checkpoints have large signs proclaiming the number, or amount or weight, etc of drugs or aliens who have been caught there to date. HOW is this permitted to go on if the USSC has clearly ruled against it, declaring it unconstitutional?

Further, the Supreme Court only hears about 80 cases a year out of about 8,000 requests & bringing a case all the way through the appeals process is hugely expensive & time consuming. My own civil rights lawsuit is well into it's 8th year after spending a year prior to filing it successfully defending myself against trumped up charges at a checkpoint.

@wpw232: Even at DUI checkpoints, you have a right to remain silent (Fifth Amendment) and a right to not have your vehicle searched (Fourth Amendment), except for exigent circumstances. For example, you can leave the windows rolled all the way up. You MAY be required to present your driver's license, proof of insurance, and registration, but all the laws I've seen only say "present" or "display" and not "hand over", so it should be fine to show them through the window.

Do you have to answer their questions at all? In United States v. Martinez-Fuerte they have deemed a brief interaction to determine immigrations status. But if you dont answer ANYthing they have no probable cause to send you to secondary. So again if you dont answer their questions do they have to let you go after a brief interaction or must you answer questions reguarding your immigration status? p.s. I dont know too many "illegals" from Canada but I know alot of "BC Bud" crosses through there which seems to support your claims of general law enforcement activities, not simply "obtaining Immigration status". This one is located over 40 miles inside the country along a highway that never intersects the border - it runs East-West. As such your question regarding paying attention to people crossing the fence is irrelevant here or at the very least should be directed to the Border Patrol agents who aren't actually patrolling the border.

This particular agent had called my place of employment several times prior to this encounter complaining about me exercising my rights and attempting to get me in trouble with my employer guitarvirtuoduder. I hate how people complain about our Nation's Checkpoints. I'll give you an example of how this is done everyday I pass through the checkpoint on my way to work.
Example:
Agent: Hello Sir, how are you doing today?
Citizen: Fine officer.
Agent: Please state your citizenship?

Agent (after reviewing documents): Thank you sir. Have a safe trip.

License plate numbers are part of the public record & are just as subject to being recorded & displayed in a public medium as federal agents operating along public highways.

I used to show my passport at the CP (w I dont have to). I got more scrutiny afterwards. Then attitude because I now refuse to show it. I would allow the agents to search me. I was very accomodating and the result was I got treated worse and worse One agent helped him self to the contents of my wallet and told me his supervisor was in on it too.

That official did have the right and obligation to remove you from the vehicle and detain you for questioning and search. All of the officials at that checkpoint did not do their job. These BP agents on the other hand did think I was special. They thought I was so special that the agent at primary had actually contacted my workplace weeks before this video to complain about me exercising my rights.
By her contacting my workplace beckie220, the agent made it clear she knew who I was & by extension my immigration status. This in turn invalidated any pretense she may have had to detain me regarding my immigration status. See how that works?
Regarding the BP coming to my workplace to take me in, I can assure you they'd answer all my questions via my attorney during the discovery phase of the ensuing legal action if they were to be so foolish. And trust me, I have a LOT of questions....
Finally, SR86 in Southern Arizona is a public highway operated & regulated by the State of Arizona, not the federal government & certainly not the Border Patrol beckie220. In fact, according to the Arizona Department of Transportation, the Border Patrol had failed to apply for an encroachment permit for this particular checkpoint the last time I checked. That means this is not only not they're workplace but they're illegally interfering with Arizona traffic.
Too bad they're wasting money on illegal arrests and search instead of repairing that awful road surface. Of course, repairing the road surface wouldn't serve oppression.

So, I've a question...If the Supreme Court ruled it unconstitutional for anything except brief detainment to make nationality status requests, why do all of the checkpoints check for drugs, criminals, among other things? Several checkpoints have large signs proclaiming the number, or amount or weight, etc of drugs or aliens who have been caught there to date. HOW is this permitted to go on if the USSC has clearly ruled against it, declaring it unconstitutional?

Further, the Supreme Court only hears about 80 cases a year out of about 8,000 requests & bringing a case all the way through the appeals process is hugely expensive & time consuming. My own civil rights lawsuit is well into it's 8th year after spending a year prior to filing it successfully defending myself against trumped up charges at a checkpoint.

@wpw232: Even at DUI checkpoints, you have a right to remain silent (Fifth Amendment) and a right to not have your vehicle searched (Fourth Amendment), except for exigent circumstances. For example, you can leave the windows rolled all the way up. You MAY be required to present your driver's license, proof of insurance, and registration, but all the laws I've seen only say "present" or "display" and not "hand over", so it should be fine to show them through the window.

Do you have to answer their questions at all? In United States v. Martinez-Fuerte they have deemed a brief interaction to determine immigrations status. But if you dont answer ANYthing they have no probable cause to send you to secondary. So again if you dont answer their questions do they have to let you go after a brief interaction or must you answer questions reguarding your immigration status? p.s. This one is located over 40 miles inside the country along a highway that never intersects the border - it runs East-West. How am I picking on these poor armed federal agents JAOB3? I didn't stop, seize, detain & interrogate them. They're the ones that initiated the contact without my consent by seizing me along a public highway & interfered with my travels absent suspicion to believe I'd violated any law they have jurisdiction over.
Why would I waste my time beating my head against a Congressional wall when I can show the country what a stand up job these Border Patrol agents are doing not patrolling the border?

Great illustration of legal U.S. citizens being harassed, yet the feds claim they can't racially profile, even though the majority of illegals are hispanic. I think that is why they ask EVERYONE, regardless of your race if you're a U.S. citizen. I was asked that question on westbound I-10 in west Texas by border patrol a few years ago. I was tired from driving all day & that question didn't register with me right away. I said "What???" Oh yeah I am!

im pretty sure that arguing the law at the checkpoint is not the way to go. just keep us updated on the court issue and hopefully it makes a change in protocol with agents. the camera is definetly proof but it only adds to the problem at the border. because sadly, some agents are not in their rights as well. or are confused. if you can tell who they are then by all means just deal with it and move on. theres no need in getting upset at the checkpnts everytime.

This particular agent had called my place of employment several times prior to this encounter complaining about me exercising my rights and attempting to get me in trouble with my employer guitarvirtuoduder. This of course meant she knew exactly who I was & my immigration status making it clear these checkpoints aren't really about illegal immigration but rather a mechanism for training the general public to be obedient to arbitrary interference in their daily lives by armed gov't agents.

Additionally, the last time I gave a cop/agent the benefit of the doubt & rationally discussed the legalities behind my position while being seized at a checkpoint, I was dragged out of my vehicle, held for hours in hand cuffs along the side of the road & maliciously charged & prosecuted.

They seized me and then made "a big scene" out of the fact that I chose to exercise my rights to not answer their questions.
BTW, Border Patrol agents need consent or probable cause to search at any location removed from the border or its functional equivalent. 25 miles has nothing to do with it.

I hate how people complain about our Nation's Checkpoints. I'll give you an example of how this is done everyday I pass through the checkpoint on my way to work.
Example:
Agent: Hello Sir, how are you doing today?
Citizen: Fine officer.
Agent: Please state your citizenship?
Citizen: US Citizen, here is my passport card and ID.
Agent (after reviewing documents): Thank you sir. Have a safe trip.
This process take but 2 to 3 minutes. The way this idiot does things is to get attention and hopefu

While I apologize that license plate numbers occasionally fall into the field of view of my camera while I'm being seized absent suspicion by armed Border Patrol agents at suspicionless checkpoints inside the country, there's not much I can do about it & there are no laws prohibiting it. License plate numbers are part of the public record & are just as subject to being recorded & displayed in a public medium as federal agents operating along public highways.

I used to show my passport at the CP (w I dont have to). I got more scrutiny afterwards. Then attitude because I now refuse to show it. I would allow the agents to search me. I was very accomodating and the result was I got treated worse and worse One agent helped him self to the contents of my wallet and told me his supervisor was in on it too.
I went on DHS website there is NOTHING in there on how to file a complaint. NONE. You think Checkpoint is a pain in the ass?? Maybe he is GOOD!

You need an education in peaceful protest. First of all when an official ask for compliance. COMPLY! That official did have the right and obligation to remove you from the vehicle and detain you for questioning and search. All of the officials at that checkpoint did not do their job. Actually agents need consent or pc to extend a detention or search jamesshaler. That's why I wasn't arrested. If you want to read about an encounter where I was arrested, see my website & blog. By her contacting my workplace beckie220, the agent made it clear she knew who I was & by extension my immigration status. This in turn invalidated any pretense she may have had to detain me regarding my immigration status. See how that works?

Finally, SR86 in Southern Arizona is a public highway operated & regulated by the State of Arizona, not the federal government & certainly not the Border Patrol beckie220. In fact, according to the Arizona Department of Transportation, the Border Patrol had failed to apply for an encroachment permit for this particular checkpoint the last time I checked. That means this is not only not they're workplace but they're illegally interfering with Arizona traffic.
